⤷ joemyman I was at the restaurant for my birthday and when the waiter brought the cake my friends started singing. In the middle of the song I saw YN and Joe walking past our table, holding hands and being all cute. Immediately we stopped singing and stared at them with amazement.

Honestly I don't have a lot of thoughts on 818 Tony; Jason Aaron's entire Avengers run has been kind of mediocre for me. It's not bad! It's definitely not bad. It's just... there. And the whole Avengers Forever premise ought to be something I love because I really enjoy multiverse stories and I like the idea of 818 Tony assembling a multiversal Avengers team a lot. It's just that when I read it I don't really find it all that exciting.

I do like the whole concept of 818 Tony and I find it really interesting that he's Ant-Man. I was kind of getting Noir Tony vibes from him at the beginning of Avengers Forever, and that's always nice. I liked the most recent issue well enough; I really liked that he got to experience some personal growth and sobriety in a way that seemed really well-earned in the narrative, to me. And I think that "you don't have to be perfect to save the world" is a nice moral. So, yeah, that part's been good.

I'm glad that Jason Aaron seems to like Tony as a character and wants to portray him as a hero and has a take on him that more or less accords with how I see him and as far as I can tell how most of fandom also sees him; I feel like the recent... several... Iron Man runs have demonstrated that we cannot really take any of that for granted. So that's good.

(The part of current canon I have actually really, really been into lately is AXE Judgment Day, and that was 616 only.)

You’d had enough of his teasing, “Get up Loki”. The rest of the team all gasped, showing different levels of excitement. You were currently training with; Loki, Thor, Steve, and Bucky.

The entire time Loki kept making comments, his arrogance on another level for some weird reason. The reason it made you mad was because unlike the others, you defended him. You’d even gotten close with him, but lately he’d been acting weird around you.

Loki just laughed, “Oh come on pet-”. You rested a hand on your hip and fake pouted. In a mocking tone you asked, “awe is asgard’s bad boy afraid…”. All of the other men erupted with laughter, while Loki gritted his teeth.

His voice was low, “Love don’t-”. The thing about you was that you weren’t just a normal human being. You had ancient magic running through your veins, giving you multiple abilities.

By opening your fist you used your powers to pull Loki towards you. Your hand rested against his chest, “Don’t what?”. Thor was laughing the loudest, this was the most amusing to him.

Thor clapped his hands, “Come on brother lady (y/n) is a very worthy opponent”. You watched as Loki rolled his eyes, but smirked. Looking down at you he said, “Fine”. You smiled right back and pushed him backwards.

Loki laughed softly while catching his balance again. His hands quickly went behind his back as he pulled out his two daggers. Planting your feet you held out your hand to the left, summoning one of the many swords.

You played around with the sword, tossing it from hand to hand, even spinning it. Loki was leaning forward his back slightly bent, “Any moment now darling”.

Shaking your head you clicked your tongue, “Silly little Prince, don’t you know the importance of foreplay?”. Bucky smacked Steve’s shoulder as he burst out laughing.

Thor looked to his friends while whispering, “Oh this shall be fun”. Steve found himself smiling, watching how into this you were getting.

Loki’s laugh was so low it was almost a growl. He tried to use it as a distraction, and came running towards you. You’d planted your feet and remained centered so he couldn’t phaze you.

Holding your ground you moved your sword side to side, watching it collide with his daggers. As his first swung forward you ducked down and swept his legs out from under him.

Thor laughed loudly while watching his brother knocked onto his back. You smirked while looking down at him, and Loki just licked his lips. As quickly as he could, he got back to his feet.

He started to walk around you, like how a predator circles his prey. You moved with him, holding his gaze. Loki faked you out, making you move forward, “Oh love..it’s not fun being teased huh?”.

Charging at him you said, “I think you like it Loki”. He gripped your arm, making you drop your sword. Using his own magic he sent it flying across the room, leaving you with just your hands.

You swung your arm back knocking him in the face, and wrapped your other arm around the back of his neck. Using your strength you pulled him down and flipped him over onto his back again.

Moving faster than he could you straddled him, pinning his arms down. You’d forced him to drop both his daggers, making you both equal now. Loki watched you, awaiting your next move.

You let go of his left wrist and patted his cheek, “Maybe next time Loki”. Once again he laughed softly, but a devilish grin appeared across his face. Suddenly Loki forced you onto your own back as he pinned down both your wrists, copying your last move

You were breathing deeply, and you couldn’t stop your mind from going to dirtier places. The smirk on his face grew, pulling you from your thoughts. He whispered softly so only you could hear, “Oh pet..I think it’s you who likes to be teased”.

He got up, pulling you with him. Loki wasn’t done yet while winking he said, “Don’t worry love I like it just as much”. You felt daring, and didn’t want to give him the upper hand.

Once again you rested your hand on his chest, quietly saying, “Awe love I’m just getting started”. You pushed him back again, and Loki laughed while watching you walk away from him.

Thor knew that look from anywhere, and smiled to himself as you joined him and the other men. While looking up to you Thor said, “I don’t know what you’ve said to my brother lady (y/n) but I would be careful...that look of his-”.

After sipping your water you turned around and watched Loki. He winked at you before snapping his fingers and vanishing from the room. Gathering your things you said, “I know exactly what I’m doing”.

Kata Containers in Screwdriver

Screwdriver is a scalable CI/CD solution which uses Kubernetes to manage user builds. Screwdriver build workers interfaces with Kubernetes using either “executor-k8s” or “executor-k8s-vm” depending on required build isolation.

executor-k8s runs builds directly as Kubernetes pods while executor-k8s-vm  uses HyperContainers along with Kubernetes for stricter build isolation with containerized Virtual Machines (VMs). This setup was ideal for running builds in an isolated, ephemeral, and lightweight environment. However, HyperContainer is now deprecated, has no support, is based on an older Docker runtime and it also required non-native Kubernetes setup for build execution. Therefore, it was time to find a new solution.

Why Kata Containers ?

Kata Containers is an open source project and community that builds a standard implementation of lightweight virtual machines (VMs) that perform like containers, but provide the workload isolation and security advantages of VMs. It combines the benefits of using a hypervisor, such as enhanced security, along with container orchestration capabilities provided by Kubernetes. It is the same team behind HyperD where they successfully merged the best parts of Intel Clear Containers with Hyper.sh RunV. As a Kubernetes runtime, Kata enables us to deprecate executor-k8s-vm and use executor-k8s exclusively for all Kubernetes based builds.

Screwdriver journey to Kata

As we faced a growing number of instabilities with the current HyperD - like network and devicemapper issues and IP cleanup workarounds, we started our initial evaluation of Kata in early 2019 (  

https://github.com/screwdriver-cd/screwdriver/issues/818#issuecomment-482239236) and identified two major blockers to move ahead with Kata:

1. Security concern for privileged mode (required to run docker daemon in kata)

2. Disk performance.

We recently started reevaluating Kata in early 2020 based on a fix to “add flag to overload default privileged host device behaviour” provided by Containerd/cri (https://github.com/containerd/cri/pull/1225), but still we faced issues with disk performance and switched from overlayfs to devicemapper, which yielded significant improvement. With our two major blockers resolved and initial tests with Kata looking promising, we moved ahead with Kata.

Screwdriver Build Architecture

Replacing Hyper with Kata led to a simpler build architecture. We were able to remove the custom build setup scripts to launch Hyper VM and rely on native Kubernetes setup.

Setup

To use Kata containers for running user builds in a Screwdriver Kubernetes build cluster, a cluster admin needs to configure Kubernetes to use Containerd container runtime with Cri-plugin.

 “Oh Alex,” I rub my temples in stress as I open my apartment door. “Another bouquet of flowers?”

“You say it like it’s a bad thing,” his voice is muffled from the overwhelming bouquet of pink lilies.

“I still have the flowers from last time sitting on my counter.” Despite my words, I move to the side to let him in. “And the time before that.”

“Maybe it’s a sign of how good of a boyfriend I’d be,” he moves the bouquet to wink at me.

“Or it’s a sign you’re giving me way too many flowers.” I fill a vase up with water and set it on the counter.

I take the flowers from him and cut the bottoms off, eyeing him out of the corner of my eye as he sits at my counter stool and watches my movements.

“Why are you staring at me?” I demand, plopping the flowers into the vase.

“I’m just admiring your ass.”

“That’s what every girl wants to hear,” I snort. “Tip, when you’re trying to get a girl to date you, don’t mention that you’re staring at her ass.”

“I won’t have to ask another girl to date me because you and I are gonna end up together forever,” he objects, “And I’m staring at more than your ass. I’m staring at your eyes that sparkle. I’m staring at your cute, button nose. I’m staring at those kissable lips.”

My breathe heavies as he reaches a hand out, tracing my lips gently with his index finger.

I watch him with inquisitive eyes as he watches me with dark blue ones.

His hand slithers down to grip my jaw softly.

The sound of kids yelling and laughing outside breaks us out of our trance.

Or me, at least.

I turn away from him and cough awkwardly, moving to wash a pan in the sink. “So when is your next game?”

“What do you want for Valentine’s Day?”

I look up at him from my phone, a confused expression covering my face.

I blush as I notice he’s already staring at me.

“Why would you get me something for Valentine’s Day?” I ask.

“Well, you’re my girlfriend.”

“Galchenyuk, we’ve talked about this,” I sigh in exasperation, reaching my foot over to gently kick his shin.

He grabs my foot suddenly, yanking it so my other foot ends up in his lap as well.

He rests his arms over my shins so I can’t move.

I roll my eyes.

“And I still don’t understand why you won’t date me.”

“Well, one, it wouldn’t be fair to him, two, I’m afraid a relationship will ruin our friendship,” I list.

“Y/N he said it was completely fine with him!”

“You asked him?” I screech.

Alex and I met because I used to date one of his friends.

Obviously me and that guy broke up, but Alex and I remained friends.

Ever since Alex found out we broke up he’s been asking me to go out with him.

And every time, I say no.

“Well I didn’t ask him,” the tall man denies, “I kept talking about how gorgeous, smart, funny, talented, charming, passionate-“”Continue with the story,” I interrupt, but the blush creeping up my neck is undeniable.

“And he said that if I ever wanted to ask you out, I could.” He pauses. “This was after the first ten times, by the way.”

I roll my eyes but a smile makes its way onto my face.

“What was your second excuse? Oh yeah.” He moves and before I know it, his heavy body is looming over mine.

His hands are pressed on either side of my head to keep me from moving (not that I want to).

His blue eyes look at me intensely and I just stare back blankly.

“Our friendship will never be ruined because we’re going to go on a bunch of dates,” one of his hands move to push my hair out of my face gently, but his eyes don’t move from mine. “Then we’ll meet each other’s families.”

He leans down to kiss my temple, but then leans back up to connect his eyes to mine.

“Then we’ll move in together.” His hand slides along my body on the couch.

“Then we’ll get engaged.” He grabs my left hand and examines my ring finger.

My heart flutters at the thought of a ring decorating it.

“Then we’ll get married.” This time he puts his hand against mine and laces them together.

“Then we’ll have a couple of kids.” It detaches to slither down my body to rest on my stomach.

My breath catches in my throat at the thought of our possible future.

“How many do you want?”

“A couple,” I reply softly.

He smirks, knowing he’s got me.

He leans down to pecker my neck with kisses. “What do you say, love? Do you want that?”

“Yes.”

COMES NOW PLAINTIFF RANDOLPH FRANKLIN AND PRESENTS HIS CONFIDENTIAL MEDIATION BRIEF: INTRODUCTION

This matter now consists of two causes of action against the defendants: legal malpractice and Common Count. Plaintiff s pleadings have withstood a Motion for Summary Judgment and the matter is set for trial on February 6th, 2012, in Department 62 of the Los Angeles County Superior Court, Judge Michael L. Stem, presiding. STATEMENT OF THE CASE Plaintiff Randolph Franklin, now a 27-year veteran of the Los Angeles Police Department, filed his First Amended Complaint in the action against the within defendants on the grounds that they committed legal malpractice both in the pre-"trial and trial proceedings leading to the loss of the $4,250,000.00 claimed as damages during argument to the jury in the underlying case by defendant John E. Sweeney. The matter arose as a result of the service of a search warrant, the affidavit for which was prepared by Los Angeles Police Department [hereinafter"LAPD."] officers Leikam and Morgan, upon plaintiff s residence which was one of three locations searched during the investigation of an attempted homicide. The affidavit for the search warrant states that plaintiff s residence is a "...known Four-Trey gang hangout," that "There have been numerous citizen complaints of gang activity and blatant narcotics sales/use at the iocation." that suspect "...Emmit Bond frequented the location." and that "...Emmit Bond delivers narcotics and stashes weapons at the location." The 4:O0 A.M., May 25, 2006, search of plaintiff s home uncovered no evidence whatsoever in connection with attempted homicide investigation and, although plaintiff was never arrested, a Departmental Complaint was filed against him. An Internal Affairs investigation into that Complaint was conducted and that investigation concluded that "...there w no evidence to indicate that F's residence was a ban - t embe aou for an m rs narcotics location orthaassociated with or hired knownan members or felons. As a resull;, all of the allegations were unfounded." A copy of the Report of that investigation was given to our defendants by plaintiff months before their initial complaint was filed. Franklin went to the Sweeney Law Firm and specifically requested that a "42 U.S.C. 1983" lawsuit be filed against the officers who lied on the search warrant against his residence. Sweeney filed a complaint in state court against the City of Los Angeles, the LAPD and officers Leikam and Morgan (hereinafter, the "underlying defendants.") consisting of four causes of action: 1) 42 U.S.C. 1983 (hereafter, "1983"), 2) negligence, 3) Unruh Act and 4) Infliction of Emotional Distress The legal malpractice alleged herein began after counsel for the underlying defendants removed the underlying initial complaint from state court to Federal Court given that the first cause of action of said complaint alleged the 1983 violation, a federal cause of action and the only cause of action specifically sought by plaintiff in retaining these defendants. Defendants and each of them, in derogation of their duties under the Business and Professions Code 6068(m) ["It is the duty of an attorney to do all of the following: ... , (m) To respond promptly to reasonable status inquiries of clients and to keep clients reasonably informed of significant developments in matters with regard to which the attorney had agreed to provide legal services."], and Rule 3-500 of the Rules of Professional Conduct concerning communicating significant case developments to client, failed to notify plaintiff that the matter had been removed to Federal Court. More importantly, they failed to inform and discuss with plaintiff their intent to dismiss the 1983 cause of action.. They then, without the knowledge or permission or consent of plaintiff, and, while in possession of the Internal Affairs Investigative Report establishing that the allegations by officers Leikam and Morgan in the affidavit for search warrant were false, voluntarily and unilaterally dismissed the 1983 cause of action in a successful effort to remand the matter to state court without the 1983 cause of action. The dismissal of said cause of action is all the more grievous in that, had the matter been prosecuted in Federal Court, the defendants would have had to prove only two elements to sustain a 1983 claim: first, that the underlying defendants acted under color and authority of law (inasmuch as the underlying individual defendants were officers of the LAPD, this was a given); and second: that plaintiff s Fourth Amendment rights were violated. The jury in the underlying trial, in special verdicts, specifically found that both underlying officer defendants deliberately falsified information in the affidavit for the search warrant of plaintiff s home. Thus, upon the same evidence as was presented to the Superior Court jury, a federal jury would have found for plaintiff on his  1983 cause of action without the need of any additional findings. The effect of this misfeasance both forced plaintiff and our defendants to shoulder a heavier evidentiary burden in state court as well as forever depriving plaintiff of the opportunity to prove that his Fourth Amendment Rights under the Constitution of the United States were violated.. Then, after secretly disposing of his best and most easily provable cause of action, Sweeney correctly told plaintiff - who, at this time, labored under the erroneous belief that his sought 1983 cause of action was still viable - that his ease was "...thin, that it was risky... ," and that he (Sweeney) would not proceed unless plaintiff he was paid a $25,000.00 fee, thereby making Franklin personally assume a financial risk in going to trial. Without the 1983 count the case was thinner by magnitudes and the risk of defeat at trial was increased. But, plaintiff was unaware of the dismissal of his specifically desired cause of action and paid the $25,000.00. Plaintiff testified at his deposition that had he been informed that the defendants intended to dismiss his desired 1983 cause of action he would have terminated his relationship with our defendants and sought new counsel. While in trial the defendants unilaterally dismissed viable counts and defendants, all without informing plaintiff of their intentions or seeking and obtaining his permission and/or consent. The Infliction of Emotional Distress cause of action in the underlying action was plead in the alternative and reaffirmed in Sweeney's Trial Brief in the underlying action; alleging both the negligent and intentional infliction of emotional distress. Yet, our defendants submitted joint jury instructions with the underlying defense [instructions which Sweeney, at his deposition, admitted he never read}omitting any instruction concerning the negligent infliction of emotional distress. Again, there was no discussion with, nor consent, of plaintiff. The resultant harm to plaintiff was palpable: instead of having to convince the jury that the underlying defendants acted with reckless disregard of the probability that the occupants of the Franklin residence would suffer emotional distress at being awakened at 4:00 A.M. and notified that their house was surrounded by an LAPD SWAT team whose leader ordered plaintiff and his children to come out of their residence; our defendants took upon themselves the unnecessary, and eventually, fatal burden of proving that Leikam and Morgan specifically intended to cause Sgt. Franklin emotional distress. [It must be noted that the SWAT commander gave Franklin 20 minutes to awaken and clothe his children before bringing them out.] Despite the above instances of legal malpractice, the case went to the jury after Mr. Sweeney argued that Leikam and Morgan's misbehavior in lying on a search warrant affidavit caused Sgt. Franklin $4,250,000.00 in damages; broken down as follows: $1,000,000.00 for the incident itself; $500,000.00 for the residual effects of his emotional distress over each of the following two years; $100,000.00 each year for the residual effects of the emotional distress over the following 20 years

The Court then reassembled the jury and instructed: "...I' m not here to speculate as to why you asked that question, however, please keep in mind, do not allow anv passion. prejudice sympathy or bias to enter into your deliberation proce " So, despite the Court's stated intention to disabuse the jury of any concern as to ability of the officers to pay any awarded damages...it did not do so. What did Sweeney and Powell do? :hipKl They sat mute at counsel table. At this moment, thts_ moment, when even a modest request, such as "May we approach the bench, your Honor ...," to address the failure of the Court to properly answer the jury' s question and do what it said it would do, the defendant' s earlier instances of legal malpractice were greatly exacerbated by their failure to utter a sound. Not even a peep from Sweeney, who had, on numerous occasions during the trial, gone toe- to-toe with the Court. The Court and all counsel understood - or should have understood - that the jury's question was the crux of the underlying case: not "did the officers lie?" or "was their conduct outrageous?" (specific facts the jury found true on their special verdict form) but who would pay any judgment? Why would the jury have written the question unless they had already determined that the officers lied on the affidavit and were ready to make an award? By specifically eliminating the City and the police department as the potential sources of the payment of any judgment, the court effectively told the jury that any monies they awarded would come from the pockets of Messrs. Leikam and Morgan. At this moment, when the situation cried out for zealous advocacy on behalf of Sgt. Franklin...our defendants condemned him. This, too, was professional malpractice writ large. Mr. Franklin was twice betrayed in his odyssey through the justice system: first, by officers of his own Department in their perjurious affidavit; and second, by his counsel for dismissing and keeping from him that dismissal of his sought 1983 cause of action, by extorting $25,000.00 from him to continue representing him in a case made demonstrably weaker by that dismissal, by their failure to tell the Judge that the officers were sued in both their individual and official capacities, and most egregiously, by their abject silence when the fate of their client hung most precariously in the balance after the Court failed to act as it said she would by failing to tell the jury that the issue of who or what would pay any judgment was NOT for their consideration. Sure enough; shortly thereafter, the jury found in favor of the officers on the issue of intent and the case was lost.

Given the above recitation of the defendant's nonfeasance, misfeasance and malfeasance concerning their representation of Sgt. Franklin in the underlying proceedings, it is respectfully submitted that their legal malpractice contributed most materially to their failure to properly represent Mr. Franklin in the underlying proceedings and that the measure of his damages should approximate the figure argued to the jury by defendant Sweeney: $4,250,000.00. However, for purposes of settlement, plaintiff's demand is 850,000.00.

CONCLUSION Given the above-recited examples of the legal malpractice of defendants Sweeney and Powell, it is respectfully submitted for the purpose of settlement that plaintiff Randolph Franklin has suffered damages in the amount of $850,000.00.
