Apple fucked us on right to repair (again)

Right to repair has no cannier, more dedicated adversary than Apple, a company whose most innovative work is dreaming up new ways to sneakily sabotage electronics repair while claiming to be a caring environmental steward, a lie that covers up the mountains of e-waste that Apple dooms our descendants to wade through.
Why does Apple hate repair so much? It's not that they want to poison our water and bodies with microplastics; it's not that they want to hasten the day our coastal cities drown; it's not that they relish the human misery that accompanies every gram of conflict mineral. They aren't sadists. They're merely sociopathically greedy.
Tim Cook laid it out for his investors: when people can repair their devices, they don't buy new ones. When people don't buy new devices, Apple doesn't sell them new devices. It's that's simple:

So Apple does everything it can to monopolize repair. Not just because this lets the company gouge you on routine service, but because it lets them decide when your phone is beyond repair, so they can offer you a trade-in, ensuring both that you buy a new device and that the device you buy is another Apple.
There are so many tactics Apple gets to use to sabotage repair. For example, Apple engraves microscopic Apple logos on the subassemblies in its devices. This allows the company to enlist US Customs to seize and destroy refurbished parts that are harvested from dead phones by workers in the Pacific Rim:

Of course, the easiest way to prevent harvested components from entering the parts stream is to destroy as many old devices as possible. That's why Apple's so-called "recycling" program shreds any devices you turn over to them. When you trade in your old iPhone at an Apple Store, it is converted into immortal e-waste (no other major recycling program does this). The logic is straightforward: no parts, no repairs:

Shredding parts and cooking up bogus trademark claims is just for starters, though. For Apple, the true anti-repair innovation comes from the most pernicious US tech law: Section 1201 of the Digital Millennium Copyright Act (DMCA).
DMCA 1201 is an "anti-circumvention" law. It bans the distribution of any tool that bypasses "an effective means of access control." That's all very abstract, but here's what it means: if a manufacturer sticks some Digital Rights Management (DRM) in its device, then anything you want to do that involves removing that DRM is now illegal – even if the thing itself is perfectly legal.
When Congress passed this stupid law in 1998, it had a very limited blast radius. Computers were still pretty expensive and DRM use was limited to a few narrow categories. In 1998, DMCA 1201 was mostly used to prevent you from de-regionalizing your DVD player to watch discs that had been released overseas but not in your own country.
But as we warned back then, computers were only going to get smaller and cheaper, and eventually, it would only cost manufacturers pennies to wrap their products – or even subassemblies in their products – in DRM. Congress was putting a gun on the mantelpiece in Act I, and it was bound to go off in Act III.
Welcome to Act III.
Today, it costs about a quarter to add a system-on-a-chip to even the tiniest parts. These SOCs can run DRM. Here's how that DRM works: when you put a new part in a device, the SOC and the device's main controller communicate with one another. They perform a cryptographic protocol: the part says, "Here's my serial number," and then the main controller prompts the user to enter a manufacturer-supplied secret code, and the master controller sends a signed version of this to the part, and the part and the system then recognize each other.
This process has many names, but because it was first used in the automotive sector, it's widely known as VIN-Locking (VIN stands for "vehicle identification number," the unique number given to every car by its manufacturer). VIN-locking is used by automakers to block independent mechanics from repairing your car; even if they use the manufacturer's own parts, the parts and the engine will refuse to work together until the manufacturer's rep keys in the unlock code:

VIN locking is everywhere. It's how John Deere stops farmers from fixing their own tractors – something farmers have done literally since tractors were invented:

It's in ventilators. Like mobile phones, ventilators are a grotesquely monopolized sector, controlled by a single company Medtronic, whose biggest claim to fame is effecting the world's largest tax inversion in order to manufacture the appearance that it is an Irish company and therefore largely untaxable. Medtronic used the resulting windfall to gobble up most of its competitors.
During lockdown, as hospitals scrambled to keep their desperately needed supply of ventilators running, Medtronic's VIN-locking became a lethal impediment. Med-techs who used donor parts from one ventilator to keep another running – say, transplanting a screen – couldn't get the device to recognize the part because all the world's civilian aircraft were grounded, meaning Medtronic's technicians couldn't swan into their hospitals to type in the unlock code and charge them hundreds of dollars.
The saving grace was an anonymous, former Medtronic repair tech, who built pirate boxes to generate unlock codes, using any housing they could lay hands on to use as a case: guitar pedals, clock radios, etc. This tech shipped these gadgets around the world, observing strict anonymity, because Article 6 of the EUCD also bans circumvention:

Of course, Apple is a huge fan of VIN-locking. In phones, VIN-locking is usually called "serializing" or "parts-pairing," but it's the same thing: a tiny subassembly gets its own microcontroller whose sole purpose is to prevent independent repair technicians from fixing your gadget. Parts-pairing lets Apple block repairs even when the technician uses new, Apple parts – but it also lets Apple block refurb parts and third party parts.
For many years, Apple was the senior partner and leading voice in blocking state Right to Repair bills, which it killed by the dozen, leading a coalition of monopolists, from Wahl (who boobytrap their hair-clippers with springs that cause their heads irreversibly decompose if you try to sharpen them at home) to John Deere (who reinvented tenant farming by making farmers tenants of their tractors, rather than their land).
But Apple's opposition to repair eventually became a problem for the company. It's bad optics, and both Apple customers and Apple employees are volubly displeased with the company's ecocidal conduct. But of course, Apple's management and shareholders hate repair and want to block it as much as possible.
But Apple knows how to Think Differently. It came up with a way to eat its cake and have it, too. The company embarked on a program of visibly support right to repair, while working behind the scenes to sabotage it.
Last year, Apple announced a repair program. It was hilarious. If you wanted to swap your phone's battery, all you had to do was let Apple put a $1200 hold on your credit card, and then wait while the company shipped you 80 pounds' worth of specialized tools, packed in two special Pelican cases:

Then, you swapped your battery, but you weren't done! After your battery was installed, you had to conference in an authorized Apple tech who would tell you what code to type into a laptop you tethered to the phone in order to pair it with your phone. Then all you had to do was lug those two 40-pound Pelican cases to a shipping depot and wait for Apple to take the hold off your card (less the $120 in parts and fees).
By contrast, independent repair outfits like iFixit will sell you all the tools you need to do your own battery swap – including the battery! for $32. The whole kit fits in a padded envelope:

But while Apple was able to make a showy announcement of its repair program and then hide the malicious compliance inside those giant Pelican cases, sabotaging right to repair legislation is a lot harder.
Not that they didn't try. When New York State passed the first general electronics right-to-repair bill in the country, someone convinced New York Governor Kathy Hochul to neuter it with last-minute modifications:

But that kind of trick only works once. When California's right to repair bill was introduced, it was clear that it was gonna pass. Rather than get run over by that train, Apple got on board, supporting the legislation, which passed unanimously:

But Apple got the last laugh. Because while California's bill contains many useful clauses for the independent repair shops that keep your gadgets out of a landfill, it's a state law, and DMCA 1201 is federal. A state law can't simply legalize the conduct federal law prohibits. California's right to repair bill is a banger, but it has a weak spot: parts-pairing, the scourge of repair techs:

Every generation of Apple devices does more parts-pairing than the previous one, and the current models are so infested with paired parts as to be effectively unrepairable, except by Apple. It's so bad that iFixit has dropped its repairability score for the iPhone 14 from a 7 ("recommend") to a 4 (do not recommend):

Parts-pairing is bullshit, and Apple are scum for using it, but they're hardly unique. Parts-pairing is at the core of the fuckery of inkjet printer companies, who use it to fence out third-party ink, so they can charge $9,600/gallon for ink that pennies to make:

But if turning phones into e-waste to eke out another billion-dollar stock buyback is indefensible, stranding people with disabilities for months at a time while they await repairs is so obviously wicked that the conscience recoils. This is big! It's momentum! It's a start!
But it can't be the end. When Bill Clinton signed DMCA 1201 into law 25 years ago, he loaded a gun and put it on the nation's mantlepiece and now it's Act III and we're all getting sprayed with bullets. Everything from ovens to insulin pumps, thermostats to lightbulbs, has used DMCA 1201 to limit repair, modification and improvement.

Have Researchers Found Amelia Earhart’s Long-Lost Plane?
A new sonar image shows an airplane-shaped object resting on the bottom of the Pacific Ocean, not far from where Earhart and her navigator, Fred Noonan, went missing in 1937.
On July 2, 1937, pioneering pilot Amelia Earhart vanished somewhere over the Pacific Ocean near the end of her historic around-the-world flight. For decades, her mysterious disappearance has perplexed explorers, who have spent millions of dollars trying to find her missing Lockheed 10-E Electra plane.
Now, a possible new clue has emerged in the case: A sonar image captured during an expedition last fall shows an airplane-shaped object sitting on the ocean floor, not far from where experts believe Earhart likely crashed, reports the Wall Street Journal’s Nidhi Subbaraman.
The blurred object is far from definitive proof, but Dorothy Cochrane, an aeronautics curator at the Smithsonian’s National Air and Space Museum, tells Smithsonian magazine it’s “an intriguing image” that warrants a second look.

The expedition was led by Tony Romeo, who is a former intelligence officer with the U.S. Air Force, a pilot and a commercial real estate investor from South Carolina. In 2021, he sold his real estate properties and spent $11 million to fund the trip, including buying high-tech equipment to aid in the search.
“This has been a story that’s always intrigued me, and all the things in my life kind of collided at the right moment,” Romeo tells Business Insider’s Katherine Tangalakis-Lippert and Rebecca Rommen. “I was getting out of real estate and looking for a new project, so even though I really started about 18 months ago, this was something I’ve been thinking and researching for a long time.”
Last September, a team from the exploration company Deep Sea Vision, which Romeo founded, departed from Tarawa, Kiribati, in the South Pacific aboard a research vessel. Working in 36-hour shifts, the 16-person crew used an underwater autonomous vehicle equipped with sonar to scour the sea floor, scanning roughly 5,200 total square miles.
About 90 days into the trip, the team was reviewing sonar images and noticed something unusual in the data from some 60 days prior. The mysterious object looked to be about the same shape and size as an aircraft, and it was identified roughly 100 miles from Howland Island, which is within the region where experts think Earhart’s plane went down. The object is around 16,400 feet below the water’s surface.

By then, however, the crew had determined it was too late to return to the site for a closer look. The camera on the underwater vehicle was also broken, which meant they wouldn’t be able to see anything if they did circle back, reports the Post and Courier’s Tony Bartelme.
But Romeo is undeterred and hopes to revisit the area in the future.
“This is maybe the most exciting thing I’ll ever do in my life,” he tells the Wall Street Journal. “I feel like a 10-year-old going on a treasure hunt.”
In the meantime, the sonar image is not detailed enough for experts to draw any definitive conclusions.
“It definitely appears to be an aircraft of some sort,” David Jourdan, who has searched three times for Earhart’s missing plane and is the co-founder and president of the ocean exploration company Nauticos, tells the Post and Courier. “It has aircraft-like features. But sound is funny. It can mislead you. We can’t say it’s her plane until you put a camera on it.”
To truly identify the object, future missions would ideally capture detailed images that contain the registration number of the plane, says Cochrane. Or, at the very least, they might more clearly show the submerged object’s dimensions and shape to see if it matches the model of Earhart’s vehicle.

“It really requires further research,” says Cochrane. “Finding something that’s really worth investigating further is step one. Verifying it’s the actual craft is step two. And step three becomes: Is it possible to recover this or not, or should it just be left where it is?”
At the time of her disappearance, Earhart was a global celebrity—speaking with the Wall Street Journal, Romeo likens her to Taylor Swift today. In June 1928, Earhart became the first woman to fly across the Atlantic Ocean (as a passenger of pilots Wilmer Stultz and Lou Gordon), a feat that propelled her to international stardom.
Nearly four years later, in May 1932, she made history again by becoming the first woman to fly solo across the Atlantic Ocean. Later that year, she became the first woman to fly solo across North America and back. And in 1935, she became the first person, regardless of gender, to fly solo from Honolulu, Hawaii, to Oakland, California.
In the summer of 1936, the renowned pilot began to plan her most ambitious trip yet: a circumnavigation of the globe. On May 20, 1937, Earhart and her navigator, Fred Noonan, departed from Oakland for the first leg of the trip. They flew nearly 22,000 miles, making stops in Miami, South America, Africa and India along their eastward route.

By late June, they had made it to Lae, Papua New Guinea. After a few days’ rest, they departed for Howland Island, a small, uninhabited outcrop in the Pacific where a refueling station had been built for their journey. The U.S. Coast Guard had a vessel, the Itasca, stationed nearby to help with the landing.
Operators aboard the Itasca heard Earhart’s radio messages as she got closer and closer to the island. But eventually, they lost contact. Earhart and Noonan were never seen or heard from again.
The U.S. Navy and Coast Guard spent 16 days searching for the missing duo without success. About one and a half years later, on January 5, 1939, Earhart was declared dead.
Theories abound about her mysterious disappearance—some onlookers have speculated that she was a spy or that she was captured by a foreign military. But Cochrane believes the simplest explanation is the most plausible: that Earhart and Noonan ran out of fuel near Howland Island.
“She’s got to be around there somewhere,” she adds.

I was a bit surprised to see that mhj specifically said that newjeans had approved the statement saying that belift had copied newjeans' concept with illit. I'm not the type of person that thinks that you're a bitch for asserting position or your value, so this isn't where I'm coming from, but, especially in an industry where it's so rare to see groups say anything negative about other groups, particular junior groups I would think, it was quite the strong, swift position to take. Do you foresee newjeans continuing to engage publicly with this scandal, and how would you think taking an active part in this would affect their brand?

I think these six asks capture most of the talking points in the asks I've received since yesterday, so I'll use these to answer your questions.
The sheer amount of spin happening in the media right now is ridiculous lmaoo. With the mention of BTS in the "escape files", ARMYs have predictably moved from shady bystanders to actively joining in the negative spin, spreading rumor articles and many are now attacking the girls themselves. But honestly, this is nothing less than what I expected. NewJeans is the most popular group in Korea, the 2nd most valuable IP only behind BTS, and Min Heejin is the brains behind the operation - an achievement she's insisted on taking full credit for since inception. Leaving the only option for whoever is masterminding this from within and outside HYBE, to destroy her reputation as an executive completely to diminish her value to outside investors, and weaken the fan support for NewJeans given how closely they are already associated with MHJ. And that's what is happening. It impacts every group at HYBE and nearly obliterates the viability of NewJeans.
For HYBE, it's a tolerable loss given there's only one year left before BTS returns and closes that earnings gap in mere months. Whoever took this action sees it simply as resulting in a numerical loss that can be soon corrected, but personally, I disagree, for the same reasons I objected to HYBE's acquisition of SM even though on paper it made numerical sense.

I'm not sure how familiar you are with ADOR's press releases in general, but anybody who reads them can tell there's almost no corporate doublespeak, no vague allusions, nothing that shows it's written by a typical media-trained PR person. Which is why most people, including you, take that statement to mean NewJeans agrees with MHJ that Illit copied them (it's a possibility), when in reality the language shows it could refer to them agreeing with MHJ's assertion that HYBE hasn't duly responded to her requests about inter-label discrimination, or other related matters. That's the kind of detail a trained PR person would be sure to include, to minimize the fallout to NJ, but just as with the press release on Cookie, the one on Minji's rival sasaeng, the response to Hyein's veneer rumours, and practically every press release ADOR has put out, the language is unsophisticated.

NewJeans has so far not engaged publicly with this scandal. MHJ has mentioned them to signal any separation between them will likely be contested. It's leverage. If they do take an active part in this scandal, it will completely destroy their brand. Like, it's already on life support. Anything more and we might as well say their last rites.

Anon in ask 2: I'd say that's not a conspiracy exactly but it is kinda pushing it. Anytime there's a stock dip it's a buying opportunity, and HYBE is always guaranteed to be a Buy so long as BTS is slated to return within 12 months of the stock event. But we simply don't have any clear indications that's the case now given the timing doesn't quite line up. If anything, that is more like the 4th order side-effect.
And yeah, people on the corporate side, not just in k-pop, are many times just that petty. But it's also true this case has been sensationalized in particular ways to appeal to k-pop stans specifically.

None of these options are good, but the worst of these evils is option 2. If the members attempt to leave with her, there's no pretty way to say this, but they'll be done. I'm not even going to waste time writing all the ways HYBE and k-pop stans as a whole will rip them to shreds, all I'll say is that whoever is attached to these girls should consider taking a 6 months sabbatical away from k-pop entirely once that news breaks. The law is not on their side and public opinion, especially after all the 'leaks' and spin from HYBE in the last 72 hours, certainly isn't on their side either. It would be career suicide.

Personally, I think yes. Every label at HYBE had similar initial monetary investment as NewJeans and ADOR had, and other groups from the Big 3 have had even bigger investments and resources at their disposal. There isn't a single group, both within HYBE and outside HYBE, that has yielded the same results as NewJeans in the same period of time. Illit comes close, but even with their achievements they haven't reached the same (positive) notoriety as NewJeans did at debut. All HYBE groups have access to HYBE's youtube channel, connections and resources, and yet the achievements of BOYNEXTDOOR, LE SSERAFIM, ENHYPEN, and even ILLIT, are nowhere near comparable to that of NewJeans. And I agree with MHJ that she's the primary reason why. Having access to resources is only one part of the equation. How you allocate those resources and what you do with it is far more important, and this is where MHJ and ADOR excels relative to other sub-labels.
NewJeans without MHJ will not be nearly as threatening to everyone else in k-pop, and I suspect this is one reason there have been calls for her to be removed from managing the group since their debut.

Anons in ask 3 & 6: Yeah there's a fair bit of greed on show here. Generally, for a lot of people in this industry, greed is good... unless the greedy person is a woman. Because the only thing more central to nasty corporate tussles like this, more than greed, is ego.
I'm not trying to play the gender card, but sometimes I do wonder why there are no articles like this about people like Jaden Jeong and Simon Jakob given the reputation those men have in corporate circles, where top officials (in this case, within HYBE) are saying they cannot possibly work with MHJ because she is "overly and excessively opinionated". I'm highlighting this article because despite the initial paragraphs of spin, that bit is the only thing consistent with MHJ's claim that this attack from HYBE started because she'd filed a whistleblowing report on toxic inter-label competition and followed up an email that said quote:
"..is this deliberate obtuseness and unapologetic behaviour consistent with HYBE's founding philosophy of rebelling against unfair practices in the entertainment industry?"
I mean... in corporate Korea, I can see how they were sick of her shit and it was only a matter of time before she got the boot.
The insidious thing about spin is that it mixes the truth with lies, making it easy for people to accept it wholly. It's entirely possible that MHJ wants more compensation, more autonomy and independence, feels that Belift and other companies borrowed her ideas without full credit, and that she was unsupported by HYBE HQ. It's entirely possible that she took actions such as monitoring fan feedback of the group(s) she suspects and filing a whistleblowing report to build a case - according to both MHJ and others at HYBE, these are complaints she's apparently had since last year, but none of those things would justify HYBE's response nor is it enough to turn people against her.
What I find particularly interesting about this case, is that everything that decisively incriminates her of the more sensational and sinister allegations, comes from the person of VP L or CEO A - a person who only joined ADOR in January 2024, shortly after which HYBE received their first tip-off that MHJ was planning to escape. It's VP L who titles documents with the equivalent of "TOP SECRET DO NOT TOUCH" on company computers... the same guy that's supposedly a double agent working in favour of MHJ and ADOR but is situated within ADOR, not HYBE, where simple logic shows he'd be most useful. Unless he's situated right where he's supposed to be.
Anyway...
HYBE has requested for a shareholder meeting on April 30th where they'll likely table the motion for MHJ to resign regardless of what's found in the audit. Far as I know, she's completed the audit questionnaire but not surrendered her laptop as HYBE has requested. Given the play is for HYBE to kick her out while continuing to manage NJ, I can see how she'd rather die than surrender her laptop and hand over her ideas (and potentially incriminating info) to HYBE on a silver platter for them to use in her wake.
Every way this shakes out is bad news for HYBE groups IMO. So long as NewJeans keeps quiet and sides with HYBE, they'll be somewhat okay. But regardless of the fallout from HYBE cannibalizing itself, all HYBE groups have no choice but to take it on the chin and bide their time until BTS comes back to capture the attention back to them.

Hi! Thank you very much! ☺️💗 I actually haven’t shared much about myself in a while.
Here are a few things about me:
1. I am in e-commerce. I own 12+ stores, launching a few brands this year (very soon actually).
2. Aries sun, Scorpio moon.
3. I’m very into health and wellness. I work out 5 days a week and starting last year have gotten very into supplements. My diet consists of only grass fed pasture raised meats and organics.
3. I love love love cooking. I would cook all day if I could.
4. I read two books a week on average.
5. I speak English, Spanish, Italian and learning Mandarin currently.
6. I love learning. I love creating. Makes me so happy.
7. I love outdoor activities and going to eat above anything else. Not a party girl and not into crowds.
8. My days are mostly work, tan, workout and repeat lol
9. I’m a nut about my skin and take ALOT of care of myself.
10. I’m almost always in dresses aside from when I’m working out. Always make it a point to dress up.
11. I’ve traveled quite a bit! Waiting for my passport renewal to go overseas for a few months (probably).
12. I’ve sponsored loads of kids from all over the world. I want to do more charity work but the projects I want to get into don’t have the nicest price tags.. so we keep working. But that’s actually something very important to me. I love helping people. I help a lot of people. I mentor alot of people. It makes me happy. I’ve been through absolute hell and wouldn’t want anyone to feel the way I’ve felt.
13. I like nice things. I have nice things… but I don’t like to have alot of things. Not very materialistic in that sense.
14. I bootstrapped my whole entire life. I grew up poor. I am an immigrant. I have never borrowed a dollar from a single man or woman for any business I’ve ever started. (Bootstrapped means when you fund something yourself without investors our outside capital).
15. I live for kids and animals. I’m dying to have children. Hopefully soon by the grace of God. Working very hard on aligning myself with this dream. (This is one of the things that prompted my own shadow work/journaling/healing journey last year).

I’ve been curious about any relationships and linkages between SMA title, Alba and Jinx. Finally, I’ve managed to discover Chris’ influencer profile on one marketing platform (note: Carbons Dating The Web estimated creation date: 2023-06-01).
There are some interesting facts and figures in the case study:
Premium US dog superfood brand, Jinx is redefining dog nutrition and is sold at Walmart stores across the country. Its audience are 71% female, typically single or married and aged in their thirties. English-speaking, Jinx’s followers are 84% US-based, with India, The Philippines, Indonesia and Brazil as secondary markets. Top cities for its customers include New York, LA, San Francisco and Chicago.
Looking at celebrity influences, Chris Evans does not appear in the list.
Media-wise, Buzzfeed, Betches Media, The New York Times, HGTV, The New Yorker, People Magazine, Vice and Bon Appetit come out on top for consumption.
