'Oh.’ If Cathy could dig a hole in the floor and disappear, she would. ‘Ignore me, I swear that I’m usually not this much of an idiot.’
‘We know.’ Jane reassures her.
‘And even if you were, we wouldn’t mind...I mean, we love Anne anyway, don’t we?’
This has been in my WIPs folder for at least 6 months if not more, but I decided it was time to dust it off because I didn't have the greatest week and I needed some levity. Should have the second part ready and post it next weekend.

In Cathy’s defence, it was a totally understandable mistake. And she had not been alone in that. But, of course, as the one dating the subject of the misunderstanding, she is the one teased about it.
It all started at university, in class, where Cathy had ended up paired with Anna. It turned out that they actually got along quite well and became friends outside of lessons too. Which led to meeting Anna’s girlfriend, Jane, and then a relatively new friend of Jane’s, Catalina. And, because it’s a small world, to discover that they were old family friends. Catalina had recognised the surname and asked if she was a relative of Maud Green. Apparently Catalina had met Cathy when she was a baby…which obviously Cathy didn’t have any recollection of.
Anyway, they all hit it off.
As new friends, one of the first topics to be covered had been housing. Between complaints about housemates, landlords, buildings and neighbours, it always guarantees plenty of fodder for conversation.
And when Catalina, whom Jane called Lina and had shrugged when asked if they could call her that too, said, ‘I have a housemate, my Kat’, with a warm smile, well, forgive Cathy for thinking she was talking about an actual cat. Especially when the topic of pets came up and Lina said ‘Does my Kat count?’ with a laugh. ‘I mean, she is independent, obviously, but-’
Cathy remembers Jane and Anna sharing her own slightly confused expression because of course cats are pets, why should it not count??
It didn’t help that Lina would say stuff like:
‘Rain check? Kat is sick, has been throwing up all day so I want to keep an eye on her.’
or
send a voice message on the group chat that ended with ‘Sorry, have to go. I have a Kat on the table and I don’t know why.’
And then there was the time she was distracted and then admitted that she was worried because she didn’t remember if she had locked the door and she didn’t want anything to happen to her cat.
Or she would talk about cleaning and how often she has to vacuum. Because two girls in a house mean lots of hair too. And you know what? Cats can shed hair too! And Catalina would not be the first person to refer to pets as you would do to a person (or treat them as such)!
And she literally replied to the question ‘How did you get your cat?’ with ‘Well, she was living with…someone I knew. When she had to move, taking her along…was not really worth the trouble, all the documents and stuff. Especially since she would be coming back anyway. And it just made sense…we already knew each other and got along well. We could keep each other company. And me and Anne might have our disagreements, but she knows she can trust me with her Kitty.’
Or should Cathy talk about the texts? Despite what people might assume, Lina uses lots of emojis. So when texts such as ‘Movie night’ or ‘Girls’ day’ were paired with others like ‘Snuggling with 🐱’ or ‘Day in with 🐱’ … Well, forgive Cathy for thinking that Lina talking about her Kat was talking about an actual cat, as in an animal.

‘Where is your cat? Hiding?’
Jane asks, looking around. It’s the first time Lina is having them over at her house – them being Anna, Cathy and herself – as usually it’s more convenient and easier for everyone to meet at places around or close to the campus.
‘She went out, but she should be back soon.’ Lina chuckles at the way they all seem eager to meet her. ‘You’ll meet her, don’t worry.’
They fell into an easy conversation, the topic forgotten until...
‘Cathy? Cathy?’ Catalina calls out. The girl in question has her cup half-way to her mouth – a couple of degrees more and she would be spilling the tea all over herself – and her eyes fixated towards the door.
Everyone turns around to see what is capturing Cathy’s attention.
‘Did Anne die?’ Catalina tilts her head as if to look for something behind a girl in basketball shorts and a sport bra, high ponytail with pink tips.
‘Almost.’ Another girl drags herself in. She drops on the floor. ‘Was it your plan all along?’ She wheezes out. ‘Why didn’t you tell me?’
‘I thought you knew…have you seen her?’ Catalina gestures to the girl still standing there, barely out of breath. ‘She is fit!’
‘I thought it was metabolism…I have a good one too.’
‘Good metabolism doesn’t give you abs like that.’
Cathy’s attempt to avoid looking at the exposed skin glistening with sweat fails completely when Lina mentions them. If the humming coming from the other girls is any indication, she is not the only one.
‘Come on, I’ll let you shower first.’
Anne moans, reaching up with grabby hands.
‘What? You want me to carry you?’
‘Are you saying you can’t?
‘Is it a challenge?’
‘If that’s what it takes…’ Anne shrugs from her spot on the floor, unrepentant.
The girl sighs but crouches down. It doesn’t seem to take too much effort for her to lift Anne in her arms and start walking, her hold confident and comfortable as if it had happened many times before.
‘Kat.’
‘Yeah?’ The girl turns around.
‘You can use my shower if you don’t want to wait.’
‘Thanks Cata, you’re the best!’ she smiles brightly at her before leaving the room, Anne in her arms.
‘That’s your Kat?’  
Cathy hears Anna asking but after that, she honestly has no idea what the others talks about or even what she is thinking until the girls returns, Anne once again carried in Kat’s arms.
Kat gently puts her down on the armchair before leaving the room again. ‘Need anything from the kitchen?’
‘No, thanks!’ Catalina calls back, before addressing Anne. ‘You know, they say you should keep moving, this is only going to make the pain worse later on.’
‘That’s a problem for future me.’
‘I would apologize saying that she isn’t normally like this, but I’d be lying.’ Catalina turns towards her friends.
‘Hey!’ Anne protests as Kat comes back, sitting on her armchair’s armrest and passing her a glass of juice.
‘Thanks Kitty.’
Catalina is going through presentations when Cathy suddenly comes back to earth. ‘Wait, you’re Lina’s cat??’
‘Possibly?’ Kat replies, hesitant confusion in her voice, while Anna, Jane and Lina look at their friend weirdly. They probably already went over it. Oops!
‘I mean, it’s Katherine.’ The girl continues.
‘Me too!’ More odd looks.
‘But most people call me Kat. Or Kitty.’
‘I better be the only one calling you Kitty.’
‘And the overprotective one is Anne,’ Kat slings an arm around the other girl, ‘if she didn’t present herself.’

‘Cathy? You alright?’ Jane asks as they walk towards the bus stop after leaving Catalina’s home. ‘You’ve been spacing out.'
‘Yeah.’ She nods. She hesitates, before blurting out. ‘Do you think they are dating?’
‘Who? Kat and Lina?’ Jane laughs.
‘No! Anne and Kat!’
‘I’m sorry, but am I the only one who thought that when Lina talked about her Kat she was talking about a cat, like, actual animal cat, meow?’ Anna interrupts them.
The look exchanged between Jane and Cathy gives her the answer. ‘So it wasn’t just me.’ Anna nods to herself, relieved.
‘Some things make more sense now,’ Cathy muses aloud, ‘like Lina not having her scarf because she gave it to her Kat.’
‘And some things don’t.’ Jane points out. ‘Kat on the table, anyone??’
‘The cat is on the table.’ Anna laughs. ‘Sorry.’ She can see her friends don’t understand why it’s funny to her. ‘When you learn English as a second language, that’s often one of the first sentences you learn.’

‘How did you meet?’
They are all back at Catalina’s house, this time Anne and Kat joining them from the start.
‘We were frenemies.’
‘Oh?’
Anne’s answer doesn’t really explain much.
‘We dated the same guy.’ Catalina expands on it.
‘Henrat.’ Anne mutters darkly, before adding, ‘Not on purpose.’
‘Certainly not.’ Catalina scoffs.
‘He told me he was going to break up with her. That it was taking some time because they had been together for years and it was hard. And well, naïve mistake of thinking myself different or better…Spoiler alert, if someone cheats on someone with you for months, chances are they will cheat on you too, sooner or later.’
‘Oh.’ That was not the story Jane was expecting when she had asked.
‘Yep. So…soon after we officially get together, Henry is out every night, just sleeping around, like what the hell?!’ Anne looks around, as if seeking support from her audience. ‘So I thought if that's how it's gonna be, maybe I'll flirt with a guy or three just to make him jel. Henry finds out and he goes mental. He screams and shouts, like so judgemental.’ She rolls her eyes.  ‘We were at a party and he was like "you damned witch”, which wow, talk about outdated, but anyway, I go “mate, just shut up, I wouldn't be such a bitch, if you could get it up”.’
‘It rhymed!’ Kat points out like she does every time Anne tells the story.
 ‘Is that what you said?’ Anna sounds impressed.
‘Yep. Everyone heard that too. He’s been wanting my head since.’ Anne shrugs. She didn’t regret it a bit. ‘And not in the sexy way.’
‘So it’s a “the enemy of my enemy is my friend” situation?’ Jane looks like she is trying to wrap her head around it. She isn’t sure she would be willing to be friend with someone she got cheated on with, doesn’t matter if they are not together anymore.
‘Not really. I didn’t want anything to do with her…or Henry. Until I saw him harassing a girl. Well, flirting according to him, but she looked so uncomfortable and so young. Especially compared to him.’
‘Yeah, I was 16.’ Kat pipes up.
‘So I shooed him away. Comfort the girl, who was pretty shaken. Have her call someone and wait with her…and who shows up?’
‘Me!’
‘Anne.’ Jane guesses correctly at the same time.
‘And that would have been the end, but Kat wanted to thank me and keep in touch and…it’s really hard to say no to her.’
‘Yeah. Especially when she gives you the KHoward look.’ Anne nods solemnly. It’s a patented weapon she has fallen victim of many many times.
‘Uhm? The what?’
‘Do it, Kitty.’
‘It’s not a party trick.’ Kat protests. But everyone is looking at her expectantly. She lets out a sigh. And she obliges the request.
‘AWW.’ Jane coos, while Anna nods. ‘I get it.’  
Cathy is just speechless.
‘Yeah. And suddenly that scene in Shrek made sense.’ Catalina adds.
‘It didn’t before??’ Anne looks almost offended.
‘Well, I never had a cat before, how was I supposed to know?’ Catalina defends herself.
‘Wait!’ Cathy suddenly exclaims. ‘K?’
‘Yeah? Katherine, you know?’
'Oh.’ If Cathy could dig a hole in the floor and disappear, she would. ‘Ignore me, I swear that I���m usually not this much of an idiot.’

‘And even if you were, we wouldn’t mind...I mean, we love Anne anyway, don’t we?’
A betrayed gasp. ‘Catalina! You turned my Kitty against me??
Catalina is laughing so hard that she is crying. 'My Kat, I love you so much!’ She finally wheezes out.
Cathy is smart. She is! But apparently she turns into a complete simpleton in the presence of pretty girls...or more specifically of one pretty girl called Katherine Howard. Sure, she had fumbled in front of girls before, but never to this degree. An absolute and utter disaster.
‘Anyway,’ Catalina starts again after regaining her breath, ‘long story short, we kept in touch. It was not Kat’s fault what Anne did, anyway. And they were living together and when Anne had to move, it made sense for Kat to come and live with me.’
‘But now you’re back?’ Cathy’s question is completely disinterested, of course.
‘Soon permanently.’ Anne smiles at Kat, nudging her.
‘Where are you going to live?’ Anna asks the younger girl. ‘Are you going to move out or stay here?’
‘Oh, she is trying to win her back.’ Catalina nods towards Anne.
‘I never lost her.’ Anne retorts.
‘I’m not a prize to be won.’
‘I’d argue about that.’ Cathy mutters, getting an amused look from Anna, the only one who heard her.
Kat heaves a sigh. ‘I would suggest we could all live together, but I don’t think I can deal with this on a daily basis.’

They hang out. It’s quite difficult to get everyone together, between classes and jobs and other commitments, but in smaller groups it’s easier and more common. That’s how Cathy finds herself at the pub with Anna and Anne, her and Anna celebrating having finished a big assignment and Anne joining because Kat and Catalina don’t particularly like going out drinking and she misses doing it.
Cathy has mixed feelings about Anne. Is she pretty? Yes. Is she smart? Yes. Is she funny? Yes. Does she hate her a little bit? Also yes. Is she going to get drunk while trying to keep up with her (and Anna, but her Teutonic constitution puts her on a whole other level)? Again, yes.
She pretty much checks out, lost in thoughts, until a shrill ‘Kitty’ brings her back to the present...and to Anne hanging from Kat’s neck, nuzzling into her. ‘You came!’
‘Of course, I did. You called.’ Kat says as if there has never been any other option.
Did Cathy mention that she hates Anne a bit?
‘Time to go home?’ Kat asks, while rubbing Anne’s back.
Anna raises an eyebrow at Anne, still wrapped around the newcomer, and then chances a look at Cathy, slumped on the table. ‘I think we better.’
‘Do you have a car?’
Anna shakes her head. ‘No, I planned to drink so...’
‘Good.’ Kat smiles at her. She is happy to play chauffeur if it means her friends are being safe and responsible. ‘Let’s get you all home.’
Anna helps Cathy to Kat’s car while the younger girl helps Anne.
‘Cathy, where-’ Kat looks at the rear-view mirror only to see that the girl is asleep. ‘Do you know where she lives?’ She asks Anna, the only one still awake.
‘I know she lives in a hall on campus, I might even remember which one, but no idea about the room, sorry.’
‘That’s okay. I’ll just take her home with us, then.’
‘Are you sure?’ Anna looks to the backseat, both girls dead to the world.
‘Yeah. I can carry Anne, I’m sure she won’t be much of a problem either.’
Kat drops off Anna and then drives home. Once she parks, she texts Catalina to open the door for her.
She picks up Anne and carries her home. ‘Can you stay at the door and keep an eye on the car?’ she asks Catalina before manoeuvring inside, careful not to bump into anything lest Anne wakes up. Few minutes later she comes back, goes to the car, and picks up Cathy.
‘Ahnghh.’
‘What?’ Catalina takes the car key Kat is holding with her teeth. ‘Say that again?’
‘I said hand because I wanted to drop the key in it.’ She adjusts her hold of Cathy. Not that she is heavier than Anne, but she has no qualms grabbing and holding Anne, and if she grazes her butt or her boobs, so be it. Cathy is a relatively new friend, and she is more conscious of any touch, no matter how accidental, that could make her uncomfortable (well, if she was awake to realise it, anyway). ‘Lock up for me, please?’

Storytime: I was 2000 words deep into this when an atrocious doubt came to me…was Kat actually pronounced the same as cat?? English is a weird language and not my native one so I started to worry…did I just base my story on something that made no sense? Also (perhaps more important), had I butchered people’s names for years without knowing? As someone whose name is often mispronounced (well, in the UK at least, since it’s Italian), I felt really bad about that. So I asked a native-speaker friend and he said it sounds the same. So if he trolled me (he told me he wasn’t, but who knows) and Kat doesn’t sound as cat…I hope you enjoyed the story anyway (and let me know so I can get back at him!)

Week 3.

Mar. 27
I woke up around noon today.
Spent a bit of time on the usual and getting some iced coffee before doing my exercise.
First, today’s DD. 1′ side plank hold with EC (30″30″). Took some focus, but manageable. It was a bit more challenging with slightly sore lats and pecs.
(After spending time to update some logs...)
Second, Day 13 of the SOP. Level 3, no rest, no assist. A fun sequence to focus on balancing work with.
Last, Day 13 of the RbP. Level 3, 1′ rest. I honestly think I probably could have gotten away with nixing the rest periods entirely, this time. But ah well. Definitely had some faves in involving jumping jacks and more balance work on the legs.
After some dishes, I made today’s Hello Fresh Meal. Rainbow Thai noodle toss. I probably should’ve cooled the noodles a bit more thoroughly to have them not stick together as much. It was otherwise just okay. Not quite as glowingly received to put this on reprisal list.
Spent rest of night on the usual stuff. I got to bed obscenely late, again...

I woke up after 1AM and the first thing I did today was my exercise.
First, today’s DD. 2′ jumping jacks with EC. I counted exactly 130 reps by the end. Very dun and manageable work. Though I was tempted to do more jacks or bounces I decided to reserve my energy for other stuff today.
Second, Day 14 of the SOP. Level 3, no rest, no drops. Even if this was an arm day with un/clenching fists - i was able to keep mental count of my sets in current headspace. Otherwise fairly breezy.
Last, Day 14 of the RbP. Level 3, 1′ rest. More arm work. Got pretty intense and had a few lapses in thinking and tried transitioning to the horizontal scissor exercise instead of that frontal arm raise hold. I usually caught myself quickly though.
Spent a good chunk of the day chatting and having movie night again. We watched Little Shop of Horrors & Dodgeball. Martin’s scenery chewing was one of my own highlights from the former movie.
Spent rest of night doing some of the usual and some reading. I got to bed a couple hours earlier than yesterday, still in the red zone.

Mar. 29
I woke up around noon.
Was a bit uncertain about some appointments this week, including ability to have today’s therapy appointment via phone. But things got straightened up and had a pleasant phone session.
After a bit of the usual, did some exercise.
First, today’s DD. 30 leg raises with EC. Doable, a bit intense for the neck, needing to hold it up
Second, Day 15 of the SOP. Level 3, no rest. Flexibility/balance-oriented work. Breezy and fun.
Last, Day 15 of the RbP. Level 3, max rest, with allowance to let head drop to floor. Because I just did not have the energy for putting up with excessive neck strain. Regardless, abs really felt that (a bit of quads too)! One thing I liked, despite flirting with strain/fatigue was some fun sensory feedback I was getting here. Kinda making me like leg raises more, tbh.
I decided to bake some shortbread cookies to have with Logan’s jam... and it was so good. (I may consider baking another batch for Roman’s jam, and baking that on top into a glaze of sorts... maybe.)
Spent rest of night on the usual stuff. I got to bed obscenely late again...

Mar. 30
I woke up around noon and one of the first things I did today was exercise.
First, today’s DD. 40 balance side lunges with EC (20/20). Just about doable.
Second, Day 16 of the SOP. Level 3, no rest, no assist (only took a seat for the leg raises here given that I wasn’t sure about essentially doing a single-leg squat or wall-sit for those.... might try that next time though!) Pretty manageable, despite having modestly stiff quads.
Last, Day 16 of the RbP. Level 3, max rest. Tendon strengthening day. Took a couple sets to get things warmed up and limber, given the quads situation, but manageable. Tough work, but rewarding!
Hi the showers and made today’s Hello Fresh Meal. Oven-ready cheesy salsa verde chicken. Getting kind of annoyed that prescribed cook-times for the oven-ready chicken dishes being under-estimated. I was already grouchy about needing to cancel tomorrow’s trip reservation (under dubious circumstances) and other shit... (Despite that, food was just okay.)
So I was too angry and tired to avoid taking a nap after that was eaten...
Spent rest of night on usual shit. Got to bed a bit earlier than yesterday, but still in the red.

Mar. 31
I woke up around 10AM.
Bro took me to group today. Seeking Safety went alright. Still exhausted about Everything.
Got home, did a lot of the usual and some writing, I did today’s exercise.
First, today’s DD.40 single arm climbers with EC (20/20). This was a tiny bit awkward arm placement throughout. Planted hand position was off-center, so remaining balanced whilst pumping the legs was a bit concerning. Probably could’ve done better form if that was a bit more on lock. Ah well, done at any rate.
Second, Day 17 of the SOP. Level 3, no rest, no drops. Arm work, I kinda like challenging myself with this program like this, I feel like my current level of fitness gets more out of it this way. :Ic
Last, Day 17 of the RbP. Level 3, max rest. Lotta up/down with it being high knees and single leg plank holds. After the first set or two, I’m glad I took time to get my ankle popped right so it wouldn’t hurt to keep up the toe-striking and jumping for the hidden burpees (probably was a tiny bit unstable/subluxed). Feeling good about that!
Spent rest of the day on reading fics and the usual. Got to bed around the same time as yesterday.

Apr. 1
I woke up after 1PM.
Spent time reading and whatnot before exercise...
First, today’s DD. 80 [standing] side leg raises with EC (40/40). Happy I manged to do this whilst holding my balance the whole way through it - even if it wasn’t specified.
Second, Day 18 of the SOP. Level 3, no rest. A bit more of a flexibility-oriented day, breezy work.
Last, Day 18 of the RbP. Level 3, max rest. Had to mod-down over half the upward dogs to cobras just to mitigate built up straining (and avoid triggering some ETD). Was also worried about heartburn after some food choices beforehand - but at least that wasn’t an issue and I will consider it a small mercy. Also another workout for every second of rest was met with gratitude.
Spent rest of night reading fics and whatnot. I got to bed a little bit earlier than yesterday, still in the red zone.

Apr. 2
I woke up a bit before 1PM, today.
Spent some time filling out some stressful legal shit.
After I took a break on that, the only planned exercise today was the DD. 200 punches with EC. I swapped stances at 100. This was a fun and breezy DD. I appreciated it given how tired I was feeling...
Spent time updating my logs, while watching YouTube after that.
Then a few rounds of dishes around making today’s Hello Fresh Meal. Szechuan beef noodles. This was just okay. I may opt to “cheat“ a little bit by putting a lil bit of sesame oil in the cook water for the ramen noodles. Still haven’t quite nailed executing them without excessive sticking-together. Would be a bit more appealing texture and flavor-dispersion. But it wasn’t bad.
Spent the rest of night getting some writing and writing plan/notes done.
Got to bed a bit later than yesterday.

"You know what I've been wondering? How do tall people like you actually sleep at night when the blanket can't possibly cover you from head to toe?" Prompto texting that to Gladio in the middle of the night ( ͡° ͜ʖ ͡°)( ͡° ͜ʖ ͡°)( ͡° ͜ʖ ͡°)

There were actually several, perfectly-logical reasons Prompto had sent the text.
First, it was after midnight and Gladio was the only other person he knew who was (definitely, probably) awake at that hour. Second, he’d been laying in his own bed, wide-awake and staring at this toes moving under the covers when the thought had occurred to him. How did tall people sleep if their feet stuck out from the blankets? Weren’t they cold? Did they have to sleep diagonally to fit like a normie? He just had to know. 
Third, he may or may not have been thinking about Gladio anyway when the question crossed his mind. It was so natural to snatch up his phone, open his recent chats, and shoot the text directly to the tallest (and hottest) person he knew. 
It was only after hitting send that Prompto realized he sounded like an idiot. An awkward, lame-o, desperate idiot. 
He panicked. He started to type an apology, deleted it. Went for a recovery, couldn’t think of anything smooth enough. By the time he’d settled on simply erasing his account and moving to a new city under a false name, the text had already been seen and he knew he was too late. 
Gladio’s unexpected reply less than a minute later shocked Prompto back to his senses. 
[00:14] We wear socks duh
Prompto blinked. Reread the message again, and again for good measure. Was... Was Gladio playing along? Suddenly grinning, he rolled onto his stomach and propped his hands on his pillow while he typed.
[00:15] Socks in bed? That’s like capital T Turn-off xP Tall people must never get laid
He waited, giggling to himself, until:
[00:16] Fine short stack, you be the judge then
Several seconds passed while Prompto struggled to decipher the meaning, but Gladio saved him the trouble. His phone buzzed - “Pix received” - and his heart nearly jumped out of his throat. It was Gladio, of course, unmistakable even in the dim light of his bedroom. He was making a sour face at the camera, his legs and arm not holding the phone tucked away under the blanket, which had been pulled right up to his chin. The label said, ‘no socks.’
The next picture - labeled ‘just socks’ - came not long after. And Prompto actually, literally moaned when opened it. 
The blanket was still there, but just barely. Gladio held one corner of it against his (otherwise naked) lap, and had purposefully angled the camera to capture the full effect - bare chest, sculpted and covered in the dark lines of his tattoo-in-progress; two-four-six-EIGHT PACK abs that Prompto wished he could wash his underwear on; and hard, thick legs that stretched for miles - and ended in a pair of ankle-high white socks. 
He managed to catch his breath - eventually. Discreetly saved the photo to his phone and then forced his trembling fingers to type a reply. 
[00:23] GODS DUDE WARN A GUY FIRST! 
[00:24] How you feelin’ about those socks now?
Prompto hesitated. He stared at his screen debating the risks. Then he fucking went for it. 
[00:26] Still not my thing, but I’d make an exception for you 
Then he tossed his phone somewhere toward the end of his bed and buried his beet-red face in the pillow. It wasn’t until morning, after he’d showered, brushed his teeth, and convinced himself it had all been a dream, that he finally saw Gladio’s reply.

The charges against DeMare arose from a sting operation in which law enforcement set up a fictitious profile of an eighteen-year-old woman named "Amber" on the dating website Meetme.com. Using a bait-and-switch tactic, a detective posing as Amber chatted and flirted with DeMare online and via text message for four days as an adult before revealing on the fifth day that she was actually a minor. DeMare was arrested when he traveled to meet the fictitious Amber at her home later that day.
The State charged DeMare with violating section 847.0135(4)(a), which proscribes traveling in Florida for the purpose of engaging in unlawful sexual conduct with a minor or a person believed to be a minor after using an electronic communication device "to seduce, solicit, lure, or entice the child or person that the defendant believed to be a child to engage in the illegal act or other unlawful sexual conduct or to attempt to do so."
DeMare filed a motion to dismiss in which he asserted, among other things, that he was subjectively entrapped by law enforcement. DeMare attached as exhibits a screenshot of "Amber's" Meetme.com profile and transcripts of the chats, text messages, and telephone call that the State provided during discovery.
The earliest communication established that Amber and DeMare began chatting as adults on May 16, 2018. Just after midnight on May 20, 2018, they switched to text messaging and flirted for about forty minutes. Their flirting included some sexual innuendo, and the detective sent DeMare a photo purporting to be of Amber. They resumed texting in earnest at 1:31 p.m. The conversation became more intimate as they planned to meet. They also exchanged more photos. When their plans became concrete, Amber "admitted" that she was only fourteen years old. This occurred at 3:49 p.m.
DeMare immediately tried to end the relationship, but Amber suggested they could still be friends. DeMare agreed but emphasized that the couple could not have sex because it was illegal. Amber told him that she liked older men and repeatedly attempted to convince him that a sexual relationship was still possible despite her age. DeMare remained reluctant but eventually responded to Amber's suggestions with sexual innuendo about what he would do if she were eighteen. Amber sent another photo. DeMare asked for more photos but specified that she not send nudes.
At 4:51 p.m., the pair agreed to speak on the phone. They also continued to exchange texts. DeMare asked if Amber was "really fourteen" and reminded her that he could get into legal trouble if they had a sexual relationship. Amber was undeterred and told DeMare that her parents were out of town and that she wanted to take advantage of it. DeMare was sheepish but offered to send Amber some selfies. Amber said she would see him when he got there and to send more photos while she got ready. DeMare sent the selfies, and Amber asked if he had any "abs shots." DeMare sent a shirtless selfie.
While the couple continued to engage in banter, DeMare vacillated from sexual innuendo about their upcoming meeting to suggesting the couple just hang out as friends and smoke pot. Amber continued to press DeMare to make sexual comments, encouraging him by telling him how excited she was, asking for specifics, and asking if he had condoms. When DeMare reverted to talking about just meeting as friends, Amber used various tactics to change his mind. She cajoled him, complained about his reluctance, accused him of being scared, and assured him he could trust her. But even when DeMare relented, he was hesitant and equivocal. Amber nonetheless asked him to come over and provided her address. DeMare was arrested at 6:07 p.m. when he pulled into the driveway of the address. He was not carrying any drugs or condoms.
The State filed a traverse in which it agreed that the exhibits were accurate and relevant to understand the chronology and nature of the communications. At an evidentiary hearing on the motion to dismiss, the trial court stated that DeMare had met his threshold burden to establish lack of predisposition to engage in the crime. However, after hearing the State's evidence, the trial court determined that the State had established a prima facie case of traveling to meet a minor and that DeMare failed to establish an entrapment defense. We disagree and conclude that DeMare established his subjective entrapment defense.
"A law enforcement officer, a person engaged in cooperation with a law enforcement officer, or a person acting as an agent of a law enforcement officer perpetrates an entrapment if, for the purpose of obtaining evidence of the commission of a crime, he or she induces or encourages and, as a direct result, causes another person to engage in conduct constituting such crime by employing methods of persuasion or inducement which create a substantial risk that such crime will be committed by a person other than one who is ready to commit it." § 777.201(1), Fla. Stat. (2017); see also Munoz v. State (Fla. 1993). The defendant must prove this subjective entrapment defense by a preponderance of the evidence. § 777.201(2).
Under this statute, the first question to be determined is whether law enforcement induced the defendant to commit the charged offense. If the answer is yes, then the second question is whether the defendant was predisposed to commit the charged offense. The defendant bears the initial burden of proving a lack of predisposition. However, when the defendant produces evidence of a lack of predisposition, the burden shifts to the State to rebut the evidence beyond a reasonable doubt….
As to the first question, based on the undisputed facts set out above, we conclude without hesitation that law enforcement induced DeMare to commit the offense of traveling to meet a minor. As to the second question, a defendant is predisposed if he "was awaiting any propitious opportunity or was ready and willing, without persuasion, to commit the offense." "[P]redisposition is not the same as mens rea. The former involves the defendant's character and criminal inclinations; the latter involves the defendant's state of mind while carrying out the allegedly criminal act."
DeMare did not have a prior record of offenses against minors, and there was no evidence he was ever investigated for or engaged in such an offense. In fact, he responded to a profile of an eighteen-year-old woman in the adult section of Meetme.com. Thus, DeMare met his burden of presenting evidence of lack of predisposition.
The burden therefore shifted to the State to establish beyond a reasonable doubt that DeMare "was awaiting any propitious opportunity or was ready and willing, without persuasion, to commit the offense." The State failed to meet this burden. When DeMare contacted Amber on Meetme.com, he thought she was an adult and was led to believe he was speaking with an adult for four days. When law enforcement finally "admitted" that Amber was only fourteen, DeMare immediately tried to end the relationship. But Amber persuaded him to remain friends and then went about seducing and luring him into entertaining the idea of having a sexual relationship. DeMare repeatedly expressed an unwillingness to engage in sex with a minor. His reluctance to violate the law was overcome by law enforcement inducement.
"Government agents may not originate a criminal design, implant in an innocent person's mind the disposition to commit a criminal act, and then induce commission of the crime so that the Government may prosecute." … In this case, … law enforcement took the lead in the conversation, initially suggested a sexual relationship between DeMare and a minor, coaxed and cajoled DeMare for more details, and challenged his reluctance by impugning his nerve and suggesting he was scared…. [L]aw enforcement's persistent urging eventually overcame DeMare's reluctance to commit or even describe sexual activity with a minor.
This leads us to … whether the defense should be decided as a matter of law or submitted to the jury…. [A]ll the communications that made up the charge were contained in the record so there was no dispute of any material facts. Because DeMare established that law enforcement induced him to commit the charged offense and the undisputed evidence failed to rebut the defense, DeMare's subjective entrapment defense should have been decided as a matter of law. Accordingly, the trial court erred in denying DeMare's motion to dismiss. We therefore reverse DeMare's judgment and sentence and remand for discharge.

This time, it’s the Ninja Training Plan... I just like to change things up for the time being. Might poke some programs/challenges again soon.

Oct. 12
I’ve been up since a bit after 11AM, today.
Mostly was back on my usual downtime activities before getting in today’s exercises.
First, today’s DD. 30 raised leg circles with EC. Not much to say other than this was very doable work.
Second, “Quick Warmup“.
Third, Day 1 of the NTP. Today’s high burn workout was “The Floor is Lava“, done at Level 1 with EC. Though I did feel tempted to do 2 more sets, my ears were starting to feel a bit... stuffy, again. Which is a shame, because I really had moments of bliss during the routine - and may well consider this a personal favorite workout! The conceit was also fun, in a childlike way (and I think bouncing motions on balls of feet are generally better for the ankles anyways).
Last, “Top to Bottom“, for cooldown. I don’t normally like this one ONLY because it’s a really lengthy stretching routine. But you can’t beat how comprehensive it is. Also, wow, balancing was hard with tired calves.

I woke up around 10AM.
Spent some time on the usual, before doing my exercise.
First, today’s DD. 1′ back arch balance hold with EC. I do enjoy this exercise a bunch, balance work is fun like that! :D
Second, “Classic Warmup“.
Third, Day 2 of the NTP. Today’s casual training workout was “Epic Abs“, done at Level 3 with EC. This was another super fun workout to do today! I think getting into the rhythm with music and syncing breath tightly with the crunches made the difference!
Last, “Fullbody Stretch“.
After a bit more of the usual, I settled down and decided to try that Pomodoro Technique to keep me focused on art production. Which I believe worked!

I woke up a bit before noon, today.
Spent Some hours on the usual, before exercising.
First, today’s DD. 10 archer push-ups without EC. Did kind of do it twice, first time forgetting to alternate sides, but both times with abysmal form. I did it one more time on my knees. with better depth and form. But not well enough to feel I earned EC. 
(After dishes and dinner...)
Second, Quick Warmup.
Third, Day 3 of the NTP. Today’s high burn workout was “Siren“, done at Level 1, kinda with EC. I walked into this going, “YEAH, this is gonna be fun! A lot of my faves! I think Level 2 would be doable!“
I don’t know wtf was wrong with me - but I really struggled to maintain balance on off side even at a fast count. My knee was WAY too tense and I rapidly lost my chill and patience. I think DOMS-y calf muscles MAY of influenced things, but man was I NOT on my game today. (I’ll still consider this a favorite workout, just was NOT in the space for it, clearly.)
Last, “Top to Bottom”, for cooldown. Despite feeling rather unhappy about how “Siren” went.

I woke up at around 8AM.
Got to the facility. Seeking Safety was pretty informal, normal facilitator was on vacation, the sub realized a bit late but the usual people stuck around and chatted about grounding stuff (and the power outage - because everyone was).
After that, I did today’s DD. 100 side kicks with EC (50/50). I had some fun doing them despite being sleep deprived. :D
Though I was worried about doing so on battery power (because taking my chord with me slipped my mind for some reason), I decided to spend the rest of my time at the facility working on that art stuff some more before leaving for home.
One of the first things I did while back was bake some brownies and largely did the usual noise.
It wasn’t until like midnight that I got around to my exercise. :I
First, “Classic Warmup”.
Second, Day 4 of the NTP. Today’s casual training workout was “Overhaul“, done at Level 1. This was another case of last-minute change of plans - I determined my energy levels really wasn’t up for “Core Sculpt“. I figured march steps and full planks were better down-gear exercises than elbow plank variations. I thought about upping the level - but it was getting too late as it was. A pretty fun workout, though.
Last, “Fullbody Stretch”.
Despite sleep deprivation, I still went to bed obscenely late. orz

Oct. 16
I woke up around 1PM, today.
Spent a good deal of time on the usual, before doing a little bit of exercising and whatnot.
First, today’s DD. 2′ arm scissors with EC. I enjoyed the exercise and counted 235 reps by the end - so close to 2/sec and was quite the challenge to get there.
After dishes and dinner... I got way too distracted to get to my intended workouts. Oops. I ate far too much sugar and caffeine so. Yeah. :I

I woke up a bit before noon today.
After a few hours of the usual, I did my exercise.
First, today’s DD. 1′ plank punches with EC. I counted 41 reps by the end. Probably one of those plank variations I really like, mostly because of the punching part.
Second, “Fighter’s Warmup”.
Third, Day 5 of the NTP. Today’s combat workout was “Heartstriker“, done at Level 3 with EC. I decided that bounce-switching for all the side kicks would be most aerobic and fun. It was also a joy employing Skull-Shining Breath technique to the rhythm of the kicks (kick - tap - bounce; full forceful exhale - 1/2 inhale - 1/2 inhale). The only thing worth complaining about was me flirting with heartburn/indigestion as I went, pffft! :,D
Last, “Fighter’s Stretching”.
I think I went to bed at a more reasonable time after that.

Oct. 18
I woke up a bit before 11AM.
Did some of the usual, was roped into playing cards, too. Spent some time doing laundry, some dishes, cleaning the kitchen, and making dinner. So I wound up exercising late (being on my feet so much kind of hurts...).
First, today’s DD. 1′ toe tap hops with EC. Counted 81 reps by the end, was a bit dubious from being on my feet so much today. But it was a doable pace. :D
Second, “Classic Warmup”.
Third, Day 6 of the NTP. Today’s casual training workout was “Gut Control“, done at Level 1 with max rest (because it was late and I found myself needing to play catch up.) This was just manageable - a bit of neck strain, but I got pretty good at quickly dropping into the crunches.
Fourth, Day 7 of the NTP. Today’s casual training was more old DDs with EC. Just 2, because of my time and energy levels (and to hit EC #1330).
February 6, 2016 - 100 bridges. After that ab work - working the lower back and hamstrings felt like a natural choice. Hams and glutes got to burning by the end, but I’m happy I could do it!

In den dokumentarischen Filmen sprechen Jugendliche über ihre Gefühle und die Bedeutung von Liebe. Dabei geht es sowohl um die schönen Seiten des Zusammenseins wie erste sexuelle Erfahrungen, Treue und langfristige Beziehungsperspektiven als auch um negative Erlebnisse wie Trennungsschmerz. Dokumentarischer Teil: Menschen lieben – Sexuelle Vielfalt (17 Min.) Junge Menschen, die sich jenseits starrer, heteronormativer Vorgaben verorten, sprechen offen und selbstbewusst über Hetero-, Homo-, Bi- und Transsexualität, über die Entdeckung ihrer eigenen sexuellen Orientierung, den persönlichen Umgang damit, Outings und die gesellschaftliche Akzeptanz von sexueller Vielfalt, über ihre Erfahrungen und Vorstellungen von Liebe, Partnerschaft und Sexualität. Digital Love (19 Min.) Die TeilnehmerInnen schildern ihre Erfahrungen mit Flirts in Datingportalen, Chats, Foto- und Videonachrichten und beschreiben das Bild vom eigenen Körper, Anerkennung, Sehnsüchte, Enttäuschungen und Glücksmomente in der Onlinewelt. Das Internet dient für sie nicht nur dazu, die eigene Sexualität zu entdecken und sich aufzuklären, es wird auch für soziale Beziehungen genutzt. Wie unterscheidet sich das digitale vom realen Flirt- und Beziehungsverhalten? Beziehungen und was dazugehört (17 Min.) Fünf junge Menschen erzählen von ihren Erwartungen und Vorstellungen an Beziehungen. Vom Kennenlernen über Eifersucht und Liebeskummer bis hin zu ihren sexuellen Erfahrungen geben sie Einblick in die romantischen, aufregenden, alltäglichen und schmerzhaften Seiten des Zusammenseins und ihre eigenen Erlebnisse. Szenischer Teil »Liebe, Sex und dann Ex«: Episode 4 »Jungs und Mädchen« (16 Min.) Sophia wird in ihrer Klasse nicht als vollwertiges Mädchen akzeptiert und gemobbt, weil sie lesbisch ist. Aber sie findet einen Draht zu Isa. Fabi wünscht sich Sex mit seiner Freundin Mel, die sich aber aus Unsicherheit und Scham nicht darauf einlassen kann. Seine Freunde raten ihm: Wenn er ein richtiger Kerl sei, sollte er sich eine Freundin suchen, die ihn ranlässt.
