heres an ask because i too am desperate to engage with people. i know u dont care about roxy music but you did say you would accept something as incoherent as a keysmash so here is an equivalent: admittedly i find the dynamics between ANY band and their fans very interesting, but roxy music in particular. there is a peculiar divide between those who are staunch bryan ferry fans (these people typically dont give half of a shit about anyone else in the band), those who are fans of the group as a whole and dont particularly care about individual members at all, and those who are most interested in phil manzanera and andy mackay and sometimes the other guys, who generally quite dislike bryan (i being the latter)- and often there is resentment between the groups. i think its so interesting that a group of people can be presented with the same exact material, love it and enjoy it for years, and yet latch onto different parts of it and make it such a part of their identity that should you confuse one with the other they become insulted, or if nothing else will tell you "no no, i like roxy music but i REALLY like bryan, i think hes the best", or "no no, i love roxy music and im a fan of andy and phil in particular but i dont care for byran much at all, dont get it twisted", etc. are there bands you're more familiar with who have this sort of divide amongst the fanbase? do tell me about them, if you like :>

sorry for taking 39485949 years to post this lmao. i wrote like FIVE entire paragraphs and then had to edit it but it was getting super late and anyway it’s still absurdly long (as in, i can say whatever i want in the below text bc no one is going to want to read it) and definitely devolved into a huge general rant about the annoying and creepy behaviors of some people within band fanbases (specifically ELO-related bc of course) as well as vagueing about my own controversial opinions but......nonetheless.

anyway!!! i find this kind of thing really interesting too!! and i know EXACTLY what you’re talking about. there are just sooo many facets to this, and i guess it’s different for every band. on the one hand i do think it’s kind of an interesting phenomenon bc if you think about it, they’re basically enjoying the same thing but taking wildly different/opposing stances on it. as a whole i would find it a lot more interesting/amusing and less frustrating if people could like...manage these kinds of differences without turning it into some kind of overly vitriolic/super hostile opposition that you would think is about politics or something and not a band we r supposed to be listening to for entertainment purposes. i mean, i 100% get that things don’t have to be Extremely Important to be worth discussing, but it just seems wild the way some people get SO intensely angry about these things, sometimes to the point of being kind of inappropriate. i have a lot of issues with the way some people within band fanbases tend to behave lol

.......anyway the Full Rant is below here (idk why i wrote this bc it’s long enough to be turned in for a grade and it’s only partially relevant. read at ur own risk):

so!! thankfully with most bands i enjoy i just kind of watch the fanbase from the sidelines and don't get too involved in or even aware of all the drama. like...i know about the band and enjoy the music but just manage to not get involved in whatever the community happens to be collectively freaking out about at any given moment. i feel like the kind of divide you mentioned is actually pretty common within band fanbases (i think there are things like this with like...styx and three dog night? among others? but i don't know all the details 👀) but like, FORTUNATELY with most of them i just would not know. that's very nice because i unfortunately do not always have that kind of luxury with the ELO fanbase...idk i have a lot of very strong ELO-related opinions that i usually don't like to discuss in great detail bc i get disproportionately frustrated but yeah basically what you described does kind of happen among ELO fans, although thankfully i'd say it's to a somewhat lesser extent? people are commonly at each other's throats about a variety of topics including (but not limited to) who they support or don't support, but there are still plenty of people who (thankfully) are not so aggressive lmao. there is sort of a divide within the fanbase but i feel like it's probably not so 50/50 as what you're talking about...maybe more like 85/15

THAT SAID, i have frequently commented on the fact that the ELO fanbase is largely a dumpster fire and there is a whole entire sector of the fanbase that is comprised of people who i absolutely cannot stand, and most of them do fight a lot lmao. this is only partially related to the subject at hand, but a good portion of the bickering is relevant to The Divide. like, i'm 100% okay with having a different opinion than someone else as long as they aren't acting like a complete freak about it, but idk, aside from the fact that most of these people are like?? needlessly aggressive?? there are certain opinions held by certain members of the Greater ELO Community that just give me that vibe of like...hmmmm this is a person i probably would not want to associate with at all, even in matters completely unrelated to this. Unsavory Person Vibes. i mean like, “opinions” that just boil down to "i am very very entitled and also incapable of seeing anyone else's perspective on literally anything ever BUT that isn't going to stop me from openly whining about this absolutely whenever possible." like!! it's one thing to have some kind of legitimate, reasonable criticism of an individual or band but some, if not most, of the things i've seen people losing their minds over within this fanbase have been so hilariously trivial that i just CANNOT understand how these people actually managed to get to be (presumably) functional adults who are probably like 50+ years old. i mean like, full-blown tantrums and calling someone all sorts of nasty things over something that shouldn't even be an issue because without exaggerating i cannot fathom how anyone could even be majorly upset about it in the first place. to give an example: someone once had a whole entire little strongly-worded, excessively presumptuous freakout because a guitar was no longer on loan to the rock and roll hall of fame. like...it was there for quite awhile and two out of four inductees loaned absolutely nothing but you're whining because one who DID loan something eventually took it back? do we not know what the word "loan" means? anyway the best part is that basically every time something like this happens, if someone tries to point out that the person is overreacting or perhaps just needs to look at a situation another way, they will then go off on that person bc god forbid we try to be level-headed about things. everything has to be Very Horrible All The Time or we’re doing something wrong or being stupid or something. idk i'm convinced that some people just want to be angry

also just...some of these people do some really shady things that i personally feel are morally questionable but there's nothing i can do about it so i try to just kind of avoid dwelling on it lmfao. like, it's not okay to violate people's privacy just because they're famous and you're overly entitled/nosy/desperate for clout/blatantly trying to profit off of them? i know in the Sane World that's a completely non-controversial idea but band fanbases apparently often aren't based on sanity skhglkshgks idk i could probably write a small novel on this and make a specific list of all the things they do that are just like...bafflingly tone deaf and kind of appalling but i digress. idk the worst part to me is the way they'll be like, saying/doing something that's just awful or like, maybe even totally factually wrong while acting like they're in the right. absolutely wild

to at least somewhat bring this back to what we were ATTEMPTING to talk about!!! personally i've reached a point where i pretty much no longer care about like 90% of anyone who has ever been in ELO (jeffrey/richard/roy/mike de albuquerque supremacy) but i'm not like, actively a Hater of the others lmao. i appreciate that they were there and enjoy the nostalgia(? i wasn’t alive) of it and i’m glad they’re out there existing but i just...don’t really care about anything they do at this point?? a good portion of it is a result of me taking issue with certain things some of them have done, which has impacted the way i feel about them, but MOST of it is really not that deep and it’s just that some of them just don't particularly interest me on that kind of level/i don't feel the need to get that invested in like 927509257 different people (fun fact: during the 1970s every third person in existence on earth was, at least briefly, a member of ELO). there's really only one ELO-adjacent person who i actually very strongly dislike and a) luckily i feel like they barely even count as a member b) the reasoning is kind of its own Thing and has very very very little to do with anything related to the band so it's kind of another subject entirely. anyway that’s as close as i’ll ever get to actually getting involved with any of the Drama sgsdgsdgfhdh. my primary beef is with the fanbase anyway because, as previously mentioned, there are too many insane people. i guess what i’m getting at here is that yeah there’s a divide and it does affect me BUT i also don’t really get why people allow this to make them act in a way that goes beyond just having a difference in opinion and is so overly hostile towards each other as well as the people they’re discussing. like...if anyone involved is a serial killer or something even remotely similar then yeah, being outraged on an extreme level and absolutely hating them even as an outsider makes sense. otherwise? calm down!!!!!

anyway. to wrap up this mostly incoherent rant that i hope no one read: i have always suspected that band fandoms kind of attract certain kinds of very distressingly weird people and i just think it's funny how there's always like, a little cluster of people within the fanbase who basically seem like they actually hate the band (those are almost always the Weird Ones bc i can’t tell you how many times i’ve witnessed a person who is like, into a band to a CREEPY extent and then one day they just flip and become a hater). at that point i'm just like, okay? so why are you still here lmfao. i guess that's the Main Idea of all of this lol. i just don't get why these people stick around when 98% of all they ever do is complain and act overly judgy? i just feel like if my so-called favorite band was making me that miserable i would try to find another band to like instead of becoming a menace to society. that’s just me tho

to bring all of this together i guess i just assume that some kind of phenomenon like this occurs within basically every band fanbase. idk it just seems pretty universal for some reason. certain kinds of people just love drama i guess and will turn any difference of opinion into some kind of shitshow

#every time i talk about this sort of thing i think about how my mom joined some of the elo facebook groups #and after a few weeks she was like omg!!! you were right!!! they're crazy!!! they're FIGHTING with each other!!!#sadly the facebook ppl are actually pretty tame compared to what can be found lurking in other corners of the internet #anyway this mostly just turned into me vagueing about my beef with the elo fanbase again but it's hard not to go there sdhglkhsdgl #also i feel like with a lot of things that cause Controversy within band fandoms it's just like #people getting so angry over things that don't affect them and that the actual people involved aren't even that concerned about anymore #AND ppl assuming they have the whole story on a particular issue when oftentimes it's likely that they don't #whether it's bc the information just isn't out there or because certain sources are obviously going to slant things in their favor #which is not inherently a problem bc of course people have different perspectives but you just can't forget that that's a thing #idk i have.....so many very strong opinions but the idea of being specific about it in a conversation gives me hives #metaphorical hives #anyway thank you for sending this bc i am literally always waiting to rant about weird ppl within band fandoms #eddie-riff

Is Trump A Fascist

Is Trump a fascist? Many people of the American Left like to call Trump a fascist. But is this true? I will be exploring this question by using the essay "Ur Fascism" by Umberto Eco. In this essay Eco lays out the 14 characteristics that fascism has. You might wonder what qualifies him to outline the features of fascism. Eco is a social and political commentator as well as philosopher who grew up in Mussolini's Italy so he seems like he would be quite good.

1. Cult of Tradition - the first characteristic of fascism is traditionalism. Traditionalism tends to want to uphold traditional status quos which means it is opposed to progressive ideas. This is evident in the United States and with Republicans with opposition to gay marriage due to marriage being between a man and woman being tradition since the times of Rome as well as views of abortion, American Exceptionalism - this tends to lead to celebration of the subjugation of natives, American imperialism, and Romanticisation of white supremacist ideas such as Manifest Destiny. The fascist Cult of Tradition also laches itself onto religion to try and give their movement validity in the eyes of the religious as well as making them more likely to support the party. In states such as fascist Italy and Germany this traditionalism also showed itself with mythology. Mussolini wanted to restore the glory of Rome and many prominent Nazis were Norse pagans with Hitler himself having an interest in the occult. Make American Great Again could be seen as a return to American tradition and can link to myths about the greatness of America's past. Trump absolutely stirs up traditional ideas (obviously not to the extent of wanting to restore Rome) and beliefs within his followers. He also aims to appeal to the religious of the country due to the Evangelicals being a key and easy group to win with conservative views.

Here we have Trump standing in front of a church after gassing a bunch of peaceful protestors, he seems to be holding the bible upside down because he doesn't really give a shit and is just performative

2. Rejection of Modernism - The second characteristic of fascism is a continuation of the first. An embrace of traditionalism requires aspects of modern society to be rejected. This usually comes as a rejection of post Enlightenment rationalism and progressive ideas. It can also come in the form of dismissing features of modern society such as media and democracy. This is evident with Trump through his dismissal of media criticism by calling it "fake news" despite not being able to prove it's fake which would be easy if true

3. Irrationalism - This feature is also known as "The Cult of Action for Action's Sake." This feature of fascism believes that action should be taken without thought for reflection on actions. This often appears as a rejection of intellectual thought and science and again can show up as attacks on modern culture such as media. This feature is evident in Trump with his dismissal of doctors and sometimes just ignoring them during the Covid-19 pandemic. It can also be seen again in his fake news attacks

4. Can't accept criticism - Fascism sees criticism of the state as a form of treason so is unacceptable. Fascism also fears such speech being allowed will expose the issues with that system. This can link to Trump in two ways. The first is again with fake news. The second is with his utilisation of cold war propaganda to scare people with no understanding of what Marxism and socialism actually are. He does this by just calling all his political rivals such as Biden Marxists and in one of his totally 100% unbiased surveys implies you are either an American or a radical Marxist

5. Fear of diversity - This feature is pretty self explanatory. Fascism seeks to exploit fears of difference. Due to this fascism is inherently racist and xenophobic. This is also evident in Trump with his anti Mexican comments during his election campaign stirring up anti Mexican xenophobia. It's also somewhat evident by him trying to associate Covid with Chinese people

6. Exploits social frustrations - during times of economic struggle fascism strives to appeal to the middle class and increases divisions between them and lower classes. This isn't done by Trump

7. Nationalism - A fascism form of nationalism is routed in xenophobia and tries to sow distrust of marginalised groups. While Trump is absolutely a nationalist leader with America First and American Exceptionalism he doesn't use nationalism like this

8. Humiliation due to enemies power - The enemy is simultaneously too strong and too weak. From what I can think of, this isn't a feature of Trump

9. Opposition to pacifism - Fascism sees pacifism as collusion with the enemy. Pacifist groups were among the groups that got sent to concentration camps under the Nazis. This characteristic doesn't apply to Trump

10. Elitism - Society has a hierarchy with the party and it's society at the top, those beneath should be looked down upon. While Trump may not do this directly, it is absolutely evident within his followers who see themselves as better than others

11. Heroism - it is desirable to die for the country. Trump does not have this feature at all

12. Masculinity - Women are inferior and sexually non conforming people are also inferior. This can also be utilised as using weapons as a way to express masculinity. In this sense, this characteristic is present in Trump with his staunch defence of American gun culture and the 2nd Amendment.

13. Populism - Fascist populism sees the people as one and the leader as the interpreter of their will. Due to this democracy is no longer present. While Trump is a populist leader he doesn't necessarily do populism in a way that is anti democracy. However, this can be argued against due to his stated unwillingness to accept the election results and calling his supporters to commit acts of voter intimidation

14. Newspeak - Newspeak is the Orwellian idea of simplifying language in order to make dissent impossible, stopping dissent is a key part of fascism. Trump does not show this characteristic

In conclusion, Trump shows at least 8 of these 14 characteristics based on my own quick look at him. While this may be low for Trump personally, within his followers there absolutely is greater amounts of fascist characteristics. It is also possible that he could be slowly building up if he truly is a fascist. also you can probably tell I put a lot more effort into the first section of this than later bits, oh well maybe it'll actually be interesting next time

MALFOY MANOR. first, i wanna say thank you for giving me a reason to ramble on about the malfoy manor. i’m gonna take this time to just talk about everything i possibly could. okay so to talk about the history, i need to introduce you to the first malfoy, the founder of the malfoy manor.

ARMAND MALFOY. armand was a french born wizard who arrived in great britain with the norman invasion ( he gained the friendship of william the conqueror ). he was also the first malfoy in britain. sometime after william I was made king of england in 1066, armand provided various services to the king. while the exact details of the services are unknown, they were known to be shady and magical in nature. ( probably: threatening with hexes, hexing enemies of the king, using various dark spells. ) in exchange for these services, king william granted armand a piece of land in wiltshire, seizing the property from it’s former landholders. the malfoy manor would over the next ten centuries, be the home of the malfoy family. the family would expand the estate even further by annexing more property from surrounding muggles but also gain more riches by coming into contact with muggles and making money off of their ways. properly doing business with them. ( this was before the international statute of wizarding secrecy. of which the malfoys initially opposed the imposition of the statute. upon the realization that further opposition would distance them from the new heart of power being the newly formed ministry of magic, they cut all ties with muggle families and became supportive of the statute. holding all denial that they had ever fraternized with non magic families. ) ( malfoys had historically been associated with high-born muggle circles, such as royalty and aristocracy, which, in part, resulted in their vast collection of muggle treasures and works of art. all of which are stored within the manor. )

I. DRIVEWAY. " they turned right, into a wide driveway that led off the lane. the high hedge curved with them, running off into the distance beyond the pair of impressive wrought-iron gates barring the men’s way… the source of the noise proved to be nothing more than a pure-white peacock, sturring majestically along the top of the hedge. “ — description of severus snape and yaxley walking along the driveway.

the gravel driveway to the manor house is wide and has a large hedge curving alongside it. the driveway and hedge go past a pair of wrought-iron gates. these gates permit select individuals ( those who make some sort of salute ) to pass through them as if they are smoke, and with others the iron contorts into a face, which demands the purpose of the person trying to enter the manor. the yew hedge is known to have albino peacocks roving along the top of it. the outside of the manor is grand and the land surrounding it is vast, filling many acres. those acres contain numerous types of trees and various plant and perhaps other animal life.

II. THE MANOR. " a handsome manor house grew out of the darkness at the end of the straight drive, lights glinting in the diamond-paned downstairs windows. somewhere in the dark garden beyond the hedge a fountain was playing… the hallway was large, dimly lit, and sumptuously decorated, with a magnificent carpet covering most of the stone floor. the eyes of the pale-faced portraits on the walls followed snape and yaxley as they strode past. “ — description of the manor and the entrance hall.

malfoy manor is a " handsome manor house " surrounded by elaborate gardens, including a fountain. the front door swings inward at the approach of a person ( or perhaps just a select group of people ) without anyone visibly opening it. the hallway is large, dimly lit, carpet covering the stone floor. the walls of the entrance hall display pale-faced portraits lining the walls ( presumably former malfoy family portraits ), and at the end of the hall is the bronze-handled door to the drawing room.

III. THE DRAWING ROOM. " the drawing room was full of silent people, sitting at a long and ornate table… illumination came from a roasting fire beneath a handsome marble mantelpiece surmounted by a gilded mirror. " — description of the drawing room.

the drawing room was a widely proportioned room. probably the grandest room of the house, it had ceilings 30 feet high, two chandeliers, and a pipe organ at one end. it had a long ornate table, where the death eaters and voldemort sat during their meeting. also, during the death eater meeting, the usual furniture was pushed carelessly up against the walls. the drawing room has a ‘handsome’, ornate marble mantelpiece with a gilded mirror which has an intricately scrolled frame on top. many of the known activities of the death eaters took place in the drawing room, which had dark purple walls with more portraits, and a large crystal chandelier, which was eventually destroyed by dobby ( their house elf ) during the escape of several prisoners. It was probably restored ( by magic ) to where it was previously hung.

IV. CELLAR. during voldemorts stay in the manor, this room functioned as a holding cell for prisoners. this room is one hundred percent escape proof with only house elves able to bypass the room’s securities. it is below ground level, no light, damp floored, and made of stone with stone beams . the family’s collection of dark artefacts are hidden below within the cellar to prevent any being seized during ministry raids. one such raid having been conducted in december 1992. considering that a vast amount of dark artefacts reside in the cellar, this makes it an immensely dangerous room to step foot in if you’re not fully aware of what is held in the room. touch the wrong thing and you could possibly die.

V. when talking about ace discourse, it is a intracommunity issue. its all lgbt+ people arguing with each other because of how they see things differently. so when addressing the discourse as a whole you have to acknowledge all the sides of it, because there isnt just one. that being said you can still discuss the issues that inclusionists have and the issues exclusionists have just talking about in those groups seperately. i see a lot of posts that discuss the “entirety of the discourse” but just talk about the opposing views they have. thats created a whole bunch of different standards each side has been held accountable for.

this post by @dogsanddiscourse is a great example of how each side is held to different standards. those who participate in the discourse on the inclusionist side do tend to ignore the issues on their side. even when shown how it can be problematic, a majority will still not acknowledge it. a good example of this is the CAH discourse. both sides made a cardcast discourse pack (exclusionists, and the 2 inclusionist ones x x ) and there was plenty of talk about them. for instance the deck made by @x-q-u-e-e-r-x which featured many slurs (none of which have been used in ace discourse) had many people reblog and support it, where as the exclusionist deck got flack for including ace and aro identities. i have pointed out to people that some cards in the inclusionist pack were iffy at best, and no one has yet to acknowledge that. if you have a issue with something (cah discourse packs) you should acknowledge both sides who are doing it, not just the opposite side. (another example if u wanna look at smthing real bad is everything to do with discourseshit)

what i really hate the most is that you cant ask inclusionists to take a look at what someone is doing without 1) “attacking all aces and aros” 2) “accusing a entire side for one persons actions” 3) “being a bigot”.

people (not everyone!! but there are people who rb from these blogs) are continuously reblogging from people who have said straight up homophobic things like acerecourse, uninueclus, wetwareproblem, golbatgender / periegesisvoid, myidentityisnotaslur / memestealingasexuals, featherinmycapandcheese, and ppl like tenichyfingers, theangrybi / robotbisexual, kuroba101, drg-aido, vaspider, strategicgoat, juunkrat (who i havent seen in the discourse tag for a while, but this is why i dont like them) i could go on. there are many popular inclusionist blogs that people will continuously reblog from and support no matter how many times they will be called out. but, on the other side. as soon as a exclusionist has done something problematic they are immediately exiled and cut off (which is toxic and a whole nother discussion for a dif post)

even when not talking about specific people but ideas and symbols inclusionists will never directly address it but instead ignore it. i havent once (pls correct me if im wrong im beggin to b wrong) seen inclusionists speak out about: the ace triangle (a direct parallel to the triangles gay people had to wear in nazi concentration camps), not calling people things they dont want to be called (queer, allosexual), using “we’re here, we’re queer, get used to it” to co-opt cishets into the lgbt+ community. where as the exclusionist side will no-platform ad ignore anyone whos been called out, (example, example (u just gotta tell me who and ill look into it), example)

Opening the Door for Censorship: New Trademark Enforcement Mechanisms Added for Top-Level Domains

With so much dissatisfaction over how companies like Facebook and YouTube moderate user speech, you might think that the groups that run the Internet’s infrastructure would want to stay far away from the speech-policing business. Sadly, two groups that control an important piece of the Internet’s infrastructure have decided to jump right in.

The organization that governs the .org top-level domain, known as Public Interest Registry (PIR), and the Internet Corporation for Assigned Names and Numbers (ICANN) are expanding their role as speech regulators through a new agreement, negotiated behind closed doors. And they’re doing it despite the nearly unanimous opposition of nonprofit and civil society groups—the people who use .org domains. EFF is asking ICANN’s board to reconsider.

ICANN makes policies for resolving disputes over domain names, which are enforced through a web of contracts. Best-known is the Uniform Domain Name Dispute Resolution Policy (UDRP), which allows trademark holders to challenge bad-faith use of their trademarks in a domain name (specifically, cybersquatting or trademark infringement). UDRP offers a cheaper, faster alternative to domain name disputes than court. When ICANN began to add many new top-level domains beyond the traditional ones (.com, .net, .org, and a few others), major commercial brands and their trademark attorneys predicted a plague of bad-faith registrations and threatened to hold up creation of these new top-level domains, including much-needed domains in non-Latin scripts such as Chinese, Arabic, and Cyrillic.

In response, the community allowed trademark interests to create more enforcement mechanisms, but solely for these new top-level domains. One of these was Uniform Rapid Suspension (URS), a faster, cheaper version of UDRP. URS is a summary procedure designed for slam-dunk cases of cybersquatting or trademark infringement. it features shorter deadlines for responding to challenges, and its decisionmakers are paid much less than the panelists who decide UDRP cases.

In a move that has drawn lots of criticism, ICANN announced that it is requiring the use of URS in the .org domain, along with other rules that were developed specifically for the newer domains.

URS is a bad fit for .org, the third most-used domain and home to millions of nonprofit organizations (including, of course, eff.org). The .org domain has been around since 1985, long before ICANN was created. And with over ten million names already registered, there’s no reason to expect a “land rush” of people snatching up the names of popular brands and holding them for ransom.

When nonprofit organizations use brand names and other commercial trademarks, it’s often to call out corporations for their misdeeds—a classic First Amendment-protected activity. That means challenges to domain names in .org need more careful, thorough consideration than URS can provide. Adding URS to the .org domain puts nonprofit organizations who strive to hold powerful corporations and governments accountable at risk of losing their domain names, effectively removing those organizations from the Internet until they can register a new name and teach the public how to find it. Losing a domain name means losing search engine placement, breaking every inbound link to the website, and knocking email and other vital services offline.

Beyond URS, the new .org agreement gives Public Interest Registry carte blanche to “implement additional protections of the legal rights of third parties” whenever it chooses to. These aren’t necessarily limited to cases where a court has found a violation of law and orders a domain name suspended. And it could reach beyond disputes over domain names to include challenges to the content of a website, effectively making PIR a censorship bureau.

This form of content regulation has already happened in some TLDs. Donuts and Radix, which operate hundreds of top-level domains, already suspend websites’ domain names based on accusations of copyright infringement from the Motion Picture Association of America, without a court order. Some registries also take down the domain names of pharmacy-related websites based on requests from private groups affiliated with U.S. pharmaceutical companies, again without a court order or due process.

PIR, the operator of .org, has previously proposed to build its own copyright enforcement system. PIR quickly walked back that proposal after EFF spotlighted it. But PIR’s new agreement with ICANN provides a legal foundation for bringing back that proposal, or other forms of content regulation. And the existence of these contract terms could make it harder for PIR and registrars to say “No” the next time an industry group like MPAA, or a law enforcement agency from anywhere in the world, comes demanding that they act as judge, jury, and executioner of “bad” websites.

Bypassing Users’ Input

The process that led to these changes was problematic, too. The multistakeholder process, which is supposed to account for the views and needs of all groups affected by a policy change, was simply bypassed. ICANN did announce the new .org contract and provided for a period of public comment. But this seems to have been a hollow gesture.

The Non-Commercial Stakeholder Group, a group that represents many hundreds of the organizations that have .org domain names, filed a comment laying out why that domain shouldn’t have the URS system and other “rights protection mechanisms” beyond the UDRP. EFF and the Domain Name Rights Coalition also filed a comment, which was joined by top academics and activists on domain name policy.

An extraordinary and unprecedented 3,250 others filed comments opposing the new .org contract, mainly on the grounds that it removed price caps from .org registrations, potentially allowing Public Interest Registry to increase the fees it charges millions of nonprofit organizations. In contrast, only six commenters, including groups representing trademark holder interests and incumbent registries, filed supportive comments. But ICANN made no meaningful changes in response to these comments from the actual users of .org domain names. The contract they concluded on July 30th was the same as the one they proposed at the start of the public comment period. The ICANN Staff seem to think they can make any policies they choose by contract.

What Comes Next?

EFF has asked the ICANN board to reconsider their new contract, to submit the issue to the ICANN community for a decision, and to remove URS from the .org domain. Public Interest Registry has not yet created any new enforcement mechanisms, nor returned to the copyright enforcement proposal it made and shelved in 2016—but if the new contract stands, it will give them legal cover for doing so. It’s important that Internet users, especially nonprofits, make clear to ICANN, PIR, and PIR’s parent organization, the Internet Society, that nonprofits don’t need new, accelerated trademark enforcement or new forms of content regulation. After all, there’s no reason to think that these organizations will regulate the speech of Internet users any better than Facebook, YouTube, Twitter, and other prominent social networks have done. It would be best if they stay out of that role entirely.
