#derek chauvin trial
Text
Former Minneapolis police officer Derek Chauvin has been sentenced to 21 years in a federal prison for violating George Floyd's civil rights. Chauvin, who pleaded guilty in December, will also be required to pay restitution.
During the sentencing, U.S. District Judge Paul Magnuson said that Chauvin "must be held responsible" for his actions, including destroying the lives of the other three officers involved in Floyd's death.
Chauvin's plea deal, which Magnuson accepted in May, called for a sentence of 20 to 25 years. Magnuson shaved seven months off of the 21-year sentence for time already served — last year, Chauvin was convicted in a state court on murder and manslaughter charges related to Floyd's May 2020 death and sentenced to 22 1/2 years. He will serve the state and federal sentences concurrently in a federal prison.
Chauvin, who is White, killed Floyd by pinning the unarmed Black man to the pavement with his knee for 9 1/2 minutes, despite Floyd's fading pleas of "I can't breathe." Floyd's death sparked protests worldwide and forced a national reckoning over police brutality and racism.
Prior to his sentencing Thursday, Chauvin wished Floyd's children "all the best in their lives" and that they have "excellent guidance in becoming good adults," CBS Minnesota reports. He did not offer an apology.
Floyd's brother, Philonise Floyd, asked the judge for a life sentence, adding that he has had nightmares since his brother's death, according to CBS Minnesota.
Prosecutors pushed for the former police officer to serve all 25 years on the grounds that his actions during Floyd's death were cold-blooded and needless. They also argued that he had a history of misusing restraints — Chauvin's plea included an admission that he violated the rights of a then-14-year-old Black boy whom he restrained in an unrelated case in 2017.
The defense instead asked for 20 years, saying Chauvin accepts responsibility for what he did and has already been sentenced to 22 1/2 years in prison by a state court in Floyd's murder. Attorney Eric Nelson wrote that Chauvin's "remorse will be made apparent to this Court."
In pleading guilty to violating Floyd's civil rights, Chauvin admitted for the first time that he kept his knee on Floyd's neck — even after he became unresponsive — resulting in his death. The former officer admitted he willfully deprived Floyd of his right to be free from unreasonable seizure, including unreasonable force by a police officer.
Chauvin is appealing his murder conviction, arguing that jurors were intimidated by the protests that followed and prejudiced by heavy pretrial publicity.

Response to Derek Chauvin’s Federal Motion for New Trial for Killing George Floyd
A recent post discussed recent developments in the state and federal criminal cases against ex-officer Derek Chauvin for the killing of George Floyd, including his recent motion for a new trial in federal court based on the opinion of a pathologist who had never examined Mr. Floyd or his corpse and who had never participated in either of these cases.[1] Now here is preliminary analysis of that…

įloyd's murder led to worldwide protests against police brutality, police racism, and lack of police accountability. Kueng and Thao are scheduled to be tried on state charges of aiding and abetting second-degree murder and second-degree manslaughter on October 24, 2022. Lane pleaded guilty in May 2022 to a state charge for aiding and abetting second-degree manslaughter. The other three officers were also later convicted of violating Floyd's civil rights. In December 2021, Chauvin pled guilty to federal charges of violating Floyd's civil rights by using unreasonable force and ignoring his serious medical distress. All four officers faced federal civil rights charges. On April 20, Chauvin was convicted of unintentional second-degree murder, third-degree murder, and second-degree manslaughter, and sentenced to 22.5 years in prison on June 25. On March 12, 2021, Minneapolis agreed to pay $27 million to settle a wrongful death lawsuit brought by Floyd's family. Two autopsies, and one autopsy review, found Floyd's death to be a homicide. The following day, after videos made by witnesses and security cameras became public, all four officers were fired. Despite this, Chauvin ignored pleas from bystanders to lift his knee from Floyd's neck. For the last few minutes, he lay motionless and Officer Kueng found no pulse when urged to check. After several minutes, Floyd stopped speaking. After being restrained, he became more distressed, still complaining of breathing difficulties, of the knee on his neck, and of fear of imminent death. Prior to being placed on the ground, Floyd had exhibited signs of anxiety, complaining about having claustrophobia, and being unable to breathe. A fourth police officer, Tou Thao, prevented bystanders from intervening. Lane had also pointed a gun at Floyd's head prior to Floyd being put in handcuffs. Alexander Kueng and Thomas Lane, assisted Chauvin in restraining Floyd. Chauvin knelt on Floyd's neck for over nine minutes while Floyd was handcuffed and lying face-down in a street. Floyd had been arrested on suspicion of using a counterfeit $20 bill. city of Minneapolis by Derek Chauvin, a 44-year-old white police officer. On May 25, 2020, George Floyd, a 46-year-old black man, was murdered in the U.S. Civil lawsuit resulting in a $27 million settlementĪiding and abetting second-degree murder, aiding and abetting second-degree manslaughter

We know that there were drugs in the squad car that contained Mr. "We now know for a fact that there were drugs that were in the car. The defense is trying to bring in as much evidence of Floyd's alleged drug use as possible. Investigators had apparently overlooked it. In another surprising moment, Nelson said months after the fatal encounter, his team found methamphetamine and fentanyl in the police squad car that had Floyd's DNA on it. I actually think that the rules of criminal procedure are very clear on the point," Nelson said. RELATED: Timeline In The George Floyd Case

In response, prosecutors asked Judge Cahill to delay the start of the trial until the appeals process was complete. Monday morning, Nelson said that he would appeal the appellate court's decision last week to the supreme court. Tuesday unless a decision from the court of appeals delays it further. In 2019, Noor, also a former Minneapolis police officer, was convicted of third-degree murder for the shooting death of Justine Ruszczyk Damond. Prosecutors appealed that decision, and the appellate court told Cahill that he must make a ruling that is consistent with the precedent set in the case of Mohamed Noor. Last week, the court of appeals told Judge Peter Cahill to reconsider adding the charge against Chauvin, who had initially been charged with it, before Cahill dropped it last fall, citing probable cause. The start of the trial is now in the hands of the Minnesota Court of Appeals and the Minnesota Supreme Court due to an issue about whether the additional charge of third-degree murder can be added against Chauvin.

The officer, Tou Thao, was found guilty of aiding and abetting manslaughter by a Minnesota judge in May.
Mr Thao testified that he acted as a "human traffic cone", holding back bystanders while Derek Chauvin knelt on Mr Floyd's neck for nearly 10 minutes.
Mr Floyd's death on 25 May 2020 sparked mass protests across the US.
All four former police officers involved in the incident were convicted on federal civil rights charges, in addition to state murder charges for Mr Chauvin. Ex-officers Thomas Lane and J Alexander Kueng pleaded guilty to aiding and abetting second-degree manslaughter.
Thao, who was sentenced to three and a half years over his civil rights conviction, will serve the 57 months at the same time.
The former officer had waived his right to a jury trial in the manslaughter case, opting instead for Judge Peter Cahill to determine the verdict. He also waived the right to testify and question witnesses.
In a 177-page ruling in May, Judge Cahill said that Mr Thao's actions - which included shielding Chauvin and the two other officers from the crowd - prevented a trained emergency medic from being able to help Mr Floyd.
"There is proof beyond a reasonable doubt that Thao's actions were objectively unreasonable from the perspective of a reasonable police officer, when viewed under the totality of the circumstances," the judge wrote.
Judge Cahill added that Thao's actions "were even more unreasonable in light of the fact that he was under a duty to intervene to stop other officers' excessive use of force and was trained to render medical aid".

Deleted five things I said about the stabbing of Derek Chauvin, but I will say this: We watched George Floyd murdered in real time and we watched his fellow police officers who could have stopped that extrajudicial killing do nothing. There was witnesses who were screaming at him to stop it, people were literally calling the cops on the cops, these witnesses are forever scarred and traumatized by seeing such a horrific and cruel murder. There was people who were traumatized and have the worst level of post traumatic stress disorder (PTSD) not just the people who saw the video but those who were there where it happened, and not just adults (and this is the one that stuck with me the most) but also children. Children. Little kids scarred for life.
The reason why he’s where he deserves to be is because of a young woman who had a cell phone who didn’t set out to film a disturbing and yet important video, but to go to the store. Those cops who testified at his trial and said that his actions were wrong are not the heroes they are nor claimed to be because if they were really heroes they would have had him fired if he had decided to not resign and they didn’t , they allowed him to get away with it because that’s the American law enforcement system for you.
So if you have fantasies about a safe life under a Trump regime, rethink that.
I’m glad he’s gone and no longer breathing… is what I would have said if he didn’t survive being stabbed multiple times.
oh well prisoner, at least you tried

Memphis police officers accused of murdering 29-year-old Tyre Nichols by beating him to death are justifiably "aggressive," but he cautioned that the prosecution won't be easy.
Speaking with host Michael Smerconish, the former prosecutor said each of the five accused cops, Demetrius Haley, Desmond Mills, Jr, Emmitt Martin III, Justin Smith and Tadarrius Bean, are facing seven charges each and that a jury -- should defense attorneys not seek to have them tried separately -- will have to come back with 35 verdicts.
According to Honig, "it is a mistake" to think the prosecution will "easy" because jurors can't convict if they have any doubts.
Honig also took up the matter of the failure to provide Nichols with medical help as he lay on the ground after the savage beating.
"So the theory here is failure to render aid or failure to render medical aid," he told the host. "Now, this is a really important point legally because this is the sort of new development that we're seeing in some of these police cases. We saw in the Derek Chauvin trial in the killing of George Floyd. The theory around all of those officers is, in addition to causing George Floyd's death, they failed to render aid."

Alpha News is proud to present “The Fall of Minneapolis.”
The film is based on Liz Collin’s Amazon bestseller, “They’re Lying: The Media, The Left, and The Death of George Floyd,” which exposes the holes in the prevailing narrative surrounding George Floyd’s death, the trial of Derek Chauvin, and the fallout the city of Minneapolis has suffered ever since. The documentary features more than a dozen interviews with the people directly involved, including exclusive interviews with former officers Derek Chauvin and Alexander Kueng who spoke to Liz Collin from prison. The families of Chauvin and Kueng also speak out publicly for the first time. The film also features current and former Minneapolis police officers who tell their harrowing stories from the riots, recount the planned surrender of the Third Precinct, and explain why so many of them left the job. The crowdfunded movie was produced by Alpha News journalist Liz Collin and directed by Dr. J.C. Chaix. Cinematography by Josh Feland.
