The police department failed again, yesterday, in actions taken against Montreal cafes, cabarets and night clubs for non-observance of the curfew law, when, before Recorder Amedee Thouin, a batch of cases made against the Grand Gardens, an east end cafe, and Chez Maurice, a west end night club, were thrown out of court. The reason: the police erred in issuance of the summonses.
In dismissing the complaints - 29 in all - the recorder sided with the defence attorneys in the argument that the police had taken illegal action against individuals, when the cases were made against incorporated establishments. In the first batch of cases, Peter Lee, manager of the Grand Gardens, was branded as the accused, when the cafe in question, incorporated under the name of Moonlight Garden Amusements, Limited, had allegedly committed the by-law infraction. In the other batch of cases, Phil. Maurice was named as the accused, when the offence was allegedly committed by Chez Maurice, Incorporated.
"In the case of an incorporated company one with letters patent issued by Quebec the company alone can be charged for infraction of the law, and not any individual connected with the com pany," Recorder Thouin ruled, in dismissing the actions. He added that summonses must be issued in the name of the companies.
The charges against both establishments included those of having given theatrical representations after midnight, having permitted dancing after midnight, and infraction of the Lord's Day Act by permitting dancing to go on until early Sunday morning.
TOTAL OF 89 CASES.
Dismissal of yesterday's charges, brought the total number of curfew law cases made by the police department and dismissed in the Recorder's Court for faulty prosecution to 89 in all. The bulk of the cases were dismissed following successful pleas by defence attorneys to the effect that charges were erratic, the complaint being one of "having a dance hall licence, you did permit dancing to go on after midnight." But it was proved In court that none of the establishments including the Cosy Grill, the Frolics, the Imperial Cafe, the Casino Cafe, etc. boasted of a dance hall licence, though they did have a licence permitting them to give theatrical representations.
Another batch of cases made on the grounds that theatrical representations were given after midnight, is booked to come before the Recorder's Court on Thursday for judgment In these cases, the defence have asked for dismissal of the. complaints on the grounds that the actions were illegally taken, having been issued in the name of the Recorder's Court of Montreal and not in the name of a recorder. Their argument is that the Recorder's Court has no jurisdiction whatsoever, and that it cannot summon an individual as it is not a person or a corporation.
Judgment in this argument is booked to be handed down by Recorder G. H. Semple.
