Case Histories - Chapter Ten
An AU Andy Barber fic (based on BBC’s ‘The Split’)
Previous Chapter Here / Masterlist Here
Series Synopsis: A talented small-town family lawyer, Grace Atherton, gets the opportunity of a lifetime when she is offered a job at prestigious Boston law firm, Rothman and Hale. She decides to give up the relative comfort and ease of her current working situation in favour of following a dream she’s had since she was a young law grad, to the detriment of her family life and marriage. She soon comes into contact with old mentor and one-time flame, Andy Barber. As gifted as he is handsome, it becomes clear he’s been keeping an eye on her burgeoning career from afar. Just how much will this decision cost her?

CHAPTER TEN
Grace anxiously tapped her fingernails against the light grey countertop as she waited for her coffee to brew. It seemed to be taking forever. It was either that or the morning was going by extremely slowly.
She absent-mindedly stared out through the kitchen’s glass doors and into their neat back garden. Flecks of sunshine peeked through the branches of the grand cherry blossom tree that was a continuous source of pocket money for Sam given how often he had to brush up the delicate petals from the ground. It was a very pretty scene and one she savoured enjoying by herself over a glass of wine whilst sitting on the couch swing. So peaceful. She couldn’t remember the last time she had done so actually, nor when she last allowed herself to enjoy a novel or a magazine.
It was beautifully warm and bright for this time of the year, what with Fall being just around the corner, but it suddenly felt much colder inside. Dan shuffled into the kitchen and dropped his work bag on the counter surface in front of where Grace stood. She heaved a frustrated sigh but couldn’t quite meet his eye.
“Can you not leave that there? You’ll drip oil everywhere.” She complained quietly under her breath so as not to start an immediate fight. There was little effort in her tone, though. She knew he would most likely ignore her request.
He glanced at her while snapping his apple watch strap back around his wrist. An aggravated mutter followed that she couldn’t quite make out and Grace wondered how many petulant children she actually had in the house at the present time.
“Working late again?” Was all he gave her.
“No, not tonight. I’ll try to get away early so we can get that pizza with Sam. I think he said his friend might stay for tea as well so it’ll save us cooking something.” She responded, fingering a chipped nail that had been irritating her for the past ten minutes.
“Well, don’t worry about it on my account.”
And with that, Dan grabbed his bag, strode out of kitchen, and out of the front door. Grace heard it slam shut but remained where she was, unsure of whether she had missed parts of a conversation. It wasn’t so much the quietness or the brooding that Dan was partial to from time to time; it was more the unwillingness to make an effort to rectify things. That old adage of ‘never going to sleep on an argument’ didn’t seem to land with him. But at this moment in time, as she poured the coffee with one hand and picked up her mobile phone with the other, she actually preferred him being out of the house. She could breathe at last. Peace and quiet was so hard to come by these days, she enjoyed these few minutes she got alone at the start of the day even if it only came off the back of a nagging fall-out.
“You’re late.” Andy teased, leaning in to her office a few minutes after she’d arrived later that same morning. He instantly regretted his joke when he was met by her rather muted expression. “Oh. Everything OK?”
“Yeh, it’s fine.” She said, half smiling. She shoved something into her desk drawer a little too harshly. She didn’t intend to come across troubled; it was just unfolding that way, it seemed.
The drawer closed shaking her computer screen a little. He could almost feel the vibration from where he was stood. Andy quickly looked behind him into the corridor and, when noticing no one was in the nearby vicinity, he closed her office door behind him.
“OK and how about now?” He asked, sterner this time but trying not to sound like he was in boss mode. He shoved his hands in his trouser pockets and raised his brow inquisitively at her.
She toyed with the idea of telling him everything from the night before, thought about getting it all out in the open, but ultimately thought better of it. Not everything needed to be made light of and she would rather not discuss the ins and outs of her marriage with a man she’d only recently slept with.
“It’s nothing. Honest. It’s just some silly stuff.” She placed her hands on her hips and scanned her eyes over the blank surface of her desk.
“Well, it’s not silly if it’s making you grouchy.”
“Grouchy?!” She repeated at him.
“Yes.” He nodded boldly, doubling down on his deduction. He moved to sit in the leather chair opposite her desk and had no trouble making himself comfortable safe in the knowledge that Grace would much rather he left her alone altogether. He somewhat savoured knowing he was pissing her off a little. “You can be one hell of a grump when you want to be.”
Her mouth hung open unsure of a comeback but he just smirked back at her. She was dumbstruck by his comment but too tired to argue back, especially after realising he wasn’t going anywhere fast.
“Liv split from her boyfriend yesterday.” She surrendered with a sigh. “She’s really upset about it and thinks the entire world is ending of course. Why are you nodding?”
Andy looked up at her across the desk and smiled sympathetically, almost laughing.
“’Cos she’s fifteen, Gracie, of course she’s gonna think the sky’s fallen in. That’s only natural, right? So I’ve heard.”
“And how do you know? When was the last time you encountered a fifteen-year-old kid?”
His smile was tighter now but he knew he was right.
“I wouldn’t say she was a “kid” kid, but…” He trailed off but stopped that train of thought when he saw how unappreciated it was with Grace. “First boyfriend, I take it?”
Grace couldn’t believe he had hit the nail on the head on his first try. She also couldn’t believe she was about to get relationship advice from Andrew fucking Barber, a man who has likely been a “Dylan” at least several times in his own teenage life. “Dylan” was probably his go-to speed even as an adult, and that thought bothered her more than it should.
“Yes. He said they were going in different directions.” She said, finger-quoting around her words.
“Different directions? I mean, I know I said they weren’t exactly kids but jeez. He’s still only fifteen, right?” He asked incredulously. “That’s a new one. I might have to steal it.”
The appalled look Grace gave him would have made him laugh in any other circumstance but this was her child after all. Her eldest child. Her only daughter. Maybe now wasn’t the right time to poke the bear.
“Look, boys that age are kinda dicks.” He continued, leaning forward in the chair. “Their minds aren’t developed enough yet to focus on one thing at a time so their attention starts shooting off in different directions. It’s friends, sports, girlfriends, possibly studies somewhere in there as well you’d hope, but not always in that order.”
She softened a little at his words and he hoped he was making some minor difference to her worries.
“But girls…” He continued. “Girls are far smarter and savvier. They run rings around us half the time. And they can focus on one thing, something that’s really important to them, like a boyfriend.”
“So, you think she should wear this like a badge of honour? That she’s hurting because she’s emotionally mature?”
He couldn’t answer that truthfully.
“I’m just sayin’, I think she’s gonna be OK. And he’ll probably end up regretting it. You know, when he sees her blossom without him.”
“Blossom?” she asked, chuckling a little.
“I don’t know, it sounded alright. Thrive, maybe? Is that less weird?”
She smiled at him as she mused on his words. If she was honest with herself, she appreciated him sitting down and saying all these things. What he was saying made some sense. It was just a shame it wasn’t a conversation she could have had with Dan.
“When did you become such a romantic?” she asked him.
He smiled warmly at her. “What can I say? You bring it out of me.”
He watched her as she looked away from him and something in that moment, something in her head evidently told her to turn her computer screen on so she could begin her day. He would have stayed there for hours just looking at her if it wouldn’t put her off or if he was invisible, but he knew when he was outstaying his welcome.
“Are you gonna be OK?” He asked, tentatively hoping she’d ask him to stay a bit longer. “You can go home if you’d rather work there?”
“No, that’s not necessary. I’m fine.” She nods and he sees her shoulders relax. She smiles up at him as he reluctantly gets up from his chair. “Thank you, Andy.”
He reaches his hand across the desk and gently places it on top of hers. “You know where I am.”
“Hey, Grace…?” Evie breezes in through the office door without knocking but stops abruptly when she spies Andy. “Oh, sorry Andy, I didn’t know you were in here. Should I come back later?”
“No, no it’s fine.” Grace slides her hand out from underneath his and turns to face her. “What’s up?”
“I’ll get going.” Andy says quietly to Grace before nodding a smile towards Evie and leaving the office.
Evie remained frozen to the spot a second longer after watching Andy walk out, and wasn’t sure if she could proceed with caution. Grace looked quite tired, more tired than usual. She noticed small details in people and the blueish hue underneath her eyes became a giveaway.
“I can come back, it’s not urgent.” Evie spoke, thumbing backwards towards her desk.
“Don’t worry, it’s all good. What’s up?”
“OK, well, this arrived for your yesterday afternoon but it was late coming up from the post room.” Evie approached Grace’s desk and placed a neatly wrapped package in front of her. “I think it might be from Doreen McArthur.”
Grace looked confused as she picked up the small rectangular box Evie had just put down. Her address was very neatly written out on a white label, and the wrapping paper was a little too decorative for it to contain something pertaining to a case file. It was clearly a gift of some kind or something more trivial.
“How can you tell?”
“I notice things.” Evie answered rather proudly before quickly clearing her throat. “I mean, that’s to say I have a good eye for small details. I definitely remember her handwriting. Even at the time, I remembered thinking it looked like calligraphy. Very beautiful.”
“Oh yeh, you’re probably right.” Grace remembered the same thing and began opening the sides that had been stuck down with precision and some silver sticky tape.
“I’ll, er, leave you to it.” Evie smiled and began walking away from her. A moment passed and she stopped just inside the doorway. “Grace?”
Grace looked up from what she was doing and spied a hopeful-looking Evie.
“Um, just in case it’s useful or anything, if there’s any problem at all, I’m a pretty good ear.” Evie offered, carefully. “If you ever need one that is.”
Grace liked Evie a lot and thought very highly of her, but she wasn’t sure how to react to that. Evie seemed to have moved from looking vaguely hopeful to appearing more uncertain of whether she has just overstepped an invisible line. Grace’s response would need to be a positive one even if Evie’s offer came a little out of left-field.
“Thanks Evie.” Grace smiled encouragingly. “I really appreciate that.”
“You’re welcome.” Grace’s non-committal seemed to do the trick. “I just know how hectic this place can be sometimes and I think it’s good to check in with people every once in a while. Maybe we could have a drink one evening soon?”
“Er, yeh, that would be lovely.”
“Great! Well, a few of us get together at the end of every month or so, so I’ll make sure to check back in with you to see if you’re free? Get a night off from the kids.”
Grace smiled again. “Sounds great.”
Evie tapped her manicured fingernails musically against the doorframe, looking rather pleased with herself, before leaving Grace’s vision entirely. Grace, left with disbelief but not an altogether unfriendly feeling, returned her attentions back to the package in her hands and continued to peel away the tape holding it all together.
It took longer than she imagined but finally she was met with a thin white box covered by a small handwritten postcard that displayed the image of a yacht. It looked like one of those photographs wealthy people turned into cards at Christmas time or for some other important occasion. She squinted at the writing on the side of the boat and made out the name ‘Freedom’. Amused, she turned the card over.
*
Dear Grace, I hope this finds you well! I am loving life down under but was struck with a feeling that this could not have been possible without you. This in no way covers the gratitude I feel but I hope this reaches you and finds you happy and well in life. It is far too short after all. With love, Doreen x
*
Grace didn’t think she could grin any wider than she already was but she somehow found a way. Doreen didn’t strike her as a sailing enthusiast but she had obviously learned some new skills in the time since they had last spoken. Knowing the lady as fleetingly as she did, that fact wouldn’t surprise her one bit.
She removed the lid from the box and found inside a fridge magnet shaped like a boomerang. She held it up in front of her and burst out laughing before quickly biting her bottom lip hard as she tried to quieten herself down lest people nearby thought she was having some kind of a breakdown.
“Whatever is yours will always come back.”
The words on the underside of the magnet, painted in a vibrant yellow and steeling focus over the other, smaller patterns that adorned it, were likely a reference to her ex-husband and the fresh, new-born feeling of independence she was now living. She was relaxed and she was happy. She was living the same life she had wanted for herself all those years ago. No barriers; no one telling her otherwise. Grace honestly couldn’t be happier for her. Doreen was living and breathing proof that while sometimes changes in life could be harsh and destructive, life often had a funny way of working itself out.
*
Andy scanned through the same dozen or so pages in the pre-hearing he had found left on his desk that afternoon. Jack had helpfully scribbled a post-it note and left it on top of the distressed leather folder asking for Andy to take a look over some of the smaller details. He was still none the wiser, however. Jack’s writing was so horrific, he couldn’t work out if he was favouring the owner or the employee.
Andy theorised he could assess how stressed-out Jack felt by how cursive his writing became. The more joined-up and chaotic it looked (sometimes two or three whole words were sandwiched together), the more irritated he was likely feeling. Andy recognised the same trait in himself. He managed to work himself out of the bad habit some years earlier, though, when a former assistant couldn’t read his notes and sent a document to the wrong Court House. Rookie mistake, Andy remembered; he wouldn’t make the same one again.
He reclined into his chair and let out the tension he had been feeling in his shoulders of late. Even late-night basketball wasn’t enough to calm his nerves these days and that usually did the trick. Sex also had a tendency to work satisfyingly well for him but, well, he was struggling to focus on anyone else right now.
He looked out of the closed glass door that shielded him and saw a few people milling around looking varying degrees of busy and harassed. Beyond the group that had congregated besides the watercooler and a few interns frantically making notes as they tried to keep up with a Researcher, there was a young girl that stood out from the crowd. She was familiar to him but he definitely hadn’t met her before.
He stared at her for a few moments, taking in the long, curly brown hair that had been casually flicked over the top of her head, and the recognisably anxious demeanour of the toe-tapping against the hardwood floor. She looked up from where she was sat waiting and glanced at every stranger who strode by her. She was invisible to almost everyone.
“It’s Liv, right?” Andy asked as he got closer to her.
She was taken aback by the tall man who appeared out of nowhere and was making conversation with her. She nodded shyly and he reciprocated in acknowledgement.
“You waiting for your mom?”
“Yeh.” She answered quietly and Andy could tell she knew she was not an expected party to Grace’s afternoon. “The lady said she’d track her down for me.”
Andy followed Liv’s eye-line and landed upon Evie stood at the front desk, phone glued to her ear, obviously trying to do that very thing
He returned his attention back to Liv, still tapping the toe of her flat shoe on the floor, completely oblivious she was doing it.
“Why don’t I show you to her office. You can wait in there if you’d like? It’ll be loads quieter than waiting out here.” He half smiled, hoping he wasn’t coming over as weird.
He seemed to have succeeded as far as he could tell. He didn’t know for sure; he didn’t know many teenagers except the few that belonged to some older pals but it wasn’t like he was babysitting them every weekend, getting an insight into their mindsets. Shit, did teenagers even need babysitters these days? He didn’t have one when he was her age but, then again, his childhood wasn’t exactly one to be used for the textbooks.
Liv followed him into the office.
“Woah….” She breathed out, eyes wide open in a mix of surprise and awe, he figured. “This is so cool.”
He watched her stride over to the window. OK, he though; he could sustain a short conversation about the views if that covered him until Grace came back. She had to be around here somewhere.
“Yeh, quite a view, huh?” He agreed, hands in both pockets as he casually walked over towards where she had paused in front of the window. “You see that tall spire over there? That’s part of Fenway.”
A grin covers her face, crinkling at the corners of her eyes, just like her mom.
“And that small brown brick building over on this side? Just behind the billboard?” He continues. “Apparently, that is where you lived when you were first born.”
“How do you know that?” She asked, suddenly turning to him. Her brow furrowed in puzzlement.
“Your mom talks about you all the time!”
“Really?”
“Yeh! You’re like the coolest person she knows. She’s always raving about you and your brother. About how smart you are and stuff that she learns from you.” He keeps looking out of the window. Liv turns back to the window but doesn’t say anything else. “I’m Andy by the way.”
“Hi.” She says quietly, amiably. “Are you her boss?”
He smirks a little and tilts his head from side to side as he ponders his answer.
“Sort of, but, she kinda bosses me around most of the time.” He jokes. “Don’t tell her I said that, though. I need to maintain some semblance looking like I’m in charge ‘round here.”
Liv laughed brightly and Andy is relieved to see that he might be coming off as a decent grown-up. He had never been this nervous meeting other people before. His oft-relaxed disposition was one of his strongest characteristics, but it was definitely feeling like an effort right now.
They stayed standing in silence as they took in the view, Liv appearing to be entranced by everything she was seeing in front of her and from this height. She asked about a couple of different places, and they poked fun at the man on the ground outside who found himself in the rather unfortunate position of running too fast before slipping up and landing on his back in a manner that would not look out of place in a Laurel and Hardy film.
Just as he was about to locate part of the Law School he and Grace had attended, she entered the office.
“Hey Livvie…” She said, anxiously. She glanced between her daughter and Andy, not expecting to see either of them in her office. He could tell she felt wary about them meeting like this. “Everything alright?”
“Yeh, just feeling a bit sick.” Liv answered and walked towards where her mom was stood. “I think I have a headache as well.”
“I’ll, er, leave you guys to it. Nice meeting you, Liv.” He wandered out of the office, smiling at both of them as he passed by.
“You too, Andy!”
Grace knew she meant it; Liv didn’t like just anyone. It often took some effort in that respect and as she got older, Grace accepted that she had inherited her father’s aloofness. She was hoping she might grow out of it by college.
“Have you been here long?” Grace had to steal herself from inquiring about what she and Andy had or had not been talking about while she’d been gone, but Liv appeared quite cool.
“No, not long.” Liv replied, taking a seat on the bench in the corner of the office. Grace sat down beside her and stroked some hair away from her face, tucking it gently behind her ear.
“Is it Dylan? Has he said something to you?”
“No,” Liv replied, sorrowfully. “I was just not feeling great so I thought I’d come here and wait for you to finish.” Liv explained, hoping her mom wouldn’t be annoyed with her for doing so.
What if they had been talking about her??
“I might be a little while longer, though? I’ve got a couple of calls to chase up on.” Grace looked frantically around her office in the hope that an idea would spring into her mind that could solve all their problems. “But why don’t I show you the kitchen? It’s quiet and there’s some comfy chairs in there. You could maybe try and do some of your homework?”
“Um, yeh, OK.” Liv turned to smile at her mom. “I have some reading, I think.”
Grace didn’t really want to shunt her daughter off to a corner of an unfamiliar building, not when she was clearly upset and possibly unwell. Liv was doing the same thing she did, trying to minimise her disappointment in an attempt to alleviate the feelings of the other person. She got that from her own mother and honestly, it was the fucking worst.
“Unless…” Grace had the bones of an idea. “You wanna help with some filing?”
Liv smiled brighter at that suggestion and nodded eagerly at her mom, obviously wanting to stay close by her.
Grace slapped her hands on her thighs, purposefully and a little proud of herself. She stood up from where she was sat and walked over to her desk.
“OK, well, how do you feel about colour-coding some reference folders? I have a hundred different coloured pens in one of these drawers here…” She proceeded to open and close them one by one before locating the transparent plastic tub that was buried at the back of the deeper, bottom drawer. “Here we go. On the top page, it’ll say which law it concerns and it’d be good to group things together under subject headings for future reference.”
Liv seemed surprisingly entertained by this idea and she gladly took the box from her mom’s hands and sat in the chair on the other side of the desk. She took each thin folder, one at a time, and began scanning the details. Nothing was confidential, thankfully, as the cases were all public knowledge and often used in textbooks for the next generation of lawyers to work from. But Grace would be a lying if she didn’t hope some keen academic interest would spring from this afternoon’s activities.
Grace wasn’t too bothered if Liv didn’t get through that many; she herself enjoyed a quiet hour with her highlighter pens from time to time. It was nice just to sit in the peace and quiet that befell them both.
“He seems nice by the way.” Liv spoke up after a few minutes of silence, not looking up from the single file currently in her lap. “Andy.”
Grace looked at the daughter. “Yeh, he’s a good guy. He’s a good boss.”
“I think he likes you.”
“What?”
“Andy? I think he fancies you.” Liv giggled to herself. It was the silence that followed that caused her to finally make eye contact with her mom before rolling her eyes. “I’m kidding!”
“Oh, right, I was gonna say…” Grace sighed in deeper relief than she perhaps intended. She turned back to her computer screen but struggled to find the sentence she had just finished reading.
“He is kinda hot, though. For an old guy.”
“Jesus, Liv…” It was now Grace’s turn to roll her eyes in exasperation.
“What?” Liv’s mouth dropped open. “He sort of is! Is he married?”
“Liv…This isn’t appropriate.” Grace retorted. “And he’s not old. He’s only a few years older than me.”
“Yeh but c’mon, you have to have noticed.” Liv pushed her again. “It’s healthy to have crushes on people anyway. It’s like keeping your options open. Isn’t that what you said once about Dylan?”
Liv returned to reading the folder in her lap. Grace watched her run a yellow pen over the chapter heading. What it must be like to be a teenager in this day and age.
“Well, I somehow don’t think your dad would appreciate that.” Grace chuckled unconvincingly, but she could feel the internal distaste rearing its head in her mind at what she was doing.
Grace saw Liv’s lip curl in antipathy, so brief that she probably wasn’t supposed to see it.
“Yeh, s’pose.” Was all Grace got from that look.
She didn’t push it. She hadn’t thought much about Dan herself during the day. At least by not having that discussion now, with whatever Liv was feeling or not feeling about her father, she could try and calm the waters for one person before it was time to go home.
