"The Man Who Came To Dinner” was a presentation of Lux Radio Theatre, broadcast on CBS Radio on March  27, 1950.

The Man Who Came to Dinner is a comedy in three by George S. Kaufman and Moss Hart. It debuted on October 16, 1939, at the Music Box Theatre in New York City, where it ran until 1941, closing after 739 performances. It then enjoyed a number of New York and London revivals.

The play was adapted for a 1942 feature film, scripted by Philip G. Epstein and Julius J. Epstein and directed by William Keighley. The film featured Monty Woolley, Bette Davis, Ann Sheridan, Billie Burke, Jimmy Durante, Mary Wickes and Richard Travis. 
“The Man Who Came to Dinner” was previously presented on radio by Philip Morris Playhouse on July 10, 1942. Monty Woolley, who played the leading role in the film version, starred in the adaptation. It was broadcast again by Theatre Guild on the Air on ABC Radio November 17, 1946 starring Fred Allen. In 1949, “The Man Who Came to Dinner” was produced on “The Hotpoint Holiday Hour” starring Charles Boyer, Jack Benny, Gene Kelly, Gregory Peck, Dorothy McGuire, and Rosalind Russell.

On October 13, 1954, a 60-minute adaptation was aired on the CBS Television series “The Best of Broadway.”  A “Hallmark Hall of Fame” production was broadcast n November 29, 1972 starring Orson Welles, Lee Remick (Maggie Cutler), Joan Collins (Lorraine Sheldon), Don Knotts (Dr. Bradley), and Marty Feldman (Banjo). The 2000 Broadway revival was broadcast by PBS on October 7, 2000, three days after the New York production closed, and was also released on DVD.
Synopsis ~ The story is set in the small town of Mesalia, Ohio in the weeks leading to Christmas in the late 1930s. The outlandish radio wit Sheridan Whiteside is invited to dine at the house of the well-to-do factory owner Ernest Stanley and his family. But before Whiteside can enter the house, he slips on a patch of ice outside the Stanleys' front door and injures his hip. Confined to the Stanleys' home in a wheelchair, Whiteside and his retinue of show business friends turn the Stanley home upside down!  But is he really injured? 
This adaptation was written by S.H. Barnett. The characters eliminated for this adaptation include Richard Stanley, John, Mrs. Dexter, and Mrs. McCutcheon.
The show is hosted by William Keighley, who directed the 1942 film adaptation.

Lux Radio Theatre (1935-55) was a radio anthology series that adapted Broadway plays during its first two seasons before it began adapting films (”Lux Presents Hollywood”). These hour-long radio programs were performed live before studio audiences in Los Angeles. The series became the most popular dramatic anthology series on radio, broadcast for more than 20 years and continued on television as the Lux Video Theatre through most of the 1950s. The primary sponsor of the show was Unilever through its Lux Soap brand.

Lucille Ball (Maggie Cutler) was born on August 6, 1911 in Jamestown, New York. She began her screen career in 1933 and was known in Hollywood as ‘Queen of the B’s’ due to her many appearances in ‘B’ movies. “My Favorite Husband” eventually led to the creation of “I Love Lucy,” a television situation comedy in which she co-starred with her real-life husband, Latin bandleader Desi Arnaz. The program was phenomenally successful, allowing the couple to purchase what was once RKO Studios, re-naming it Desilu. When the show ended in 1960 (in an hour-long format known as “The Lucy-Desi Comedy Hour”) so did Lucy and Desi’s marriage. In 1962, hoping to keep Desilu financially solvent, Lucy returned to the sitcom format with “The Lucy Show,” which lasted six seasons. She followed that with a similar sitcom “Here’s Lucy” co-starring with her real-life children, Lucie and Desi Jr., as well as Gale Gordon, who had joined the cast of “The Lucy Show” during season two. Before her death in 1989, Lucy made one more attempt at a sitcom with “Life With Lucy,” also with Gordon.

Clifton Webb (Sheridan Whiteside) had appeared with Lucille Ball in the 1946 film The Dark Corner. He was nominated for three Oscars. Webb had played the role of Sheridan Whiteside on stage for two years.
Eleanor Audley (Mrs. Stanley) appeared in several episodes of Lucille Ball’s “My Favorite Husband” as mother-in-law Letitia Cooper. Audley was first seen with Lucille Ball as Mrs. Spaulding, the first owner of the Ricardo’s Westport home in “Lucy Wants to Move to the Country” (ILL S6;E15). She returned to play one of the garden club judges in “Lucy Raises Tulips” (ILL S6;E26). Audley appeared one last time with Lucille Ball in a “Lucy Saves Milton Berle” (TLS S4;E13) in 1965.
Ruth Perrott (Sarah) played Katie the maid on Lucille Ball’s radio show “My Favorite Husband.” On “I Love Lucy” she played Mrs. Pomerantz in “Pioneer Women” (ILL S1;E25), was one of the member of the Wednesday Afternoon Fine Arts League in “Lucy and Ethel Buy the Same Dress” (ILL S3;E3), and played a nurse when “Lucy Goes to the Hospital” (ILL S2;E16).
Betty Lou Gerson is best remembered as the voice of Cruella De Ville in the original Disney film One Hundred and One Dalmatians (1961).
Stephen Dunn had appeared with Lucille Ball in Miss Grant Takes Richmond (1949).

Professor Metz was based on Dr. Gustav Eckstein of Cincinnati (with cockroaches substituted for canaries), and Lorraine Sheldon was modeled after Gertrude Lawrence.
The character of Harriet Sedley, the alias of Harriet Stanley, is an homage to Lizzie Borden. The popular jump-rope rhyme immortalizing Borden is parodied in the play.

Sometimes this is the best approach. I did this at a car dealership who was trying to charge me for work they did when the vehicle was under warrantee. They claimed they "found nothing wrong with the vehicle after driving it for 20 miles and I would charged for labor." Went out to my vehicle, sure as shit, the clutch was STILL stuck to the floor (which is why I had it towed there). During her last years of schooling, Derek and Nancy enrolled Elizabeth in high level science and mathematics classes in anticipation of her following her father into a career of engineering. However, Elizabeth's strongest talents lay within the more artistic courses and her grades plummeted. As such, she was forced to attend high school for an additional year.. I just feel so hopeless.As I frugal and I sensitive to citronellol, limonene and linalool, I like to experiment with different store bought oils. So far I like flaxseed oil, grapeseed oil, walnut oil and sesame seed oil. I don find jojoba oil to be superior to any of the above oils. In Pikmin there are many bridges to build or gates to tear down, which provides you shortcuts or new areas for the next day, while in Majora Mask you only have to play up to the point where you get new equipment or learn a new song, then you can usually reset the cycle and start again from nearly the same point you left off. Chopping up progress like into bitesize chunks like this makes it much less of a punishment to reset the cycle and makes the game more enjoyable.. NTA. I do think I can understand why he might have been a bit bothered by it though. Engagement rings are crazy expensive and usually shown off quite a bit, so to someone who didn know about your anxiety it could have looked a bit weird and as if there was some kind of problem in the relationship or something, so maybe that why it bothered him so much?. Instead of paying for a ticket every time people see a movie, they pay a monthly subscription fee that allows them to see as many movies as they want. When enough people sign up, theaters have a stabilized revenue stream. The company's first customer, a theater in California, increased revenue from $700,000 to $1.5 million after signing up with Movie Heroes [source: Pomerantz].. I tried not to take it personally but I would support them if they had a channel. Actually, one of my friends just started a channel and I was the first one to subscribe and have watched all her videos. I recently let my family know and they have also been supportive. Want to see the pool from their kitchen and living area, Mr Gray said. Need a visual of the kids, so it needs a connection with the kitchen and living area. That where people will want their pool now.

Who could pick in the category of actor/ drama with Bateman, Odenkirk, Pacino, Josh O’Connor and Matthew Rhys?  Another tough one is show/ drama with The Crown. Ozark, Lovecraft Country and Ratched. Directing categories are also tough with Regina King for One Night in Miami, David Fincher for Mank and Aaron Sorkin for The Trial of the Chicago 7.  There are great performances with the females but Anya Taylor-Joy and Queen’s Gambit just has to win. Will comedy be ruled by Dan Levy and co. for Schitt’s Creek? The Foreign press gave love to Chadwick Boseman and Viola Davis in Ma Rainey’s black bottom, Olivia Coleman, Jodie Comer, Sarah Paulson, Bryan Cranston, Hugh Grant and James Corden. Sacha Baron Cohen got a couple of noms. I was glad to see noms for Lin- Manuel Miranda, Andy Samberg, Dev Patel, Bill Murray, Andra Day, Glenn Close, Helena Bonham Carter and Cynthia Nixon and Jared Leto.  I was routing for Donald Sutherland in the Undoing and Jodie Foster in The Mauritanian. ** So The Globes came and went with not too much excitement. Jodie did win so hooray for her!! Catherine O’Hara, Sacha  and Mark Ruffalo won. Everyone was thrilled for The Queen’s Gambit and Anya Taylor-Joy!! There were some very long speeches and a few did dress up. There were also hoodies and jammies in the virtual world. Mank had many noms but no wins. Rosamund Pike was a surprise win but she was scary good. The hosts Amy and Tine were going for sexy!!

Gangland Lawyering? Featuring Pierce Bainbridge & Hecht Partners
Rudy Giuliani tied himself to Pierce Bainbridge Beck Price & Hecht LLP with a tweet announcing the firm would represent him for the Ukraine fiasco. The man formerly known as “America’s Mayor” made his chops taking on “The Five Families,” a New York City Organized Crime syndicate. The revelations coming out of Pierce Bainbridge have many opining that Pierce Bainbridge operations are more akin to a criminal enterprise than a reputable law firm. A bombshell accusation from an ex-firm associate has increased the already searing spotlight on the firm, as well as its current and former partners.  The accusations – which sound like something that could be found in Rudy’s bag of tricks – include alleged fraud on a federal court and related intimidation tactics.
 “Intimidation” & “Fraud on the Court” Accusations
A new outside lawyer for Pierce Bainbridge, Ed Altabet of Cohen Seglias, has been accused of attempting to “intimidate” the ex-associate from coming forward with accusations that ex-Pierce Bainbridge named-partner David L. Hecht (Hecht Partners) intentionally defrauded a federal court.  The issue arose in connection with a putative class action against Boeing and Southwest Airlines.  The story is covered by LawFuel.com here.
Hecht has been so loyal to Pierce, his ex-partner Christopher N. LaVigne (Withers Bergman) said “David would toss dogs off of cliffs,” if Pierce said it was a good strategy.  To be fair, LaVigne clearly has a low opinion of Hecht, LaVigne has also opined in writing:  “David is an embarrassment to lawyers everywhere.  Some of the worst lawyers I know are better than David.”  Similarly, Mike Masnick of Techdirt.com, referred to a complaint Hecht filed on behalf of Tulsi Gabbard as “laughable” and said Hecht should be “embarrassed.”
Notwithstanding these views, Hecht recently started his “own firm,” Hecht Partners LLP.  Oddly, seven (7) of the eight (8) lawyers are from Pierce Bainbridge, certain administrative personnel from Pierce Bainbridge have reportedly joined, and Hecht puzzlingly said in open court that while he is no longer a partner at Pierce Bainbridge, he still works with the firm.
This, as well as related events such as the Boeing Southwest fiasco, the reported $65,000,000 Pierce Bainbridge debt to litigation funder Virage Capital Management, and the at least six lawsuits currently facing Hecht’s former firm, has led to suggestions that the two firms, and perhaps a third-party, are involved in Gangland-like shell-game shenanigans.
The Bombshell Filing does nothing to help the image of the newly established Hecht Partners.  It has Gangland tactics written all over it.  The former associate took direct aim at Altabet and Hecht.
Altabet replaced long-time Giuliani ally, and a lawyer intricately connected to Donald Trump, Mark Mukasey. Even for Mukasey, the Pierce Bainbridge environment appears to have been unacceptable; he withdrew citing ethics concerns.  In came Altabet, and the unethical conduct did not skip a beat.
In a filing in the United States District Court for the Eastern District of Texas in front of the Honorable Judge Amos L. Mazzant, the ex-associate said:
“After reviewing the transcript from the May 13th hearing in this matter, I have confirmed what I believe are numerous statements of material fact by David Hecht which are inaccurate, and may have been made to intentionally mislead counsel and the Court.”
“[I]n light of an email I received from Pierce Bainbridge’s outside counsel, Ed Altabet, today, in which he made several baseless accusations against me in what appeared to be an effort to intimidate me and hamper my efforts to correct the record, I request an In-Camera ex parte hearing before the Court.”
The John Pierce, Keyboard-Fueled Gangland Tactics
Pierce’s bombast proclamations of global domination, and overwhelming lack of candor, have rendered the Harvard Law School graduate a laughingstock in many legal circles.
Pierce is still, however, commonly seen as the straw stirring Hecht’s actions, as well as the driving force behind the intimidation tactics.  Pierce, who claims to have been a tank platoon leader in the United States Army, takes his faux machismo passionately; for example, a report by Meghan Tribe in Law.Com, quotes Pierce:
“We are building an army of killers on a highly collaborative platform. In addition, we have a culture obsessed with winning and bringing maximum value to clients.” – John Pierce, January 3, 2019
Pierce subsequently attacked Tribe on LinkedIn in a falsehood-ridden post with his disciples lending support.  Former Pierce Bainbridge partners Michael Pomerantz, Thomas Warren (Warren Terzian), Johanthan Kortmansky (BraunHagey & Borden) and, you guessed it, David Hecht endorsed Pierce’s nonsense.
Indeed, the Pierce modus operandi seems to be to threaten by e-mail.
For example, Pierce threatened a former client by email, the client reported Pierce to the California State Bar and included an opinion that Pierce is a “menace to the legal society.”
Pierce threatened a lending company named Newtek by email in September 2018; in early October 2018, Newtek denied Pierce’s request for a $ 1 million SBA loan secured by a client’s $ 6 million home;  the denial was related to Pierce’s obligations to the Internal Revenue Service (IRS) as well as California state tax authorities.  (Public records show Pierce has around $1.5 million in tax liens, e-mails show he owes $21,000 month alimony, and Pierce claims to be the sole guarantor of a $65,000,000 Pierce Bainbridge debt to Virage Capital Management.)
To complete the trifecta, Pierce also threatened former partner and whistle blowing Don Lewis by email.  Lewis’s ex-partners, all who have been sued by him, were on the email. Lewis says, “despite their fiduciary duties of care, they all did nothing.”  (Denver G. Edwards pictured, joined after Lewis, but has been accused, along with Christopher N. LaVigne (Withers Bergman) of “lying under oath” to smear Lewis.)

The Mysterious Richard Silverstein of Loan Annex
An individual who may have some answers, but to date has largely stayed out of the fray, is Richard Silverstein the Founder of Loan Annex.
Silverstein is pictured above with promotional material from his LinkedIn page.  The Loan Annex founder filed a sworn affidavit in federal bankruptcy court at the end of last year stating:  “Throughout 2019, I was engaged by Pierce Bainbridge as their consultant for the purpose of arranging financing for the firm.” 2019 is when both tranches of the $65 million Virage deal were struck.
Interestingly, Silverstein’s affidavit was filed to support the claims of a lender named Counsel Financial; Pierce Bainbridge was allegedly in discussions with Counsel Financial about financing in March 2019.  In line with the Gangland theme, the underlying debtor claimed in an affidavit:  “A colleague of mine derided these tactics as ‘Mafia-style’ intimidation, but even the Mafia had a code about attacking family members.”  The tactics had to do with alleged e-mail threats from a lawyer for Counsel Financial.
More Questions:  What’s Going on with Talon LF, LLC
Recently leaked solicitation materials for potential investors in a litigation fund intricately intertwined with Pierce Bainbridge may also shed light; the name of the fund is Talon LF, LLC.
Two ex-Pierce Bainbridge partners, Doug Curran (BraunHagey & Borden) and Thomas D. Warren (Warren Terzian), as well as Pierce are listed as closely affiliated.
The Talon investor solicitation materials appear to have several issues, but there are two glaringly puzzling representations.

A chart which represents a positive investment rate of return (“IRR”) for litigation funder Pravati Capital, which apparently failing to indicate that Pravati declared a $9,157,072.95 default.
Are these representations true?  Are they materially misleading? Are they fraudulent?
Issues surrounding the clearing of the Pravati default raise more Gangland type flags.  A former firm client, Gustavo Escamilla, President of Greenway Nutrients, says he “has strong reason to believe that Mr. Piece and his firm Pierce Bainbridge accepted bribes ”from individuals with “criminal backgrounds” and  “used this bribe money to pay down some, or all, of an over $9.1 million [Pravati] default.”
Escamilla has also developed a compelling timeline, which suggest his claims may be valid.
The General Counsel & Blind Eye:  Carolynn K. Beck
On the issue of Pravati, ex-firm General Counsel, Carolynn K. Beck, now a partner at Goldstein & McClintock, was intricately connected to Pravati.  She is alleged to have misrepresented, with Pierce, a case value to Pravati by well over $900,000,000.00, and documents appear to support the same.  In addition, a Philly lawyer has sued Beck individually, the other named partners and Pierce Bainbridge claiming the case value presented to Pravati was wildly overinflated. The Philly lawyer worked the same case for 16 months before Pierce Bainbridge took over.
Beck joined her new firm with Craig Bolton; the duo reportedly worked very closely together at Pierce Bainbridge. Bolton was apparently involved in litigation funding efforts, including the alleged discussions with Counsel Financial in March.
A cavalcade of severe misconduct happened under Beck’s watch:  lies under oath, violations of ethical rules, deletion of evidence, misogyny from the top, potential double-pledging of firm collateral, Pierce siphoning funds from firm accounts, the list goes on.
Beck as General Counsel for the firm, appears, at best, to have done nothing to stop it.  A type of Gangland consigliere who seems to have made an internal oath to never get in the way.
As an example, written communications indicate Beck was aware of Pierce using firm accounts as a personal piggy bank back in October 2018.  A text that Lewis received from the firm’s bookkeeper, just days before being banished, strongly suggests the Goldstein & McClintock partner was in the know.
Subsequent to this October 2018 message, the Firm, under Beck’s watch, would go on to rack up a $65 million debt from April 2019 – April 2020, find itself a defendant in three cash advance lawsuits (where upfront cash was provided in exchange for alleged firm receivables) and see a mass exodus of attorneys starting in October 2019.  Beck’s apparent willful turn of a blind eye is not consistent with the role of a General Counsel.
Camille Varlack, Kevin Cash & The Future
Beck left the firm around a month ago; a Law360 article said Chief Operating Officer and Deputy General Counsel Camille Varlack and Chief Financial Officer Kevin Cash were running Pierce Bainbridge while Pierce was on a forced leave of absence. Both Varlack and Cash are not part of the original Pierce Bainbridge inner circle; but their role in leadership positions, with apparent visibility into the firm’s finances is noteworthy.
With a firm boasting so many red flags, the possibility of a wide-ranging Pierce Bainbridge bloodbath seems more likely by the day. Cash and Varlack may be subjected to some hard questions about what they knew, when they knew it and what they did about it.
Giuliani, some would say, has learned from the mobsters he used to prosecute and has pulled off Gangland tactics for years, while remaining relatively unscathed.  It remains to be seen if this brat pack of attorneys Rudy hired have what it takes to keep ahead of the tsunami of severe issues that are closing in on them.

“My Favorite Husband” was based on the novels Mr. and Mrs. Cugat, the Record of a Happy Marriage (1940) and Outside Eden (1945) by Isabel Scott Rorick, which had previously been adapted into the film Are Husbands Necessary? (1942). “My Favorite Husband” was first broadcast as a one-time special on July 5, 1948. Lucille Ball and Lee Bowman played the characters of Liz and George Cugat, and a positive response to this broadcast convinced CBS to launch “My Favorite Husband” as a series. She began her screen career in 1933 and was known in Hollywood as ‘Queen of the B’s’ due to her many appearances in ‘B’ movies. With Richard Denning, she starred in a radio program titled “My Favorite Husband” which eventually led to the creation of “I Love Lucy,” a television situation comedy in which she co-starred with her real-life husband, Latin bandleader Desi Arnaz. When the show ended in 1960 (in an hour-long format known as “The Lucy-Desi Comedy Hour”) so did Lucy and Desi’s marriage. She followed that with a similar sitcom “Here’s Lucy” co-starring with her real-life children, Lucie and Desi Jr., as well as Gale Gordon, who had joined the cast of “The Lucy Show” during season two. Before her death in 1989, Lucy made one more attempt at a sitcom with “Life With Lucy,” also with Gordon.
Richard Denning (George Cooper) was born Louis Albert Heindrich Denninger Jr., in Poughkeepsie, New York. When he was 18 months old, his family moved to Los Angeles. Plans called for him to take over his father's garment manufacturing business, but he developed an interest in acting. Denning enlisted in the US Navy during World War II. He is best known for his  roles in various science fiction and horror films of the 1950s. Although he teamed with Lucille Ball on radio in “My Favorite Husband,” the two never acted together on screen. While “I Love Lucy” was on the air, he was seen on another CBS TV series, “Mr. & Mrs. North.” From 1968 to 1980 he played the Governor on “Hawaii 5-0″, his final role. He died in 1998 at age 84.
Gale Gordon (Rudolph Atterbury) had worked with Lucille Ball on “The Wonder Show” on radio in 1938. One of the front-runners to play Fred Mertz on “I Love Lucy,” he eventually played Alvin Littlefield, owner of the Tropicana, during two episodes in 1952. After playing a Judge in an episode of “The Lucy-Desi Comedy Hour” in 1958, he would re-team with Lucy for all of her subsequent series’: as Theodore J. Mooney in ”The Lucy Show”; as Harrison Otis Carter in “Here’s Lucy”; and as Curtis McGibbon on "Life with Lucy.” Gordon died in 1995 at the age of 89.
Bea Benadaret (Iris Atterbury) was considered the front-runner to be cast as Ethel Mertz but when “I Love Lucy” was ready to start production she was already playing a similar role on TV’s “The George Burns and Gracie Allen Show” so Vivian Vance was cast instead. On “I Love Lucy” she was cast as Lucy Ricardo’s spinster neighbor, Miss Lewis, in “Lucy Plays Cupid” (ILL S1;E15) in early 1952. Later, she was a success in her own show, “Petticoat Junction” as Shady Rest Hotel proprietress Kate Bradley. She starred in the series until her death in 1968.
Ruth Perrott (Katie, the Maid) was also later seen on “I Love Lucy.” She first played Mrs. Pomerantz, a member of the surprise investigating committee for the Society Matrons League in “Pioneer Women” (ILL S1;E25), as one of the member of the Wednesday Afternoon Fine Arts League in “Lucy and Ethel Buy the Same Dress” (ILL S3;E3), and also played a nurse when “Lucy Goes to the Hospital” (ILL S2;E16). She died in 1996 at the age of 96.
Bob LeMond (Announcer) also served as the announcer for the pilot episode of “I Love Lucy”. When the long-lost pilot was finally discovered in 1990, a few moments of the opening narration were damaged and lost, so LeMond – fifty years later – recreated the narration for the CBS special and subsequent DVD release.

Jacob "Jack" Kruschen (Mr. Pearson) was a Canadian character actor who worked in film, television and radio. During the 1940s, he became a staple of West Coast radio drama. He had several roles in programs made especially for the Armed Forces Radio Service (AFRS) broadcast for the benefit of members on active duty in the military in the 1940s and 1950s. He was nominated for the Academy Award for Best Supporting Actor for his role as Dr. Dreyfuss in the 1960 comedy-drama The Apartment. He played a mechanic in The Long, Long Trailer (1954). 
Mr. Pearson is the father of Tommy, the child Liz is baby sitting.

Liz is avoiding seeing George because it is the day he wants to go over their  Christmas list and Liz has not put a penny in the Christmas Club account all year long!  She reluctantly goes into the dining room to try the ‘smooch’ treatment on him. George wants to take half the money in the account and pay bills. Liz tries to ‘Christmas’ him out of the plan, calling him a Scrooge. He relents but that still leaves Liz with an empty Christmas Club account and a full list.

Later, Liz comes up with the idea to make fruitcake for everyone on the list.  That will work for everyone except George.  She wonders if she could make money with a part-time job. Since George has taken the newspaper to work with him, Liz goes next door to see Mr. Wood (Hans Conried), since four of his eleven children have paper routes. Liz arrives just as all eleven of them stamped out the door for school at the same time!
MR. WOOD: “Goodbye, Bob, Madelyn, Adele, Lucille, Ruth, Lucius, Jessie, Walter, Jess, Joanne!” 
After a pause, Little Hugo also scampers by making eleven. These are the names of some of the staff of My Favorite Husband.

Mr. Wood suggests she try to take his daughter Adele’s old job - baby sitting!   Liz dresses up to go on her first baby sitting assignment to take care of Tommy Pearson, who is a sure shot with a pea shooter!  She tells George she is going to a lecture with Iris Atterbury.  
Twenty minutes later, George is pacing the living room without Liz. He figures if Liz is with Iris, Rudolph is available to go to a movie. Iris picks up the phone and knows nothing about the lecture - until she suddenly realizes Liz has lied to George and covers her tracks. But too late!  The cat is out of the bag and both wonder where Liz can be!

After a commercial for Jell-O, the story resumes with Liz arriving home from babysitting, driven by Mr. Pearson, Tommy’s father (Jack Kruschen). George is waiting up for her to ask her about the lecture. Liz lies and says the lecture was about financial matters.
LIZ: “He said not to put your money in fiscals this year. The frost ruined them all.”

George finally confronts her that he knows there was no lecture. Liz can’t tell him where she really was, so George assumes that he has a rival. Liz, having no other choice, plays along.

George spends the night sleeping on the couch. Liz fills Katie in on George’s misapprehension, enjoying the fun.  Iris phones and asks Liz about ‘the other man’ in her life. Liz denies there is another man and Iris assumes she is lying to her! 
George seeks advice from his boss, Mr. Atterbury, who suggest he fight fire with fire and pretend he is in love with another woman. George thinks it might work and is determined to try it. 
Next day Liz is ready to leave to baby sit and George acts unbothered. Liz is bewildered by his behavior.  He says that he is doing the same thing. Liz accuses him of making it up. To prove it, he makes a phone call to Mr. Atterbury, pretending it is his old girlfriend Helen. Mr. Atterbury plays along, but luckily Liz can’t hear his voice - just the radio listeners.  Liz storms out angry. 
Mr. Pearson leaves for the day and George is at the door to confront him - thinking he is Liz’s lover!  He knocks him out!  Liz tells him the truth. 
LIZ: “You just punched yourself out of a Christmas present!”

LIZ: “I’ll speak to Katie and asks her to buy quieter bread. Or, I could puree the bread and eat it with a spoon.”
The phone rings. It is George’s old friend Charlie Nichols. Charlie is a Bullfrog, a member of their college Glee Club. Liz translates the slangy conversation between the old friends for Katie. George riffs a few notes of “Yes Sir, That’s My Baby” into the phone with Charlie.

"Yes Sir, That’s My Baby” is a popular song from 1925 written by Gus Kahn and Walter Donaldson. A week before this episode aired, it was also the title of a Universal motion picture starring Donald O’Connor and Gloria DeHaven. In 1980 the film was referenced in “Lucy Moves To NBC” which featured O’Connor and DeHaven in a show-within-a-show sitcom called “The Music Mart”. 
Liz anticipates that George will want to find his old ukulele for his reunion with Charlie. Naturally, she’s right and naturally Liz has no idea where it is! George reminds her of the time she disposed of all his old clothes, a hint at a future episode titled “Husbands Are Sloppy Dressers” (E95) which would become “Changing The Boys’ Wardrobe” on “I Love Lucy”.  
GEORGE: “A man’s old clothes are filled with sentiment.” LIZ: “That’s sediment, not sentiment!”

On “I Love Lucy” saxophone wasn’t the only instrument she was able to play. Lucy first plays the ukulele in “Ricky Loses His Voice” (ILL S2;E9), “Little Ricky Gets Stage Fright” (ILL S6;E4), and again in “Don Juan Is Shelved” (ILL S4;E22). Lucy Carmichael strummed the uke in “Lucy’s College Reunion” (TLS S2;E11). Fast forward to 1972 and Lucy and Kim Carter play the ukulele in “Lucy Goes Hawaiian: Part 2″ (HL S3;E24).
Liz denies having thrown away George’s prized ukulele. Liz asks George the last time he saw it and he says it was “just the other night at the alumni dinner” - in 1938!  Liz says it’s probably in the attic, and off they go to look for it.

On “I Love Lucy,” Lucy Ricardo visited the attic to find a musical instrument, too - “The Saxophone” (ILL S2;E2). Of course, she finds other memories along the way. This was the series’ only visit to the attic of 623 East 68th Street. 
In the attic, George thinks he sees a prowler - but it is just Liz’s old dress dummy!

Lucy Carter and her kids visits the attic for antiques and get a lesson in family history lesson in “Lucy Takes Over” (HL S2;E23). When first entering the darkened attic, Lucy screams when she runs into the dress dummy, just like George!
The box marked ‘ukulele’ is actually filled with ski boots!  Liz’s labeling system has resorted in confusion about what’s inside each box.

This warped logic foreshadows Lucy Carmichael and Lucy Carter’s crazy filing system on “The Lucy Show” and “Here’s Lucy.”  It never failed to confound Mr. Mooney / Harry (Gale Gordon). 
Liz finds her corsage collection - dried flowers of corsages given to her by high school boys. George finds his old electric train. Liz wants to throw out the trains, while George wants to toss the corsages.

"Lucy Goes To Sun Valley” (LDCH S1;E5) opens with Lucy searching the living room closet for Ricky’s guitar strings. While doing so, she runs across  a pressed corsage of violets that Ricky gave to her during their courtship.
Hours later, Liz and George still haven’t thrown away anything and still haven’t found the ukulele. They agree to try again after lunch - but the attic door is locked. George calls for Katie - but she’s gone downtown to take George’s Glee Club sweater to the cleaners and is then off for the afternoon.  
From the attic window, Liz yells to neighbor Mr. Wood (Hans Conried) but he is working on his motorcycle and can’t hear them. Jimmy the Paper Boy (also Conried) thinks they want their newspaper tossed through the attic window.  It hits George square in the face.
George decides to ram the door with his shoulder like they do in the movies, but to no avail. 
GEORGE: “They must use fake doors in pictures.” LIZ: “Maybe they use real men!”
George has landed on his ukulele, which emerges unharmed. He strums and sings a few more bars of “Yes Sir, That’s My Baby” - much to Liz’s chagrin.

More time passes and they are still locked in the attic. Liz notices the calendar on the attic wall says March. 
LIZ: “I wonder if it’s been a tough winter?”  
Liz starts to cry, but George wants her to laugh it off and think of it as an exciting adventure. Hunger starts to set in. Liz finds a piece of their ten year-old wedding cake. Petrified!. She spies a piece of cheese in a mousetrap!

It is here the episode starts to foreshadow “Lucy in the Swiss Alps” (ILL S5;E21) in which the Ricardos and Mertz’s are trapped in an Alpine cabin due to an avalanche, where hunger is also an issue.  
Panic sets in - Liz is stir crazy and wants George to jump out of the window to get help. George gets the idea to make a rope ladder out of old drapes and lower Liz to the ground.

The idea of escaping a high confinement by knotting sheets (or blankets or curtains) together to form a rope ladder is a familiar trope. It was later used in “The Star Upstairs” (ILL S4;E25) when Lucy Ricardo finds herself trapped in Cornel Wilde’s upstairs suite and chooses this method of escape. 
LIZ: “Just a moment.  Who’s lowering whom?” GEORGE: “I’m lowering you’m!” LIZ: “Over my’m dead body you’m are!”

This exchange is very similar to “Vacation from Marriage” (ILL S2;E6) which finds Lucy and Ethel trapped on the roof when the door locks behind them. Lucy gets the idea to put a plank across the alleyway (five flights up) to the neighboring building, but naturally she wants Ethel to go first!  Ethel is reluctant to be the one to go first!
Practically speaking, Liz is not strong enough to hold George’s weight, so she has to be the one to be lowered. As Liz climbs onto the window ledge, Mr. Wood sees her and thinks she’s going to kill herself!  He rushes into the attic to save her.
MR. WOOD: “You have so much to live for. You’re young! You’re beautiful! You’re vibrant! Think of your husband!  Think of the children!” LIZ: “I don’t have any children.” MR. WOOD: “Well I have eleven children, you can have a couple of mine.”
Liz explains that she wasn’t suicidal but that they were locked in the attic. She demonstrates by shutting the door - accidentally locking them in again!  Katie arrive just in time and admits that she’s been home the whole time - asleep on her good ear!  Just as they are about to leave - the wind slams the door shut. Katie calmly announces that the firemen will let them out when they arrive after the explosion. 
LIZ: “What explosion?” KATIE: “I left the pressure cooker on the stove!”

Synopsis
To impress a local women's club, Lucy hires a maid.  But to afford a maid, she must take a job – as a maid!  When her new employer hosts a dinner party she recruits Viv to help out – only to have to serve dinner to the very women she is hoping to impress. A quick-change parade of international costumes is contrived to remain incognito.

Kathleen Freeman (Miss Putnam) previously played the character of Kathleen, but is making the third of her appearances playing various other characters on the series.  Freeman was ‘born in a trunk’ to a family of vaudevillians. She made her stage debut at age two in her parents’ act. Equally at home on screen and stage, Freeman was appearing on Broadway in The Full Monty in 2001 when she died of lung cancer.
Freeman gets entrance and exit applause from the studio audience!

Norma Varden (Mrs. Van Vlack) last appeared with Lucille Ball and Vivian Vance in “The Ricardos Change Apartments” (ILL S2;E26) as Mrs. Benson, the weepy woman in apartment 3B who swapped apartments with Lucy and Ricky after her daughter got married and moved out. She is probably best known for playing Frau Schmidt, the somewhat circumspect housekeeper at the Von Trapp mansion in 1965′s The Sound Of Music. She first met Lucille Ball when she played Lady Maude in Fancy Pants in 1950.
Van Vlack is the surname of one of Lucille Ball's childhood friends, Marion Strong Van Vlack, who was also a character on several episodes of “I Love Lucy.”

The Danfield Art Society members are played by:
Jean Vachon making the fifth of her six appearances on “The Lucy Show,” all but this one uncredited.
Paula Ray making the first of her three appearances on the series. This is the only one where she gets screen credit.
Caryl Lincoln was one of Lucy’s friends from her Goldwyn Girl days. This is the fourth of her seven appearances on the series, often appearing with her husband, fellow extra Bert Stevens.  This is the only episode where she receives screen credit.
Luree Wiese makes her only appearance on “The Lucy Show” but will make a single appearance on “Here's Lucy” in 1970.

As a movie star and mother, Lucille Ball had a maid named Harriet McCain. She was employed by Lucy from the late 1940's until the 1980s. Because Harriet was a woman of color, Ball insisted that the elevators in her townhouse be integrated, a first for her neighborhood. When McCain was hospitalized before her death, Ball paid all her medical expenses.
Lucy says that the Danfield Art Society is the most prestigious club in town. This is the group’s first mention on the series.

Viv says she doesn't want to work that hard to become a member of an organization that is comprised solely of woman.  Now the YMCA, on the other hand....  Danfield's new YMCA was often mentioned during the first season, with scenes set there during “Lucy Digs Up a Date” (S1;E2).  
Lucy figures it costs $3.00 for popcorn and candy at the movies.  Today, popcorn and candy can cost as much or more than the movie ticket itself.

A maid will cost Lucy $40 a week. In today's money that would be a salary of $365.
Lucy mistakes the Social Register with Social Security.  The United States Social Security act was signed into law by President Franklin Roosevelt in 1935. In 1961, the early retirement age was lowered to 62 from 67 for reduced benefits.

Mrs. Van Vlack decides to call Lucy 'Hilda,' after her former maid. Coincidentally, Verna Felton (who played Mrs. Porter, Lucy Ricardo's short-lived maid) played a character named Hilda on the radio show “December Bride” (1952) and its TV sequel “Pete and Gladys” (1960). On those shows, Hilda was the best friend to the main character – much like Ethel Mertz and Vivian Bagley.

Hoping to impress the new maid, Lucy replaces all their Mickey Spillane detective paperbacks with encyclopedias.  Mickey Spillane (1918-2006) was an American crime novelist, whose stories often feature his signature detective character, Mike Hammer. More than 225 million copies of his books have sold internationally. In 1964 alone Spillane released four novels.
Miss Putnam asks Lucy whether there's a color TV in the kitchen. Viv says yes, “If we drag it in from the living room.”  Lucy replies that it is a “light beige walnut.” CBS was still airing “The Lucy Show” in black and white, despite it being filmed in color.  
Miss Putnam gets a telephone call from Gladys Wentworth who gives her a stock market tip.    
So they won't be recognized by the members of the Danfield Art Society, Lucy and Viv don a series of disguises to serve their 'international' dinner:

Russian Borscht (actually Viv’s consommé with ketchup) - Lucy wears a napkin as a babushka and puts on a shawl.  She hums “The Song of the Volga Boatmen,” a traditional Russian folk song as she ladles out the soup.

French Bread – Lucy makes a beret from a black pillow and ties a red checkered table cloth around her waist.  She sings “Frere Jacques” as she distributes the baguettes.

Italian Antipasto – Viv makes an Italian chef's outfit from uniforms found in the kitchen closet, making a mustache from the fringe on a throw pillow. She sings “O Solo Mio” while presenting the platter.  The Neapolitan song was written by Giovanni Capurro and Eduardo di Capua in 1898.

Spanish Wine – Lucy puts a lace curtain on her head and wraps herself in a lace tablecloth. Holding a bunch of parsley in front of her face, she sings “In a Little Spanish Town,” a song by Mabel Wayne, Sam M. Lewis, and Joe Young written in 1926.

Turkish Shish-Ka-Bob – Viv wraps a pink and red silk scarf around her head and cinches a print table throw around her waist.  She hums "The Streets of Cairo, or the Poor Little Country Maid" (also known as “The Snake Charmer Song”) written by James Thornton in the late 19th century.  Vivian Vance gyrates her hips with her back to the camera, earning a few surprised gasps and laughs from the studio audience.

Baked Alaska – Lucy puts a dust mop on her head and wears a powder blue fur jacket while Viv throws potato flakes in the air from the kitchen door.  She sings “Jingle Bells” - a song Ricky Ricardo called “Yingle Bells” on “The Lucy-Desi Comedy Hour.”  Ball and Vance sang the song on the long-lost Christmas episode of “I Love Lucy.”

Colombian Coffee – Viv takes the same pink and red scarves and wraps them around her waist while putting a floral arrangement on her head like Carmen Miranda. She chants “Cha-cha-cha” as she serves the coffee.

In “Lucy Hires a Maid” (ILL S2;E23) Lucy Ricardo hired Mrs. Porter, a maid who intimidates her and behaves more like the employer than the employee. Both maids dislike children, are overly concerned about their own meals, and demand to be addressed by their last names. As in 1953, Lucy ends up waiting on the maid, not the other way around.

In “Pioneer Women” (ILL S1;E23) Lucy Ricardo and Ethel Mertz go out of their way to please The Society Matrons League headed by Mrs. Pomerantz (Florence Bates, left) and Mrs. Pettibone (Ruth Perrot, right), a very close model for the Danfield Art Society, but much snootier. It was based on a similar organization on Lucille Ball’s radio show “My Favorite Husband.”

Gangland Lawyering? Featuring Pierce Bainbridge & Hecht Partners
Rudy Giuliani tied himself to Pierce Bainbridge Beck Price & Hecht LLP with a tweet announcing the firm would represent him for the Ukraine fiasco. The man formerly known as “America’s Mayor” made his chops taking on “The Five Families,” a New York City Organized Crime syndicate. The revelations coming out of Pierce Bainbridge have many opining that Pierce Bainbridge operations are more akin to a criminal enterprise than a reputable law firm. A bombshell accusation from an ex-firm associate has increased the already searing spotlight on the firm, as well as its current and former partners.  The accusations – which sound like something that could be found in Rudy’s bag of tricks – include alleged fraud on a federal court and related intimidation tactics.
 “Intimidation” & “Fraud on the Court” Accusations
A new outside lawyer for Pierce Bainbridge, Ed Altabet of Cohen Seglias, has been accused of attempting to “intimidate” the ex-associate from coming forward with accusations that ex-Pierce Bainbridge named-partner David L. Hecht (Hecht Partners) intentionally defrauded a federal court.  The issue arose in connection with a putative class action against Boeing and Southwest Airlines.  The story is covered by LawFuel.com here.
Hecht has been so loyal to Pierce, his ex-partner Christopher N. LaVigne (Withers Bergman) said “David would toss dogs off of cliffs,” if Pierce said it was a good strategy.  To be fair, LaVigne clearly has a low opinion of Hecht, LaVigne has also opined in writing:  “David is an embarrassment to lawyers everywhere.  Some of the worst lawyers I know are better than David.”  Similarly, Mike Masnick of Techdirt.com, referred to a complaint Hecht filed on behalf of Tulsi Gabbard as “laughable” and said Hecht should be “embarrassed.”
Notwithstanding these views, Hecht recently started his “own firm,” Hecht Partners LLP.  Oddly, seven (7) of the eight (8) lawyers are from Pierce Bainbridge, certain administrative personnel from Pierce Bainbridge have reportedly joined, and Hecht puzzlingly said in open court that while he is no longer a partner at Pierce Bainbridge, he still works with the firm.
This, as well as related events such as the Boeing Southwest fiasco, the reported $65,000,000 Pierce Bainbridge debt to litigation funder Virage Capital Management, and the at least six lawsuits currently facing Hecht’s former firm, has led to suggestions that the two firms, and perhaps a third-party, are involved in Gangland-like shell-game shenanigans.
The Bombshell Filing does nothing to help the image of the newly established Hecht Partners.  It has Gangland tactics written all over it.  The former associate took direct aim at Altabet and Hecht.
Altabet replaced long-time Giuliani ally, and a lawyer intricately connected to Donald Trump, Mark Mukasey. Even for Mukasey, the Pierce Bainbridge environment appears to have been unacceptable; he withdrew citing ethics concerns.  In came Altabet, and the unethical conduct did not skip a beat.
In a filing in the United States District Court for the Eastern District of Texas in front of the Honorable Judge Amos L. Mazzant, the ex-associate said:
“After reviewing the transcript from the May 13th hearing in this matter, I have confirmed what I believe are numerous statements of material fact by David Hecht which are inaccurate, and may have been made to intentionally mislead counsel and the Court.”
“[I]n light of an email I received from Pierce Bainbridge’s outside counsel, Ed Altabet, today, in which he made several baseless accusations against me in what appeared to be an effort to intimidate me and hamper my efforts to correct the record, I request an In-Camera ex parte hearing before the Court.”
The John Pierce, Keyboard-Fueled Gangland Tactics
Pierce’s bombast proclamations of global domination, and overwhelming lack of candor, have rendered the Harvard Law School graduate a laughingstock in many legal circles.
Pierce is still, however, commonly seen as the straw stirring Hecht’s actions, as well as the driving force behind the intimidation tactics.  Pierce, who claims to have been a tank platoon leader in the United States Army, takes his faux machismo passionately; for example, a report by Meghan Tribe in Law.Com, quotes Pierce:
“We are building an army of killers on a highly collaborative platform. In addition, we have a culture obsessed with winning and bringing maximum value to clients.” – John Pierce, January 3, 2019
Pierce subsequently attacked Tribe on LinkedIn in a falsehood-ridden post with his disciples lending support.  Former Pierce Bainbridge partners Michael Pomerantz, Thomas Warren (Warren Terzian), Johanthan Kortmansky (BraunHagey & Borden) and, you guessed it, David Hecht endorsed Pierce’s nonsense.
Indeed, the Pierce modus operandi seems to be to threaten by e-mail.
For example, Pierce threatened a former client by email, the client reported Pierce to the California State Bar and included an opinion that Pierce is a “menace to the legal society.”
Pierce threatened a lending company named Newtek by email in September 2018; in early October 2018, Newtek denied Pierce’s request for a $ 1 million SBA loan secured by a client’s $ 6 million home;  the denial was related to Pierce’s obligations to the Internal Revenue Service (IRS) as well as California state tax authorities.  (Public records show Pierce has around $1.5 million in tax liens, e-mails show he owes $21,000 month alimony, and Pierce claims to be the sole guarantor of a $65,000,000 Pierce Bainbridge debt to Virage Capital Management.)
To complete the trifecta, Pierce also threatened former partner and whistle blowing Don Lewis by email.  Lewis’s ex-partners, all who have been sued by him, were on the email. Lewis says, “despite their fiduciary duties of care, they all did nothing.”  (Denver G. Edwards pictured, joined after Lewis, but has been accused, along with Christopher N. LaVigne (Withers Bergman) of “lying under oath” to smear Lewis.)
The group are experienced attorneys who now practice at Armstrong Teasedale, Braunhagey & Borden, Withers Bergman, Hecht Partners, among other firms.  Their prior experience is at reputable law firms such as BakerHostetler, Baker & McKenzie, Browne George & Ross, Brown Rudnick, Covington & Burling, Davis Polk, Fish & Richardson, Gibson Dunn, Glaser Weil, Grais & Ellsworth, Grant & Eisenhofer, Kasowitz Benson, Kirkland & Ellis, Kaye Scholer, Kobre Kim, Margolis & Tinsman, McKool Smith, Murphy & King, Murchison & Cumming, Reid Collins & Tsai, Steptoe & Johnson, Sullivan & Worcester, Quinn Emanuel; White & Case, Wachtell Missry, Wilson Sonsini, and White & Case.
Next Stop Jail?
Many have speculated if Pierce may eventually wind up behind bars, consistent with a warning he received from Oscar De La Hoya’s long-time lawyer in the Fall of 2018.
Lots of Questions:  What Was Virage Told? 
As for the Virage $65 million, what convinced the litigation funder to risk such a large investment in Pierce Bainbridge remains a mystery. Pierce appears to be running a decent con, perhaps even Giuliani with all his Gangland experience was impressed.
The question persists:  What was Virage told?  What representations were made? Who made them? How could Virage get in so deep behind:
a $9.1 million declared default against the firm.
issues with paying creditors.
no track record of meaningful litigation success.
a “leader” – John Pierce – with “brutal credit”.
a “leader” – John Pierce – with issues with “substance abuse and other addictive behaviors.”
The Mysterious Richard Silverstein of Loan Annex
An individual who may have some answers, but to date has largely stayed out of the fray, is Richard Silverstein the Founder of Loan Annex.
Silverstein is pictured above with promotional material from his LinkedIn page.  The Loan Annex founder filed a sworn affidavit in federal bankruptcy court at the end of last year stating:  “Throughout 2019, I was engaged by Pierce Bainbridge as their consultant for the purpose of arranging financing for the firm.” 2019 is when both tranches of the $65 million Virage deal were struck.
Interestingly, Silverstein’s affidavit was filed to support the claims of a lender named Counsel Financial; Pierce Bainbridge was allegedly in discussions with Counsel Financial about financing in March 2019.  In line with the Gangland theme, the underlying debtor claimed in an affidavit:  “A colleague of mine derided these tactics as ‘Mafia-style’ intimidation, but even the Mafia had a code about attacking family members.”  The tactics had to do with alleged e-mail threats from a lawyer for Counsel Financial.
More Questions:  What’s Going on with Talon LF, LLC
Recently leaked solicitation materials for potential investors in a litigation fund intricately intertwined with Pierce Bainbridge may also shed light; the name of the fund is Talon LF, LLC.
Two ex-Pierce Bainbridge partners, Doug Curran (BraunHagey & Borden) and Thomas D. Warren (Warren Terzian), as well as Pierce are listed as closely affiliated.
The Talon investor solicitation materials appear to have several issues, but there are two glaringly puzzling representations.
“Vertically integrated with PB w/ a success rate on contingency cases of 97%”. (From cover e-mail accompanying the materials)
A chart which represents a positive investment rate of return (“IRR”) for litigation funder Pravati Capital, which apparently failing to indicate that Pravati declared a $9,157,072.95 default.
Are these representations true?  Are they materially misleading? Are they fraudulent?
Issues surrounding the clearing of the Pravati default raise more Gangland type flags.  A former firm client, Gustavo Escamilla, President of Greenway Nutrients, says he “has strong reason to believe that Mr. Piece and his firm Pierce Bainbridge accepted bribes ”from individuals with “criminal backgrounds” and  “used this bribe money to pay down some, or all, of an over $9.1 million [Pravati] default.”
Escamilla has also developed a compelling timeline, which suggest his claims may be valid.
The General Counsel & Blind Eye:  Carolynn K. Beck
On the issue of Pravati, ex-firm General Counsel, Carolynn K. Beck, now a partner at Goldstein & McClintock, was intricately connected to Pravati.  She is alleged to have misrepresented, with Pierce, a case value to Pravati by well over $900,000,000.00, and documents appear to support the same.  In addition, a Philly lawyer has sued Beck individually, the other named partners and Pierce Bainbridge claiming the case value presented to Pravati was wildly overinflated. The Philly lawyer worked the same case for 16 months before Pierce Bainbridge took over.
Beck joined her new firm with Craig Bolton; the duo reportedly worked very closely together at Pierce Bainbridge. Bolton was apparently involved in litigation funding efforts, including the alleged discussions with Counsel Financial in March.
A cavalcade of severe misconduct happened under Beck’s watch:  lies under oath, violations of ethical rules, deletion of evidence, misogyny from the top, potential double-pledging of firm collateral, Pierce siphoning funds from firm accounts, the list goes on.
Beck as General Counsel for the firm, appears, at best, to have done nothing to stop it.  A type of Gangland consigliere who seems to have made an internal oath to never get in the way.
As an example, written communications indicate Beck was aware of Pierce using firm accounts as a personal piggy bank back in October 2018.  A text that Lewis received from the firm’s bookkeeper, just days before being banished, strongly suggests the Goldstein & McClintock partner was in the know.
Subsequent to this October 2018 message, the Firm, under Beck’s watch, would go on to rack up a $65 million debt from April 2019 – April 2020, find itself a defendant in three cash advance lawsuits (where upfront cash was provided in exchange for alleged firm receivables) and see a mass exodus of attorneys starting in October 2019.  Beck’s apparent willful turn of a blind eye is not consistent with the role of a General Counsel.
Camille Varlack, Kevin Cash & The Future
Beck left the firm around a month ago; a Law360 article said Chief Operating Officer and Deputy General Counsel Camille Varlack and Chief Financial Officer Kevin Cash were running Pierce Bainbridge while Pierce was on a forced leave of absence. Both Varlack and Cash are not part of the original Pierce Bainbridge inner circle; but their role in leadership positions, with apparent visibility into the firm’s finances is noteworthy.
With a firm boasting so many red flags, the possibility of a wide-ranging Pierce Bainbridge bloodbath seems more likely by the day. Cash and Varlack may be subjected to some hard questions about what they knew, when they knew it and what they did about it.
Giuliani, some would say, has learned from the mobsters he used to prosecute and has pulled off Gangland tactics for years, while remaining relatively unscathed.  It remains to be seen if this brat pack of attorneys Rudy hired have what it takes to keep ahead of the tsunami of severe issues that are closing in on them.

Gangland Lawyering? Featuring Pierce Bainbridge & Hecht Partners
Rudy Giuliani tied himself to Pierce Bainbridge Beck Price & Hecht LLP with a tweet announcing the firm would represent him for the Ukraine fiasco. The man formerly known as “America’s Mayor” made his chops taking on “The Five Families,” a New York City Organized Crime syndicate. The revelations coming out of Pierce Bainbridge have many opining that Pierce Bainbridge operations are more akin to a criminal enterprise than a reputable law firm. A bombshell accusation from an ex-firm associate has increased the already searing spotlight on the firm, as well as its current and former partners.  The accusations – which sound like something that could be found in Rudy’s bag of tricks – include alleged fraud on a federal court and related intimidation tactics.
 “Intimidation” & “Fraud on the Court” Accusations
A new outside lawyer for Pierce Bainbridge, Ed Altabet of Cohen Seglias, has been accused of attempting to “intimidate” the ex-associate from coming forward with accusations that ex-Pierce Bainbridge named-partner David L. Hecht (Hecht Partners) intentionally defrauded a federal court.  The issue arose in connection with a putative class action against Boeing and Southwest Airlines.  The story is covered by LawFuel.com here.
Hecht has been so loyal to Pierce, his ex-partner Christopher N. LaVigne (Withers Bergman) said “David would toss dogs off of cliffs,” if Pierce said it was a good strategy.  To be fair, LaVigne clearly has a low opinion of Hecht, LaVigne has also opined in writing:  “David is an embarrassment to lawyers everywhere.  Some of the worst lawyers I know are better than David.”  Similarly, Mike Masnick of Techdirt.com, referred to a complaint Hecht filed on behalf of Tulsi Gabbard as “laughable” and said Hecht should be “embarrassed.”
Notwithstanding these views, Hecht recently started his “own firm,” Hecht Partners LLP.  Oddly, seven (7) of the eight (8) lawyers are from Pierce Bainbridge, certain administrative personnel from Pierce Bainbridge have reportedly joined, and Hecht puzzlingly said in open court that while he is no longer a partner at Pierce Bainbridge, he still works with the firm.
This, as well as related events such as the Boeing Southwest fiasco, the reported $65,000,000 Pierce Bainbridge debt to litigation funder Virage Capital Management, and the at least six lawsuits currently facing Hecht’s former firm, has led to suggestions that the two firms, and perhaps a third-party, are involved in Gangland-like shell-game shenanigans.
The Bombshell Filing does nothing to help the image of the newly established Hecht Partners.  It has Gangland tactics written all over it.  The former associate took direct aim at Altabet and Hecht.
Altabet replaced long-time Giuliani ally, and a lawyer intricately connected to Donald Trump, Mark Mukasey. Even for Mukasey, the Pierce Bainbridge environment appears to have been unacceptable; he withdrew citing ethics concerns.  In came Altabet, and the unethical conduct did not skip a beat.
In a filing in the United States District Court for the Eastern District of Texas in front of the Honorable Judge Amos L. Mazzant, the ex-associate said:
“After reviewing the transcript from the May 13th hearing in this matter, I have confirmed what I believe are numerous statements of material fact by David Hecht which are inaccurate, and may have been made to intentionally mislead counsel and the Court.”
“[I]n light of an email I received from Pierce Bainbridge’s outside counsel, Ed Altabet, today, in which he made several baseless accusations against me in what appeared to be an effort to intimidate me and hamper my efforts to correct the record, I request an In-Camera ex parte hearing before the Court.”
The John Pierce, Keyboard-Fueled Gangland Tactics
Pierce’s bombast proclamations of global domination, and overwhelming lack of candor, have rendered the Harvard Law School graduate a laughingstock in many legal circles.
Pierce is still, however, commonly seen as the straw stirring Hecht’s actions, as well as the driving force behind the intimidation tactics.  Pierce, who claims to have been a tank platoon leader in the United States Army, takes his faux machismo passionately; for example, a report by Meghan Tribe in Law.Com, quotes Pierce:
“We are building an army of killers on a highly collaborative platform. In addition, we have a culture obsessed with winning and bringing maximum value to clients.” – John Pierce, January 3, 2019
Pierce subsequently attacked Tribe on LinkedIn in a falsehood-ridden post with his disciples lending support.  Former Pierce Bainbridge partners Michael Pomerantz, Thomas Warren (Warren Terzian), Johanthan Kortmansky (BraunHagey & Borden) and, you guessed it, David Hecht endorsed Pierce’s nonsense.
Indeed, the Pierce modus operandi seems to be to threaten by e-mail.
For example, Pierce threatened a former client by email, the client reported Pierce to the California State Bar and included an opinion that Pierce is a “menace to the legal society.”
Pierce threatened a lending company named Newtek by email in September 2018; in early October 2018, Newtek denied Pierce’s request for a $ 1 million SBA loan secured by a client’s $ 6 million home;  the denial was related to Pierce’s obligations to the Internal Revenue Service (IRS) as well as California state tax authorities.  (Public records show Pierce has around $1.5 million in tax liens, e-mails show he owes $21,000 month alimony, and Pierce claims to be the sole guarantor of a $65,000,000 Pierce Bainbridge debt to Virage Capital Management.)
To complete the trifecta, Pierce also threatened former partner and whistle blowing Don Lewis by email.  Lewis’s ex-partners, all who have been sued by him, were on the email. Lewis says, “despite their fiduciary duties of care, they all did nothing.”  (Denver G. Edwards pictured, joined after Lewis, but has been accused, along with Christopher N. LaVigne (Withers Bergman) of “lying under oath” to smear Lewis.)
The group are experienced attorneys who now practice at Armstrong Teasedale, Braunhagey & Borden, Withers Bergman, Hecht Partners, among other firms.  Their prior experience is at reputable law firms such as BakerHostetler, Baker & McKenzie, Browne George & Ross, Brown Rudnick, Covington & Burling, Davis Polk, Fish & Richardson, Gibson Dunn, Glaser Weil, Grais & Ellsworth, Grant & Eisenhofer, Kasowitz Benson, Kirkland & Ellis, Kaye Scholer, Kobre Kim, Margolis & Tinsman, McKool Smith, Murphy & King, Murchison & Cumming, Reid Collins & Tsai, Steptoe & Johnson, Sullivan & Worcester, Quinn Emanuel; White & Case, Wachtell Missry, Wilson Sonsini, and White & Case.
Next Stop Jail?
Many have speculated if Pierce may eventually wind up behind bars, consistent with a warning he received from Oscar De La Hoya’s long-time lawyer in the Fall of 2018.
Lots of Questions:  What Was Virage Told? 
As for the Virage $65 million, what convinced the litigation funder to risk such a large investment in Pierce Bainbridge remains a mystery. Pierce appears to be running a decent con, perhaps even Giuliani with all his Gangland experience was impressed.
The question persists:  What was Virage told?  What representations were made? Who made them? How could Virage get in so deep behind:
a $9.1 million declared default against the firm.
issues with paying creditors.
no track record of meaningful litigation success.
a “leader” – John Pierce – with “brutal credit”.
a “leader” – John Pierce – with issues with “substance abuse and other addictive behaviors.”
The Mysterious Richard Silverstein of Loan Annex
An individual who may have some answers, but to date has largely stayed out of the fray, is Richard Silverstein the Founder of Loan Annex.
Silverstein is pictured above with promotional material from his LinkedIn page.  The Loan Annex founder filed a sworn affidavit in federal bankruptcy court at the end of last year stating:  “Throughout 2019, I was engaged by Pierce Bainbridge as their consultant for the purpose of arranging financing for the firm.” 2019 is when both tranches of the $65 million Virage deal were struck.
Interestingly, Silverstein’s affidavit was filed to support the claims of a lender named Counsel Financial; Pierce Bainbridge was allegedly in discussions with Counsel Financial about financing in March 2019.  In line with the Gangland theme, the underlying debtor claimed in an affidavit:  “A colleague of mine derided these tactics as ‘Mafia-style’ intimidation, but even the Mafia had a code about attacking family members.”  The tactics had to do with alleged e-mail threats from a lawyer for Counsel Financial.
More Questions:  What’s Going on with Talon LF, LLC
Recently leaked solicitation materials for potential investors in a litigation fund intricately intertwined with Pierce Bainbridge may also shed light; the name of the fund is Talon LF, LLC.
Two ex-Pierce Bainbridge partners, Doug Curran (BraunHagey & Borden) and Thomas D. Warren (Warren Terzian), as well as Pierce are listed as closely affiliated.
The Talon investor solicitation materials appear to have several issues, but there are two glaringly puzzling representations.
“Vertically integrated with PB w/ a success rate on contingency cases of 97%”. (From cover e-mail accompanying the materials)
A chart which represents a positive investment rate of return (“IRR”) for litigation funder Pravati Capital, which apparently failing to indicate that Pravati declared a $9,157,072.95 default.
Are these representations true?  Are they materially misleading? Are they fraudulent?
Issues surrounding the clearing of the Pravati default raise more Gangland type flags.  A former firm client, Gustavo Escamilla, President of Greenway Nutrients, says he “has strong reason to believe that Mr. Piece and his firm Pierce Bainbridge accepted bribes ”from individuals with “criminal backgrounds” and  “used this bribe money to pay down some, or all, of an over $9.1 million [Pravati] default.”
Escamilla has also developed a compelling timeline, which suggest his claims may be valid.
The General Counsel & Blind Eye:  Carolynn K. Beck
On the issue of Pravati, ex-firm General Counsel, Carolynn K. Beck, now a partner at Goldstein & McClintock, was intricately connected to Pravati.  She is alleged to have misrepresented, with Pierce, a case value to Pravati by well over $900,000,000.00, and documents appear to support the same.  In addition, a Philly lawyer has sued Beck individually, the other named partners and Pierce Bainbridge claiming the case value presented to Pravati was wildly overinflated. The Philly lawyer worked the same case for 16 months before Pierce Bainbridge took over.
Beck joined her new firm with Craig Bolton; the duo reportedly worked very closely together at Pierce Bainbridge. Bolton was apparently involved in litigation funding efforts, including the alleged discussions with Counsel Financial in March.

Littler Mendelson Accused of Playing Dirty
Mega-Firm Littler Mendelson Accused of “Malicious Deception” in Defending Pierce Bainbridge (Rudy Giuliani’s Chosen Law Firm for the Ukraine fiasco)
Littler Mendelson P.C. describes itself as having the “largest global employment and labor law practice . . .with more than 1,500 attorneys in 80 offices.”  The firm is a defendant in a Grisham Thriller-like legal dispute involving claims of ex-partner Don Lewis against Pierce Bainbridge Beck Price & Hecht LLP, and its legal representatives Littler (S. Jeanine Conley) and Putney Twombly (Michael D. Yim).  The gist of Lewis’s claims is that he blew the whistle on financial misconduct, and the firm, its founder John Mark Pierce, along with a slew of partners, as well as  Putney, weaponized #MeToo in an effort to silence Lewis and obliterate his credibility as part of a cover-up. Then Littler, hired by Pierce Bainbridge to deal with Lewis, piled on with deceitful litigation tactics.
Recent lawsuits from other parties are now validating Lewis’s long-standing claims of financial foul play at Pierce Bainbridge and making Littler’s decision to do Pierce Bainbridge’s dirty work against Lewis appear less than wise.

(Pomerantz, formerly of Grais & Ellsworth, and Hecht, formerly of Steptoe & Johnson, are also defendants in a proposed second amended defamation complaint filed by Lewis for “shamefully endorsing a deeply depraved defamatory post of Pierce’s, in which Pierce also lied about litigation finance, and baselessly attacked Bloomberg Big Business Law reporter Meghan Tribe.”)
“Shocking” Behavior
Legal Desire previously published a piece:  “Pierce Bainbridge and Littler Mendelson: Two Law Firms in the Same Deceitful Pod?”  It covers a pattern of unethical litigation conduct by Pierce Bainbridge partners including boasting about violating ethical rules, sanctions and two firm partners, Denver G. Edwards and Christopher N. LaVigne, according to Lewis: “lying under oath.”
In addition, Lewis has been informed that Pierce Bainbridge was untruthful in representing to a Court in New York that the firm purportedly “just” found out about an arbitration agreement in December days after the Pierce Bainbridge’s Los Angeles lawsuit against Lewis was dismissed; specifically that ex-firm General Counsel Carolynn Beck (and others) were aware of the arbitration provision months earlier.  Interestingly, Littler’s own counsel from Vorys Sater Seymour and Pease LLP has stated this would constitute “fraud on the court,” and trigger reporting obligations under the ethical Rules of Professional Conduct.  Beck’s alleged misconduct, including accusations of deleting and burying evidence, have been well documented.
The seeming deceitful litigation tactics of Littler and Conley were briefly covered in the earlier mentioned coverage.  Conley’s public work involving organizations such as the Federal Bar Association, the NYC Society For Human Resource Management, and the Metropolitan Black Bar Association was also briefly discussed. In line with that work, an attorney named Brian Esser, praised Conley this week on a pre-recorded Lawline presentation on “diversity, inclusion, and combatting implicit bias.”  Lewis, who was the only  black attorney at the firm when he was placed on leave, has said: “Conley’s conduct, particularly given who she publicly holds herself out to be, was shocking to me.”
While Lewis’s complaint sets forth several examples of what appears to be racial double standards while he was at the firm, one need not take Lewis’s word for it.  According to a Lewis complaint, current partner Patrick Bradford was displeased when Beck required Bradford to provide a “book of business memo” prior to hiring, which was never required of any of the firm’s white – and seemingly less qualified – partners.  Bradford – in writing – remarked:
“The fact that I was being asked to submit a business plan (when my understanding was no other potential partner was) . . . when my objective qualifications exceed some of your partners – – that is if I were White. Folks come up with all sorts of justifications for their. . . shortcomings let’s say.” ~ Patrick Bradford, Summer 2018.
While almost every partner at the time had never been a partner at a law firm, Bradford was a partner for ten years at the world-renowned Davis Polk & Wardwell LLP.
  “Beyond Zealous Advocacy”
Conley, a shareholder at Littler Mendelson, entered the scene in late April 2019, she replaced Pierce Bainbridge partner Denver G. Edwards, also black, as lead negotiator.  Interestingly,  Conley communicated to Lewis’s team that Edwards: “is not an employment attorney and didn’t really understand what he was looking at.”  Lewis says LaVigne similarly remarked “Edwards is incompetent;” and added something in the nature of:  “everyone knows why John picked Denver to handle this.”  The implication is clear.
Lewis believes that Conley crossed several lines for the collapsing Pierce Bainbridge firm.  A Lewis complaint states:  “Conley’s conduct goes well beyond simple zealous advocacy and squarely enters the realm of malicious intent to harm.”
The Stall, The Threat and The Withdrawal Stunt
The Days Leading Up to May 15
May 8.  A one-page letter from Lewis’s counsel to Conley says that he will file his complaint on May 14 if the parties cannot agree on mediation.
May 13.  Conley claims that she – and presumably her 17 litigator clients – “misread” a one-page letter and needs more time to consider Lewis’s offer of mediation with certain conditions.  Lewis obliged.
May 14.  Conley refers to the negotiations as “amicable” and in “good faith.” During this time, unbeknownst to Lewis, two lawsuits – one for filing in New York, the other for Los Angeles – are being prepared by Conley’s clients against Lewis;  affidavits of two Pierce Bainbridge partners – clandestinely filed under seal the next day in New York – are dated this same day, May 14.
May 15 and The Withdrawal Stunt
May 15 – 8:49 am. With her clients in the process of filing the first of their two never-before mentioned lawsuits, Conley engages in threats and scare tactics to try to delay the filing of Lewis’s complaint, and buy more time for her clients to launch the alleged massive smear campaign: “if [Lewis] files, he will be trying to clear his name forever (particularly with any law firm he may want to work for in the future), regardless of the outcome.”
May 15 – 11:40 am.  Lewis files his complaint in New York, as he said he would do.
MAY 15 – THE DAMNING E-MAILS
Conley Requests Lewis’s Complaint be Withdrawn
Lewis’s counsel and Conley had a phone call immediately after the e-mail above was received.  During the call, Conley specifically requested Lewis’s counsel withdraw the complaint.  Lewis’ counsel told Conley he was not sure if he could but said he would try.

To be clear, after requesting Lewis withdraw his complaint, and thanking him for doing so, Conley then asked for a court-stamped copy of the withdrawn complaint, which was provided. Four hours later Conley’s client filed a second complaint – this one in Los Angeles and not under seal – which attached the court-stamped copy provided to Conley, and remarkable dishonestly claimed that Lewis filed and withdrew his complaint as “part of a scheme to extort.”
Lewis was then defamed nationwide as a “terrorist,” and an “extortionist.” Lewis’s counsel emailed Conley the next morning called her out.
Conley failed to answer Lewis’s counsel questions about the LA filing and defamatory extortion allegation.
Was S. Jeanine Conley Played by John Mark Pierce?
A few weeks later, Conley filed a motion to dismiss a Lewis complaint which Lewis says included “baseless ad hominem attacks and either deliberately misstated or failed to comprehend elementary legal concepts.”
Around one month later, in late August 2019, Lewis learned about the clandestinely filed sealed New York action for the first-time.  While one could argue that John Pierce pulled a PT Barnum “sucker born every minute” on the Littler partner, these post-May 15 events, as well as the fact that Conley and Littler have stood by Pierce Bainbridge’s falsehoods for eleven months, undermines any such conclusion.
Conley and Littler, according to Lewis, were key players, along with LaVigne, Edwards and Pierce, in hatching a conspiracy to humiliate and destroy his credibility through a “scorched-earth” defamatory attack.
“Tell me who you walk with, and I’ll tell you who you are”
The apparent willing participation of Conley in the vicious railroading of Lewis is troubling.  Lewis remarked:  “Conley put on a different face to protect John Pierce and collect her billable hours; the same John Pierce who his own personnel have referred to – in writing – as a ‘fu*king lunatic,’ ‘narcissistic sociopath,’ and ‘snake,’ who ‘talks out of every side of his mouth,’ ‘loses track of his lies,’ and who is ‘showing severe signs of alcoholism and drug use’ and ‘probably deep into the sauce [alcohol] and coke [cocaine].”
Conley is also alleged to have joined forces with LaVigne and Edwards, both of whom Lewis unequivocally says, “lied under oath to smear me and to protect Pierce and his illicit financial activity.”  Lewis continued:  “There are bad looks, there are very bad looks, and there is S. Jeanine Conley aligning herself — and her firm — with this merry trio of disreputable attorneys.”
Where Are We Now?
It is now eleven months later, and Conley still stands by Pierce and Pierce Bainbridge.  The firm, which had around 70 attorneys in May 2019, now has about 10.  Ryan Boysen of Law 360 previously reported Pierce Bainbridge is on life support, and per the late “Breaking News” from Law360, the firm appears to be done.
Lewis’s allegations of financial foul play, made well over a year ago, have been validated, for example, Jack Newsham of the New York Law Journal reported Pierce was placed on a forced leave of absence by his own partners for financial improprieties.  Newsham also reported in the New York Law Journal that Marc Mukasey, of Mukasey Frenchman & Sklaroff LLP, has filed to withdraw as counsel for Pierce Bainbridge citing ethical concerns with continued representation.  Yet Conley, soldiers on, as if she, and her clients, did nothing wrong.
Lewis concluded:  “It is no longer a secret that Pierce Bainbridge is the ‘cesspool’ I have said it was for over a year; some suggest it’s a ‘birds of a feather’ environment for Giuliani, as well as the firm’s at least three convicted felon clients.  Be that as it may, I foolishly hoped that Conley would comport like the person she publicly holds herself out to be, I was wrong.”
He continues: “A friend remarked: ‘I can’t believe Jeanine Conley supported that guy Pierce, referenced ‘black-on-black’ crime, and mentioned an inflammatory defense used by United States Supreme Court Justice Clarence Thomas years ago; I have not, and I do not, intend to go there.  That said, the face Conley has worn for Pierce Bainbridge, bears no resemblance to her apparent public one.  There is malodorous phoniness to it all, it’s unfortunate, and ultimately, it’s disappointing.”
The Lewis cases continue, it’s unclear where this will all end up; but it’s safe to say that individuals (and entities), like Conley, and even Lewis for a time, who have aligned themselves with Pierce and Pierce Bainbridge, have almost to a person, ended up worse off.  For Pierce himself, and potentially certain of his partners, it remains to be seen whether any of them — like a seasoned New York City attorney for Oscar De La Hoya warned John Mark Pierce over a year ago — “ends up in jail.”

Pierce Bainbridge and Littler Mendelson: Two Law Firms in the Same Deceitful Pod?
Christopher N. LaVigne (Pierce Bainbridge), S. Jeanine Conley (Littler Mendelson) and Denver G. Edwards (Pierce Bainbridge) have been accused of dishonesty and deceit in the lawsuits filed by Don Lewis, an ex-partner at Pierce Bainbridge Beck Price & Hecht LLP.  Littler served as outside counsel for the firm, until compelled to withdraw when Conley and the firm became defendants themselves.  Lewis claims he blew the whistle on illicit financial activity, and, in response, Pierce Bainbridge, a slew of its partners, along with the firm of Putney Twombly Hall & Hirson LLP (Michael D. Yim) weaponized the #MeToo movement to demonize and discredit him. According to Lewis, Conley and Littler were hired by Pierce Bainbridge to finish the job against him, and in doing so employed deceitful litigation tactics more typical of their client.
The impact of the lawsuits, and related revelations of a bevy of ugly realities about firm founder John Mark Pierce, certain of  his partners, as well as firm operations, has turned the Pierce Bainbridge carousel into a “not-so-merry” ride; thirty-five attorneys have quit in the last several months. Be that as it may, the firm apparently continues to represent a high-profile clientele: Rudy Giuliani, Michael Avenatti, Lenny Dykstra (two of them convicted felons; the third with potential criminal headaches of his own), Tulsi Gabbard, as well as one of the largest cryptocurrency exchanges in the world Kraken, Inc. d/b/a Payward.
The conduct of Conley is particularly odd, however.  Through events at the Federal Bar Association, the NYC Society For Human Resource Management, and the Metropolitan Black Bar Association, Conley has advocated for the “elimination of bias,” “lawful investigations in the Wake of #MeToo,” and “interrupting racism and inequality within the profession.”  Lewis says:  “S. Jeanine Conley has supported the deeply depraved and misogynistic John Pierce, race-based discrimination led by Pierce and a sham #MeToo investigation conducted by Michael D. Yim of Putney Twombly who flatly stated I was not entitled to ‘due process.’ Conley’s conduct, particularly given who she publicly holds herself out to be, was shocking to me.”
It appears, that Conley “bet on the wrong horse.”
Deceitful Litigation:  “The Norm, not the Exception at Pierce Bainbridge”
Boasting About Violating the Ethical Rules
Lewis provided the quote above, but there seems to be a good deal of history lending support.  It apparently starts right at the top.  As a glaring example, the recently departed long-time Managing Partner of the Pierce Bainbridge New York Office, David L. Hecht, foolishly boasted publicly about violating the ethical Rules of Professional Conduct.  It was not just a garden variety violation; Hecht was found to have violated Rule 8.4, which the federal court noted:  “prohibits conduct involving dishonesty and misrepresentation;” the opinion invoked the words “trickery” and “deceit.” Hecht apparently took pride in the decision, because the court stopped short of disqualifying the firm.  Indicative of the Pierce Bainbridge culture, other so-called leaders “liked” the post:  Firm Managing Partner John Mark Pierce and Los Angeles Managing Partner Amman Khan.
$27,500,000 Malpractice Claim and Accusation of  Intentionally “Bungling” a Client’s Case
Khan’s reaction to Hecht’s post is arguably unsurprising; he is no stranger to controversy concerning his litigation practice.  A Law360 report indicates that while a partner at Glaser Weil, Khan was a defendant in a $27.5 million malpractice suit.  Khan was accused of “intentionally bungling a legal action,” “breaching his fiduciary duties to his client,” and forming a “plan, scheme and conspiracy,” to foul up the litigation.  The case dragged on for almost three years, before an apparent resolution was reached.
New Managing Partner Tom Warren:  Sanctions and Violation of Ethical Rules
Thomas David Warren was chosen to succeed John Mark Pierce as Pierce Bainbridge Managing Partner, and it appears the firm intends to not skip a beat on its unethical litigation conduct. Warren, who has had his own recent ethical issues with courts, is named as a defendant in a proposed amended defamation complaint Lewis filed in October 2019.

Additional new current and former partner defendants in Lewis’s proposed complaint are Brian Slater (formerly of Kramer Levin), ex-partner Conor McDonough (formerly of Paul Weiss) Christopher N. LaVigne (formerly of Success Academy Charter Schools), ex-partner David L. Hecht (Hecht Partners), Gregory Sephton (formerly of Kramer Levin), Jeff Alexander (Wachtell Missry), Jonathan Kortmansky (BraughnHagey & Borden), Michael Pomerantz (formerly of Grais & Ellsworth), Susan Winkler (Winkler Law LLC) and Ted Folkman (Folkman LLC). The nature of the claim is a conspiracy to defame. 
Lewis say four new defendants: “conspired with Pierce in one of the most heinous defamatory lies one could make about a person; it is disgusting; Kortmansky, Warren, Pomerantz and Hecht all endorsed and promoted the most depraved of Pierce’s misconduct, as well as his outright public lies about the firm’s relationship with litigation funder Pravati and litigation funders generally, as well as Pierce’s baseless public attack on Bloomberg Big Business Law reporter Meghan Tribe.” Warren and Hecht are pictured above.  Pomerantz (left) and Kortmansky (right) are pictured below)

In September 2018, while Warren was a partner at BakerHostetler, his client was hit with a motion for sanctions by Dostart Hannink & Coveney LLP.  The sanctions request accused Warren and his client of “scurrilous accusations,” engaging in “totally improper” conduct, and deploying a “motion-by-ambush tactic.”  The court granted monetary sanctions against Warren’s client for over $20,000.
Warren joined Pierce Bainbridge three months later, and it did not take him long to get back to unethical work.  Just months after Hecht’s fiasco, Warren – while representing convicted felon Lenny Dykstra – was found by Los Angeles State court judge to have violated the ethical Rules of Professional Conduct, with the judge noting that such issues are “simply the purview of the State Bar . . .”
Yet Another Sanctions Motion
Incredibly, shortly after Warren took the Iron Throne for House Bainbridge in late February; the ethical problems for the firm seamlessly continued.  On March 5, 2020, in a case where Pierce, Jim Bainbridge, ex-counsel Matt Rand (formerly of McKool Smith) and Michael Eggenberger appear on the signature block, Pierce Bainbridge was on the receiving end of sanctions motion to “avoid further fraud upon the court.”
Fraud on the Court and Destruction of Evidence
The “fraud on the court” motion dovetails well with recent events in the Lewis lawsuits.  As Legal Desire previously reported, Marc Mukasey, of Mukasey, Frenchman & Sklaroff LLP recently filed to withdraw as counsel for Pierce Bainbridge citing ethical concerns with continued representation.  In response, Lewis’ counsel filed an affidavit which states:  “we have strong reason to believe — based on information provided to us by former and current employees and partners of PB — that PB . . . has corrupted these proceedings”; and continues: “we have been led to believe . . .that the PB Defendants have destroyed pertinent and material evidence; have manufactured false ‘evidence’. . . and mislead the Court as to when they were aware of the arbitration provisions that were part of the recent motions before the Court.”
The pairing of Littler and Pierce Bainbridge was perhaps a match of kindred litigation spirits; Littler has a history of sanctions of its own.  Indeed, it is exceedingly rare that a reputable law firm receives monetary sanctions for “frivolous” court filings and “violations of rules”.  Lewis says: “a quick review reveals that Littler has been a culprit at least four times, and at least twice the 9th Circuit Court of Appeals supported such sanctions.”
John’s Pierce’s Three Musketeers of Dishonesty, Deception and Deceit
The apparently troubling issues surrounding Lewis’s ousting from the firm, with Michael D. Yim of Putney Twombly riding shotgun with Pierce Bainbridge, have been well documented.  Conley appears to have been brought in to help finish what Yim failed to accomplish, silencing Lewis or destroying his credibility through lies.  Conley, along with Pierce, Edwards and LaVigne are alleged to have hatched a conspiracy to defame Lewis on a nationwide scale to mute his soon to be filed complaint.
Lewis had provided Pierce Bainbridge a deadline to agree to private mediation.  It appears that in order to buy more time, Conley claimed she misread a one-page letter with the deadline.  Lewis gave her the benefit of the doubt and extended the deadline, but when two days later Pierce Bainbridge still did not agree to the conditions to mediation, Lewis moved forward with the filing of his complaint.
Conley, however, deceived Lewis’s New York counsel by continuing a charade of settlement negotiations in bad faith. Conley – by e-mail – asked Lewis to withdraw his complaint in New York so that the parties could continue negotiations, thanked him – by e-mail – for doing so, yet four hours after it was withdrawn, Pierce Bainbridge filed a complaint in California against Lewis and, most incredibly, alleged that Lewis filed and withdrew his action in New York as “part of a scheme to extort.”
Even worse, three months later, Lewis learned that Pierce Bainbridge and Conley were not only being deceitful to beat Lewis to the court with a sham complaint in California, but on that same day, Pierce Bainbridge was also filing a lawsuit in New York under seal; a filing in which firm partners Denver G. Edwards and Christopher N. LaVigne, according to Lewis, both demonstrably lied in supporting affidavits.
Lewis said:  “The deceit, dishonesty and outright lies over a three-day period – by Christopher N. LaVigne, John M. Pierce, S. Jeanine Conley and Denver Edwards are actually incredible.  Like I said in my complaint, stuff like this does not happen over the course of most lawyers’ careers.”
The White-Collar Partner Exodus
As for the financial misconduct that Pierce Bainbridge sought to cover-up, interestingly, the firm itself has conceded that the financial misconduct alleged by Lewis (which has been validated by recent events): “if true….would amount to criminal activity.” LaVigne, according to Lewis, made a very telling statement months after Lewis was no longer with the firm:
“John hired a bunch of white-collar lawyers; he thinks they’ll help when the Feds come knocking; they will be the first one’s out the door.” ~ Christopher N. LaVigne
Since LaVigne’s purported statement, at least eleven white-collar partners have hit the Pierce Bainbridge escape hatch:

We are reminded of an attorney who warned Pierce in Fall 2018:  “Trying to do what you are doing – build a major NYC firm overnight is hugely risky. . . The last person who tried it in NY was Mark Dreier.  He ended up in jail.”
Brazen Lies and Brazen Deceit
Christopher N. LaVigne
Notwithstanding LaVigne’s blistering written criticism of firm founder John Mark Pierce as a “lunatic,” “bully,” and “snake,” who “loses track of his lies,” “talks out of every side of his mouth,” and is “probably deep into the sauce [alcohol] and coke [cocaine],” LaVigne, according to Lewis, “lied under oath” to protect Pierce.
In court filings, Pierce Bainbridge claimed Lewis – who has played ice hockey socially with LaVigne for over ten years – never played with LaVigne from November (when he was ousted) until April (when LaVigne claims Lewis extorted him during a conversation after a game).   The clear objective was to create a (false) narrative of Lewis going out of his way in order to allegedly “extort,” LaVigne.  Hard evidence supports that Pierce Bainbridge and LaVigne were untruthful in court filings.

In addition, a screenshot from a March 6, 2019 exchange between the two about another game is below.  “OMW” means “on my way.”
Both February 13, 2019 and March 6, 2019, fall between November 2018 and April 2019.
Denver G. Edwards
Denver G. Edwards is on the Board of Trustees at Middlebury College.  He has previously worked as a partner at Bryant Rabbino LLP and Bressler, Amery & Ross LLP.   Edwards claimed in court filings and a sworn affidavit that Lewis blew confidentiality by publicly naming the firm’s litigation funder Pravati Capital LLC.  To the contrary, the relationship was already the subject of media coverage, a press release from Pravati (the firm’s original name was Pierce Sergenian) and, even worse, publicly filed UCC lending documents in Denver Edwards’s own name, disclosed the relationship.  (Below is an image from a March 8, 2019 UCC  filing.)
The Conley “Withdrawal Stunt”
The third musketeer, Conley, is, according to Lewis: “as deceitful as the others.”  The “Withdrawal Stunt” covered earlier, is detailed below.
Lewis Withdraws the Complaint at Conley’s Request, She Thanks Him
May 15, 11:40 a.m. – Lewis filed his complaint in New York.
May 15, 12:12 p.m. – Conley e-mailed Lewis’s counsel to request that he withdraw the complaint stating: “[PB] could get to Lewis’ number if you provide more time.”
May 15, 2:12 p.m. – Lewis’s counsel withdrew the complaint, Conley wrote to thank him and ask for a copy of the withdrawn complaint with the filing-stamp affixed.
May 15, 6:12 p.m. – Pierce Bainbridge filed a complaint in Los Angeles against Lewis which was never mentioned during the Conley-led negotiations.  The complaint included the filed-stamped copy of the withdrawn complaint Conley requested.
Pierce Bainbridge Says Lewis Withdrew as “Scheme to Extort”
Incredibly, Pierce Bainbridge then alleged in LA: “[Lewis] deleted the filing as a tactic, furthering his scheme to extort [PB].” Seeing what had happened, Lewis’s counsel immediately took Conley to task:
Conley avoided these pointed questions,  Pierce Bainbridge then labeled Lewis an “extortionist” and “terrorist,” S. Jeanine Conley failed and, eleven months later, continues to fail to come forward with the truth.
Know When to Hold ‘Em, Know When to Fold ‘Em
For months, Pierce Bainbridge has been on a downward spiral towards full implosion.  Thirty-five lawyers have jumped the sinking ship.  Pierce was finally stripped of his Managing Partner title after his alleged Ponzi-Like financial foul play, which Lewis reported to the partnership well over a year ago.  Now Pierce Bainbridge’s own attorney, Marc Mukasey, citing ethical concerns, has asked to withdraw as outside counsel.  Attorneys who were or are with Pierce Bainbridge have apparently broken the wall of silence, as Lewis recently reported to the court, and reportedly have divulged information concerning Pierce Bainbridge manufacturing and destroying material evidence, and engaging in fraud on the court.
With respect to his former partners, who largely only started leaving when the firm was already in meltdown mode, Lewis says, “they are like rats fleeing a sinking ship; each of them turned a blind eye to issues I pointed out in written communications over a year ago; they did not care; their greed outweighed their integrity.”  Lewis continued:  “It is crystal clear to any reasonable person what has happened here, yet none of my former partners has ever reached out to apologize or attempt to make this right; they remained concerned with themselves only, fueled by selfishness and greed.”
The reports of substance abuse, the lies, the illicit financial dealings, the misogyny, Mukasey filing to withdraw, thirty-five lawyers quitting Team Pierce: none of this, however, has deterred Conley, LaVigne and Edwards.   They remain committed to John Pierce and the firm, like the musicians on the Titanic.   Beloved country western singer Kenny Rogers recently passed, but his lyrics in “The Gambler” are timeless words of wisdom; perhaps it’s time for the “Three Pierce Musketeers” to pay them heed.
