I donate monthly to bail funds and to the Baltimore American Indian Center, and yearly to abortion clinics. I give cash directly to homeless people when I can. I give to other causes. I don’t make a lot of money, but I share it when I can.
At my old job, I wrote letters asking courts to allow undocumented Central American migrants to stay in the United States with their families. I showed up in front of the Supreme Court on November 9th of last year as part of the demonstration in support of ICWA. Without doxxing myself or my current job, when customers cannot pay I do not charge them. I provide tech support to elderly people even when I’m off the clock. It’s small, of course, but it’s something.
I’m sure you do something too, otherwise you wouldn’t expose yourself to being asked “what about you?” And if you do in any way work to improve material conditions for even one person, that’s good and you should be proud of it.
I’m just failing to understand how being gleeful about five people suffocating in the word’s stupidest tube is part of that important work. But I can’t tell you how to feel! Only that you look silly when you try to defend your glee as the morally correct response rather than simply your personal vindictive feeling.
You believe in the logic of punishment. You believe that there are Bad People and if they suffer, then that will right the wrongs they’ve done. I personally believe this is not the same as justice. But that’s just me.

What is at stake with the icwa
Please read the preliminary report from the department of the interior's initial investigation to understand the very surface level of what it is the ICWA (indian child welfare act) is defending against. It is not an easy read. There are many aspects it did not touch. And the academic language used to insulate mutes a level of horror. These schools did not end. Some are still in operation. Some closed in the 80s. Many of them became adoption agencies. There use to be vans that grabbed kids off the street. Estimates place 25-35% of native children were taken out of their communities. Forced sterilization was something that happened to about 1 in 4. There were whole communities that lost all their children. The reason we don’t have examples of exact numbers were that people didn’t think it was important enough to track or purposefully obfuscated and buried it. --- Please understand this about the supreme court. These are men, who will never feel the consequences nor guilt of their actions arguing in favor of genocide. And should be treated as such. They feel no shame over this nor the racist propaganda they propagate. Only see a smug righteousness and oil money in their future. But the documented truth is native kids need the support of their community and there is a long paper history over-policing of indigenous communities. The ICWA isn’t some poorly thought out patch job. It in many ways is a gold standard of child welfare. Plenty of advocacy groups, be it child welfare, mental health, or transracial adoptees agree. Last count  I checked was 486 tribal nations, 59 Native orgs, 11 child welfare orgs, 26 states In fact the only people that seem in favor of it is the state of Texas, a conservative think tank, and a law firm funded by big oil? Now what would all these these people have a vested interest in a face that on the surface level seems to be about custody? Well, the case is arguing that the policy is reverse racism and that indigenous identity is racial instead of, what it actually is, a political and social identity as we are sovereign nations and political entities. They say this to enforce exterminationist policies like blood quantum. The practice of determining indigeneity by blood fractions. Something that is racist, has no basis in science, indigenous models of nationhood or belonging, and again, is made to be exterminationist. That indian can be bred out.   This, would be key to undermining Indigeneity as an identity at all. Basically, legally, native folk would be tied to (by the US's definition) an identity that couldn't exist in a sustainable or politically defensible way. Thus undermining every bit of sovereignty or civil rights protection that has been fought for over hundreds of years. Or, more direly, leaving it up to the states. Something oil has a monetary interest in as this has been the cornerstone of indigenous nations to stonewall oil pipelines going through, lands, sacred sites, and watersheds. It is one of the keys to success for pipeline protest all over the country. Standing rock put the fear of god into these folk. Indigenous nations are politically sovereign entities with our our rights, cultures, languages, and definitions of belonging and community. We're not purebred dogs nor can we be bred to extinction. We have the right to our children and they have a right to their future. Please don't let some clowns arguing "reverse racism" without the first clue over indigenous identity, belonging, or kinship being backed by oil money and a racist lawyer with a grudge against natives take our children our undermine our sovereignty. I do not have faith in american government on issues of indigenous rights. Especially in this supreme court. Indigenous racism has long been defined by a hyper invisibility which silences our struggles. Do not let this be one of them. All I ask is you pay attention and listen to the people actually affected by this case. And question the motives of anyone that says a civil rights ruling is unneeded. Indigenous people are not inherently less capable of providing for and loving our own children.

In context of whiteness as you discuss a lot in your posts and I guess more the "white-ish-ness": How would you relate the experience of "Third Culture Kids" in the States to this topic?
I was someone thrown into the foster system and handed over to white families when my own is native on one side and Mexican on the other and I think that experience was a TCK experience if not Very similar to one.
Mexican stuff was relatively easy to participate in because my area growing up had a lot of South American ppl but the native stuff? Much harder.
That said, ICWA exists specifically because of the known relevance and damage caused by sending kids to live outside their culture and adopting someone else's. It makes it harder to have a sense of community when you aren't tied securely to any community.
That was my experience. And looking at some job that create TCK like military... Yeah I'd say it's that. It's that othering from society. And you can Feel that you don't fit anywhere really. Your social cues or words or jokes you make to fit in with a certain group don't land quite right because you did not grow up around them and lack the same tone, mannerisms, or accent. Communities you belong to feel like they don't belong to you because the people in them Feel you are an outsider even if you're not.
To an extent I'd say most mixed kids could probably see this too and relate.
To me being able to See people with healthy cultural ties and knowing I should have the same ties and knowing that I would if not for colonization makes it Very Hard for me to view introducing Whiteness as a culture as anything But ongoing colonization tbh.
It's destroying cultures and community to this day. And yeah I think TCK can see it way and understand it that way if they tried. If they wanted to. It's not so different.

Yeah actually i will vent about whats going on with me fuck it, i turn 26 in 2 days and am going to lose my insurance, my partner and wife both have covid so we can't celebrate and I'm alone, if I get sick I will probably have to go to the hospital for it, im still unemployed and still can't find a job just hit 2500 apps, and this year I actually had plans for my birthday that were going to be followed up on and im just so fucked up that i cant even hug the people i love on that day. Also my adopted mom was supposed to come into town and she has the flu + my biomom put like pressure on me about it + jewish shit hard + indigenous shit hard + ICWA pressure. Also I have a job interview tomorrow that I ACTUALLY WANT SO BAD but it's in person and thats stressful

When Kimora Toledo was a little girl, she and her mother Malisha would make the hour-long drive from Albuquerque, New Mexico, to Jemez Pueblo at least once a month. Malisha, who is from Jemez and Tesuque Pueblos, had moved her family to Albuquerque for a better job, but her father was a Jemez medicine man and it was important to her that Kimora be immersed in that heritage. On one of those visits to Jemez, Malisha remembers dancing alongside Kimora – who’s Jemez, Tesuque, Diné and Black – during the feast day celebrations. She hoped it would be the first of many times they’d dance together.
But Malisha battled a criminal record and her ex, Kimora’s father, managed to gain custody over Kimora and her younger brother. The two children would spend several years living at their dad’s house in Albuquerque, without those monthly visits to the pueblo.
When Kimora was 11, the New Mexico children, youth and families department removed her from her father’s home over abuse she was experiencing. Kimora would spend the next three years in and out of group homes and rehabilitation centers, eventually landing in foster care when she asked not to be returned to her father’s.
Kimora had never felt more disconnected from her culture and traditional ways of healing. Her foster mother, a Mexican woman, suggested Kimora take Spanish as an elective in school. But Kimora desperately missed her mother and grandfather, and the language they’d spoken during her childhood. “I missed a lot of my childhood and our traditions,” she said, just weeks before her seventeenth birthday.
Kimora and her mother didn’t know it then, but, as a Native American child, Kimora should have never ended up in foster care the way that she did.
This month, the US supreme court will consider the future of families like Kimora and Malisha’s. On 9 November, the court will hear oral arguments in Haaland v Brackeen, a case challenging the constitutionality of the Indian Child Welfare Act. Designed to keep Native American children in their communities during custody, foster care and adoption proceedings, ICWA was passed in 1978 in response to the mass separations of families that had been customary since the 19th century. Many Native American activists are worried for the future of ICWA, given the rightwing composition of the supreme court. Some – like Kimora and Malisha – are also working to enshrine it in local law.
Remedying a policy of destruction
In 1860, the Bureau of Indian Affairs opened the first of what would become more than 350 American Indian boarding schools, with the intention of “civilizing” Native American children – an assimilationist policy regarded by many as “cultural genocide” today. By the 1920s, nearly 83% of school-age Native American children were enrolled in boarding schools, where a government report found they were malnourished, overworked, harshly punished and poorly educated. As boarding school attendance increased into the 1960s and 70s – peaking at 60,000 in 1973 – the US government rolled out another program, called the Indian Adoption Project. It ended up placing 395 Native American children from western states with white families in the midwest and east coast.
By the 1970s, data showed that 25% to 35% of Native children had been removed from their families during the boarding school era, leading to the passage of the Indian Child Welfare Act in 1978. According to the law, states are required to follow protocols when handling certain custody cases involving a Native child, including involving the tribe in the proceedings. Perhaps most notably, ICWA also establishes a placement preference system, requiring child welfare agencies to try to keep Native children within their communities – by placing them, for example, with extended family or with a foster family in their own tribe – to ensure that they do not lose ties to their heritage.
“I call it a remedial statute because it has been the US government’s policy for hundreds of years to destroy the Native American family,” said Angelique EagleWoman (Sisseton Wahpeton Oyate), director of the Native American Law and Sovereignty Institute at the Mitchell Hamline School of Law and one of 30 professors of American Indian law who filed an amicus brief with the supreme court in support of ICWA.
Despite ICWA’s existence, the law has often gone unenforced. That’s in part because there is no federal oversight agency monitoring compliance. Although the Bureau of Indian Affairs released guidelines designed to improve enforcement in 2016, tribal officials say that state welfare agencies regarded them as suggestions that were not legally binding.
As a result of these gaps, in 2016, a 10-month-old Navajo and Cherokee boy was fostered by a white Texas couple, Chad and Jennifer Brackeen, who ultimately adopted him. When the Navajo Nation was alerted to the case and stepped in to place the child with a Navajo family, the Brackeens sued.
The questions the court will consider as it hears Brackeen v Haaland are twofold: whether ICWA discriminates on the basis of race and whether the law supersedes states’ rights to control child custody placements. The Brackeens and their supporters argue that ICWA violates the constitution’s equal protection clause, discriminating against them as a white family, and imposes unlawful requirements on states. The federal government and Native advocates say that Congress may enact laws that apply to states in order to uphold its treaty obligations, and that Native Americans belong to a political class based on their sovereign status, not a racial group.
With this supreme court showing willingness to upend long-held precedent, many advocates are worried for the future of the ICWA. In 2013, three justices currently on the court – John Roberts, Samuel Alito and Clarence Thomas – sided with the majority to rule against a Native American father who had given up custody rights before changing his mind. Since then, the court’s conservative majority has grown to six justices, including Amy Coney Barrett who is herself an adoptive parent. But that majority has also been joined by Neil Gorsuch, who has consistently supported tribal sovereignty – even when that’s meant going against the conservative majority – and many legal scholars are hoping that the court will not overturn ICWA because of how doing so would reshape the legal relationship between the federal government and Indian tribes.
“It is very difficult to conceive of the US supreme court reframing the entire relationship with tribal governments and tribal children,” says EagleWoman. “We are starting to heal our communities, and it would be a major setback to genocidal policies for the US supreme court to strike down any of the provisions in the Indian Child Welfare Act.”
A state-based alternative
Many states, including New Mexico, aren’t waiting to see how the court rules. Instead, they’re enshrining ICWA in state law. To date, ten states have codified ICWA – and eight have added provisions to augment it. Native-led coalitions in other states, like Wyoming, have begun working to do the same.
When organizers in New Mexico began working to pass the state’s Indian Family Protection Act, the majority of the 500 Native children in foster care were in non-Native homes, says Jacqueline Yalch (Isleta Pueblo), director of Isleta Pueblo social services and president of the New Mexico Tribal Indian Child Welfare Consortium. Since New Mexico passed its own law in March, she says, that number has fallen.
After Kimora was placed in foster care at age 14, a social worker reached out to her grandfather and helped him secure custody a year later. After five years of feeling separated from her heritage, Kimora moved back to the Jemez Pueblo and began relearning the Jemez language. Through her grandfather, Kimora was also reunited with her mom, who realized exactly how much Kimora had missed out on – like participating in coming of age ceremonies, learning traditional recipes and dancing at celebrations. “There were so many times we could have danced together,” Malisha said. She’s hoping as the risk of the Covid-19 pandemic lessens, they might be able to dance together again next year.
Malisha and Kimora said that advocating for New Mexico’s Indian Family Protection Act was a healing experience. “Our children are our future,” says Malisha. “We have to do whatever we can to protect them.”

shit [I think] you should read: how the gop uses its hatred of young people as political strategy
During the past week – which featured Amazon losing a trillion $ of value, a Texas judge shooting down student debt cancellation, the Canadian pediatric healthcare system on the verge of collapse, ICWA at the Supreme Court, Twitter becoming #ungovernable, and, oh yes, the midterms – I've returned to this piece again and again. Icon and Teen Vogue Politics editor, Lexi McMenamin writes:
"Regardless of who wins or loses on Tuesday, the right is at war with young people, and using that as an avenue to target marginalized communities across the board. If things feel extra bad right now, it’s because, unfortunately, they are."
Frankly, someone finally just coming out and saying it, was cathartic. Things are bad, and even though the midterms results are not as bad as the fear-mongering centrists told us they would be, these problems are not going anywhere. Gen Z voters, tireless organizers, and strategists have bought us some time.
And it is those same Gen Zers that the Right is at war with. In the piece, McMenamin points out that Republicans made their hatred of trans youth and so-called "Critical Race Theory" in school curriculum central to their political strategy, this term.
Right-wingers have two (very very very connected) goals here: consolidate power (turns out that was a flop) and privatization. Conservatives are skeptical of publicly administrated services that operate for goals other than profit. They want to make it absolutely hellish to be an abortion provider, teacher, doctor or nurse to trans kids... the list goes on and on. They want public school teachers, administrators, and school librarians so relentlessly policed and afraid of getting harassed and doxxed that they self-censor, or find a new job. They want doctors and nurses in public hospitals overworked and underpaid so that they opt to work for private ones. They want private schools, private prisons, private transportation systems and infrastructure projects, completely unrestricted drilling rights on formally "public" lands, and privatized health-care.
Think Twitter this week - chaos driven by the unhinged pursuit of profit and growth, by people who don't understand nor care about the product they offer/people they serve. Imagine that at your school. Or the hospital, the next time you need care.
One population of youth targeted by the far-Right that McMenamin does not mention - but definitely fits their thesis - is Native youth. This week SCOTUS heard arguments alleging that ICWA (the Indigenous Child-Welfare Act, usually pronounced ick-waa) discriminates against white adoptive parents on the basis of race. ICWA mandates that Native kin and families be given priority when looking to provide homes for Native kids.
This case is not about "race" - or at least, not in the way we usually think about it. Indigenous people have a unique relationship with the United States, because they were here first. These relationships are governed by treaties, just like any other relationship the US has with another state - yes! Indigenous nations, are, by definition, states.
According to these treaties - agreements that are in some cases older than the US itself - Indigenous nations have the right to a say over their children and in who gets to adopt them. (Again, just as any other nation, think Canada, China, or El Salvador would have the right to do.)
But, just because treaties Indigenous nations have agreements with the US, that does not mean that government (federal, state, or otherwise) have always recognized/or abided by them. ICWA was put in place in the late 70s to prevent states (who usually operate "child welfare" systems) from stealing Indigenous children and allowing them to be adopted by white parents.
Because the right to determine who is or is not a citizen is basically what makes a nation state a nation state, this case is a poorly concealed attempt to undermine Indigenous nations' ability to enact their sovereignty. For more about this, I strongly recommend listening Rebecca Nagle's incredible podcast "This Land":
In the podcast, Nagle lays out how the legal challenges to ICWA have been a coordinated effort by the Republican Right to undermine Indigenous sovereignty. But why? Simply because they are cartoonishly evil? Well, yeah. But specifically because – and this is where we connect to McMenamin's analysis – yes, you guessed it. Profits are the line. Nagle reports that if ICWA goes down, and federal Indian law with it, that could imperil tribal gaming rights. (Trump, specifically, has a fixation with tribal gaming rights, and the reason is quite obvious: it's a 30 billion dollar industry. That's 30 billion dollars that are not being spent in his casinos and generated under different regulations.) The oil and gas industry also stands to gain if SCOTUS deals a blow to federal Indian law. Indigenous people manage about 2% of land in the US, but that land contains approximately one third of fossil fuel reserves – worth about 1.5 trillion dollars, Nagle reports.
Again we see marginalized young people, in this case, often very very young children, sacrificed by the Far-Right for its political and economic interests. In episode 5, "Trojan Horse," of "This Land," Nagle describes what it was like to uncover the connection between legal challenges to ICWA and conservative funders keen to consolidate power:
"As a Native journalist, this was almost worse than uncovering some plot to undo tribal sovereignty, because it means that this attack on ICWA, where the stakes are so high for Native families and tribes, is just collateral damage in a bigger conservative agenda."
(Seriously, you should go listen to "This Land." The above summary is absolutely unworthy of Nagle's impeccable reporting.)
We won't know the outcome of ICWA for several months, nor what the strategy should be to hold newly-elected officials accountable. But, what went down on Twitter this week has given me a modicum of hope. The creative hijinks that ensued demonstrated that it is possible to interrupt, delay, antagonize and resist efforts to strip our beloved spaces of value. When the same interests come for our in-person communities, and neighboring ones, may we do the same.
