Canada's Big Move For H-1B Visa Holders, Families To Benefit Too

In an official release, Canada's Ministry of Immigration, Refugees, and Citizenship said the program will also provide for study or work permits for the family members of H-1B visa holders.

Ottawa: Canada Immigration Minister Sean Fraser on Tuesday announced that the government will create an open work-permit stream to allow 10,000 American H-1B visa holders to come and work in the country.

In an official release, Canada’s Ministry of Immigration, Refugees, and Citizenship said the program will also provide for study or work permits for the family members of H-1B visa holders.

“Thousands of workers in high-tech fields are employed with companies that have large operations in both Canada and the US, and those working in the US often hold an H-1B speciality occupation visa. As of July 16, 2023, H-1B speciality occupation visa holders in the US, and their accompanying immediate family members, will be eligible to apply to come to Canada,” the release read.

The approved applicants under the new decision will receive an open work permit of up to three years in duration.

“They will be able to work for almost any employer anywhere in Canada. Their spouses and dependants will also be eligible to apply for a temporary resident visa, with a work or study permit, as needed,” said the release.

According to Canada-based, CBC News, Fraser said that by the end of this year, the federal government will be developing an immigration stream for some of the world’s most talented people that will be able to come to Canada to work for tech companies, irrespective of having a job or not.

However, the Immigration minister did not explain exactly who will qualify or how many people will be admitted to the stream.

H-1B visas allow foreign nationals to temporarily work in the US in certain specialized occupations, including the technology sector. Tech companies went on a hiring binge during the pandemic but have since started laying people off in large numbers. That’s left a lot of H-1B visa holders scrambling to find new jobs.

What is the H-1B visa?

The H-1B Visa is a visa for foreign nationals with a bachelor's degree (or its equivalent work experience) and a U.S. employer that will hire this person in a specialty occupation, including fashion models of distinguished merit & ability and those working for Department of Defense projects. The petitioning U.S. employer must demonstrate that the worker will be paid the actual or prevailing wage.

What is the application process?

Sign up for the Electronic Registration Process. Petitioners seeking to file H-1B cap-subject petitions, including those eligible for the advanced degree exemption, will first have to electronically register with the U.S. Citizenship and Immigration Services (USCIS) and pay the $10.00 registration fee during the designated registration period.

USCIS will conduct its randomized selection. When USCIS has determined that it has received enough electronic registrations during the initial period to reach the H-1B numerical allocations (limits the annual number of qualifying foreign workers who may be issued a visa or otherwise be provided H-1B status to 65,000 with an additional 20,000 under the H-1B advanced degree exemption) they will conduct their randomized selection process to determine who may submit H-1B applications.

Registration Selection Notification. After the randomized selection is completed, the petitioner’s USCIS online account will show one of the following statuses for each registration:

Submitted: The registration has been submitted and is eligible for selection. If the initial selection process has been completed, this registration remains eligible, unless subsequently invalidated, for selection in any subsequent selections for the fiscal year for which it was submitted.

Selected: Selected to file an H-1B cap petition.

Not Selected: Not selected – not eligible to file an H-1B cap petition based on this registration.

Denied: Multiple registrations were submitted by or on behalf of the same registrant for the same beneficiary. If denied as a duplicate registration, all registrations submitted by or on behalf of the same registrant for this beneficiary for the fiscal year are invalid.

Invalidated-Failed Payment: A registration was submitted but the payment method was declined, not reconciled, disputed, or otherwise invalid.

Filing of the Labor Condition Application (LCA): The employer must apply for and receive DOL certification of an LCA, which is a document attesting that they will pay the foreign worker the prevailing wage in the occupation.

Employer Submits Completed Form I-129 to USCIS. The employer must file Form I-129, Petition for a Nonimmigrant Worker, with the correct USCIS service center with the LCA and other supporting documentation.

Prospective Workers Outside the United States Apply for Visa and/or Admission. Once the Form I-129 petition has been approved, the prospective H-1B worker who is outside the United States may apply with the U.S. Department of State (DOS) at a U.S. embassy or consulate abroad for an H-1B visa. If the prospective worker is in the United States, their status will change to H-1B upon approval of the petition. Approved beneficiaries may work in the U.S. for up to three years and may be extended up to six years.

What’s new?

To avoid duplicate entries, starting FY 2023, USCIS has added duplicate checker functionality to the electronic registration process. Before you submit your registration(s), you can check if the registrant named in the draft submission previously submitted a registration for any of the beneficiaries included in that draft submission for the same fiscal year. USCIS also provides a tool to download a .csv file and search for duplicate entries. Duplicate entries will result in a denial so it is important to make sure that only one entry is submitted for each beneficiary.

The U.S. Department of Treasury has approved a temporary increase in the daily credit card transaction limit from $24,999.99 to $39,999.99 per day for the FY 2024 H-1B cap season. This temporary increase is in response to the volume of previous H-1B registrations that exceeded the daily credit card limit.  Additional information will be provided before the start of the initial H-1B registration period.

What is the H-1B process timeline?

Feb. 21: Petitioners and registrants can begin creating H-1B registrant accounts at noon Eastern.

March 1: H-1B registration period opens at noon Eastern.

March 17: H-1B registration period closes at noon Eastern.

March 31: Date by which USCIS intends to notify selected registrants.

April 1: The earliest date that FY 2024 H-1B cap-subject petitions may be filed.
