North Carolina may have just gerrymandered 3 US House seats out of Democratic control. But the New York Court of Appeals (what the state supreme court is called in NY) just indirectly gave the Democratic legislature the power to draw a new Congressional map. It will probably result in Dems flipping 3 or 4 seats and possibly as many as 6. In effect, the North Carolina gerrymander has been neutralized – or even more than neutralized.
Under a new map, Democrats could flip as many as six seats currently held by Republicans, enough to seize control of the closely divided House. The New York Republicans who rode a state-level red wave to Congress in 2022 are about to watch their districts shift dramatically to the left. The big question is whether New York Democrats will squander this opportunity with the kind of mismanagement and infighting that led them to disaster last year. Tuesday’s decision was the latest episode in the years-long saga over redistricting in New York. It began when residents voted for a constitutional amendment in 2014 that gave primary responsibility over the process to an Independent Redistricting Commission, or IRC. The 2014 amendment, however, divided the IRC equally between Democrats and Republicans, and the commission deadlocked on a plan after the 2020 census. So the legislature stepped in with its own congressional map—which the New York Court of Appeals struck down as an unlawful partisan gerrymander by a 4–3 vote in 2022. (The Court of Appeals is the state’s top court.) The conservative-leaning majority, appointed by Gov. Andrew Cuomo and led by Chief Judge Janet DiFiore, directed an outside mapmaker to redraw the plans. The mapmaker’s submission was heavily influenced by analyses from experts who specialized in GOP-friendly redistricting. It gave Republicans an edge while pushing two top Democrats into the same district, forcing them to compete against each other. As a result, Republicans seized five or six additional seats (though one was vacated when the House expelled indicted Rep. George Santos).
So we probably have that 2022 NY map to thank for George Santos's brief House career. His district, NY-03, is currently a tossup. But with a redraw of the map, much of that area would probably find itself in bluer territory.
In the peculiar world of NY politics, nothing is simple.
First crack at a new map will go to the IRC (Independent Redistricting Commission). But it will deadlock because it is evenly split along party lines. Then the task goes to the legislature with Dem majorities in both chambers. Dems will get out their mapping software and have a go at it. Republicans will inevitably appeal the new Democratic map and the case will end up back at the New York Court of Appeals which just handed down this decision on Tuesday.
All this has to be done before filing deadlines for the 2024 US House primaries. However, no date has been set for those primaries in NY. The primaries can be held as late as early September. Stay tuned!

The Federal Election Commission has tossed out claims by the Republican National Committee that Google’s spam filters in Gmail are illegally biased against conservatives, according to an agency letter obtained by CNN.
The decision resolves a joint FEC complaint filed last year spearheaded by the RNC that alleged Gmail’s automated filters had sent Republican fundraising emails to spam at a higher rate than for Democratic candidates during the 2020 election cycle. The RNC didn’t immediately respond to a request for comment.
The FEC decision to dismiss the complaint and close the case is the latest defeat for Republicans who have sought on multiple occasions to bring the agency’s powers to bear against tech platforms over allegations of anti-conservative bias. In 2021, the FEC dismissed a similar RNC claim against Twitter over the company’s decision to temporarily suppress the New York Post’s reporting about Hunter Biden’s laptop, saying the content moderation decision appeared to have been made “for a valid commercial reason.”
The FEC took the same stance on the Gmail filtering issue in a letter to Google last week, and which the company provided to CNN on Wednesday.
In the Jan. 11 letter, the FEC said its review “found no reason to believe that [Google] made prohibited in-kind corporate contributions” to Democrats in the form of more favorable email filtering treatment.
In order to be considered a violation, the FEC wrote, “a contribution must be made for the purpose of influencing an election for federal office,” adding that Google’s public statements have made clear its spam filtering exists “for commercial, rather than electoral, purposes.”
Even if it were true that Gmail spam filtering happened to favor Democratic campaigns over Republican ones, the FEC wrote — an allegation the commission neither explicitly endorsed nor rejected — that outcome would not necessarily make Gmail’s underlying conduct an illegal campaign contribution.
In its letter, the FEC cited Google’s public statements claiming that its reasons for spam filtering include blocking malware, phishing attacks and scams.
“In sum, Google has credibly supported its claim that its spam filter is in place for commercial reasons and thus did not constitute a contribution within the meaning of the [Federal Election Campaign Act],” it wrote.
Documents related to the case will be made available to the public by Feb. 10, according to the letter.
“The Commission’s bipartisan decision to dismiss this complaint reaffirms that Gmail does not filter emails for political purposes,” said José Castañeda, a Google spokesperson. “We’ll continue to invest in our Gmail industry-leading spam filters because, as the FEC notes, they’re important to protecting people’s inboxes from receiving unwanted, unsolicited, or dangerous messages.”
While the FEC did not weigh in directly on Gmail’s practices, the letter highlighted the limitations and context surrounding a 2022 academic study that the RNC had leaned heavily upon in its initial complaint.
The study by North Carolina State University researchers had involved an experiment testing the spam filters of Gmail, Microsoft Outlook and Yahoo! Mail. Its findings suggested that of the three email providers, Gmail was the likeliest to mark emails from Republican campaigns as spam.
The RNC had cited the study’s findings as evidence of “illegal, corporate in-kind contributions” to Democratic candidates, including Joe Biden, and called for an FEC investigation.
But the FEC’s letter cited several factors that cast doubt on the RNC’s interpretation of the research, including the study’s own statements of limitations and a Washington Post interview with one of the study’s lead authors, who had said Republicans were “mischaracterizing” the paper.
The study itself acknowledged that it covered a short period of time, and that its findings could have been affected by campaigns’ own tactical decision-making as well as other variables the study did not account for, the FEC wrote, adding that in its response to the RNC allegations Google had said the researchers used a sample of 34 email addresses “when Gmail has 1.5 billion users.”
“Though the NCSU Study appears to demonstrate a disparate impact from Google’s spam filter, it explicitly states that its authors have ‘no reason to believe that there were deliberate attempts from these email services to create these biases to influence the voters,’” the FEC added.
Meanwhile, a separate RNC lawsuit against Google over the same Gmail filtering issue is still ongoing. And Google has continued with an FEC-approved pilot project that allows political campaigns to bypass Gmail’s spam filters. More than 100 political entities are participating in that program, a Google spokesperson told CNN on Wednesday.

A federal judge in Washington, DC, ruled Thursday that changes Postmaster General Louis DeJoy made to the US Postal Service before the 2020 election hurt mail delivery, and has put in place orders to prevent DeJoy from doing the same again.
The decision, in a years-old lawsuit from Democratic-led state and local governments, is largely a response to mail across the country not being delivered on time at higher rates than normal in 2020. New York state and New York City, Hawaii, New Jersey and San Francisco-area governments argued that the slow-down impacted their ability to stop the spread of the COVID-19 virus, by impeding people from having a reliable alternative to in-person voting.
In mid-2020, the USPS cut back on the number of mail sorting machines it used, and also hindered the ability of workers to make extra postal trips that would result in them being paid for overtime. The changes – which Democratic politicians heavily criticized at the time because they dovetailed with then-President Donald Trump’s vocal opposition to mail-in balloting during the election – hurt on-time mail delivery.
DeJoy had made the changes without consulting the regulatory agency that oversees the post office first, Judge Emmet Sullivan wrote in his 65-page opinion Thursday.
“The evidence demonstrates that [the states and localities] suffered harm by impeding their ability to combat the spread COVID-19, impeding their ability to provide safe alternatives to in-person voting,” and by imposing costs and administrative burdens on state and local governments, Sullivan found.
Sullivan said the USPS couldn’t bar postal workers from making late or extra delivery trips without permission from the Postal Regulatory Commission, an independent federal agency.
“Although the simultaneous implementation of multiple policy changes in June and July 2020 contributed to the decline in mail service and the overall confusion by postal workers, the record evidence demonstrates that changes to and impacts on the USPS transportation schedule regarding late and extra trips were the primary factor in affecting service on a nationwide or substantially nationwide basis,” Sullivan wrote in a 65-page opinion Thursday.
Sullivan looked at whether the USPS had violated the law governing federal elections in making its service changes in 2020, and found the agency had not, according to his opinion.
“Though the implementation of the Postal Policy Changes contributed to the delay in mail deliveries nationwide, which in turn risked a delay in the delivery of mail-in ballots during an election season, USPS’s actions do not amount to voting regulations that override the States’ existing regulations,” Sullivan wrote.
Sullivan declined to appoint an independent monitor to oversee the USPS’ internal operations complying with the court’s orders.
In a statement, the Postal Service said it is “focused” on its critical role in the electoral process.
“Just as we always have been, the U.S. Postal Service remains fully committed to the secure, timely delivery of the nation’s Election Mail. Between now and the November election, we are highly focused on fulfilling our critical role as part of the country’s electoral system where election officials or voters choose to utilize us as a part of their process,” USPS said.
“We continue to believe that the lawsuit was not justified under the facts or supported by the applicable law. We are studying the opinion to determine our appropriate next steps,” the agency added.
