DCCPA, azaz Digital Commodities "Consumer Protection" Act
Szeretnék megosztani veletek egy a Kongresszusnak benyújtott törvényjavaslatot Debbie Stabenow, John Boozman, John Thune és Cory Booker szenátorok közreműködésével, akik mind nagy nyertesei voltak az FTX biznisznek. Nem véletlen ugyanis, hogy maga Sam Bankman-Fried is dolgozott a DCCPA-n.
Miért problematikus ez a törvénytervezet?
Nézzük meg közelebbről:
Először is a törvényjavaslat kizárná a SEC-et a kriptokereskedelem felügyeletéből.
Másodszor: a törvényjavaslat megkövetelné, hogy a kriptókereskedelem a Amerikai Határidős Árutőzsde Felügyelet (tov. CFTC) által meghatározott CeFi-okon keresztül történjen.
Harmadszor: a törvényjavaslat értelmében a közvetítőknek, vagy "kriptobankoknak" (Binance, FTX, stb.) jogosultságuk van a saját maguk által végzett határidős ügyleteik hitelesítésére. Az elszámolás és a kiegyenlítés teljes mértékben az adott cég belső feladata lenne bármilyen szabályozó szerv felügyelete nélkül. Valóságos Paradicsom a jelen és a jövő SBF-jei számára...
A törvényjavaslat tehát hatalmat ad a CFTC számára a spot digital commodity piac felett, amellyel eddig csak a derivatív piac felett rendelkezett.
Jól lehet, a dokumentum nem definiálja a "digital commodity" (digitális árupiaci termék) fogalmát, vagy a megkülönböztetés elvét, amely által egyes tokenekről kijelenthető, hogy ezen kategóriába essenek, vagy sem.
Sőt mi több, a CFTC már elismerte a Bitcoint és az Ethereumot digitális árupiaci terméknek törvényalkotás, a fogalom pontos definiálása nélkül. (Korábban Gensler, "a bankok ősellensége", ex-Goldman-es is csak a Bitcoinra használta ezt a fogalmat.)
Így a törvényjavaslat továbbra sem nyújt információt a tokenizált projekteken dolgozó cégek számára, hogy tokenjeik árupiaci termékeknek, értékpapíroknak, vagy netán egyiknek sem számítanak.
Summa Summarum: ha ezt a tervezetet elfogadja a Kongresszus, az megöli a DeFi-t. Jól lehet, a szöveg konkrétan nem említi a DeFi-t, azonban értelmében a DeFi projektek tekinthetőek "digitális árucikk platformoknak", a DEX-ek pedig "kereskedési létesítményeknek", minthogy lehetővé teszik a digitális árupiaci termékek kereskedésének végrehajtását. S minthogy központi szereplőket akar a kereskedések középpontjába állítani, ezzel a DeFi lényegét nyírja ki.
Például: a törvényjavaslat megköveteli a DEX-ektől, hogy vészhelyzet esetén különleges jogkör keretében likvidálhasson, illetve átruházhasson pozíciókat, valamint felfüggeszthesse a kereskedést meghatározott árupiaci termékek esetében, a SEC-kel való egyeztetés illetve együttműködés esetén.
A tövényjavaslat megköveteli, hogy a minden digitális árupiaci terméket mozgató platform rendelkezzék CCO-val, azaz "minőségbiztosítási vezetővel", aki rendszeresen jelent a platform SO-jának, azaz "vezető tisztségviselőjének", s felelősséggel tartozik a platform törvénnyel és a CFTC által előírt szabályokkal való megfeleltetéséért.
A törvényjavalat egy olyan struktúrát követel meg, amely kizárja annak koncepcióját, hogy egy okosszerződéses rendszer olyan decentralizált infrastruktúrát működtethessen, amely kevéssé vagy egyáltalán nem függ emberi aktivitástól.
A törvényjavaslat továbbá lehetővé teszi a CFTC számára, hogy díjat számítson fel a platformok számára az új regisztrációs követelmények kifizetése és a kereskedés felügyelete érdekében. A díj mértékét persze a bíróságok nem vizsgálhatják felül.
Továbbá a törvényjavaslat megköveteli, hogy a kereskedési létesítmények megfeleljenek az „alapelveknek”, amelyek magukban foglalják a „ügyletek végrehajtásának központosított piacának” biztosítását.
Ezen törvény bevezetése olyan helyzetbe hozná a DeFi-t, hogy a projektek saját tokenjei tulajdonképpen "értékpapírosítódnának".
Érdekes, hogy mennyire ellentétes a CFTC korábbi megnyilatkozásaival. Berkovitz, a CFTC biztosa, például úgy nyilatkozott, hogy "CFTC regs are made for a different world than DeFi", illetve "[the regulations] are based on an intermediation model".
Ez a törvényjavaslat csupán az olyan platformokra lehet értelmes, amelyek már eleve rendelkeznek a hagyományos közbenső szereplőkkel. Ekképpen lényegében megsemmisíti a DeFi-t, míg a CeFi-t különböző előnyökhöz juttatja. A CEX-ek további nagy előnye, hogy sok ideje együtt működnek a szabályozó szervekkel, és olyan konstrukciókat dolgozhatnak ki velük, amelyek mindkét fél számára előnyösek.
Csak a kellően nagy, és jól finanszírozott már meglévő piaci DeFi szereplők fogják tudni túlélni ezt.
Minthogy magától érthetődő, hogy a törvényjavaslat tulajdonképpen ezen ponzi-sémákra épülő cégeket igyekszik validálni és olyan keretek közé vonni, amely a bankok számára áttekinthetőbb, az FTX összeomlása (amely SBF-el nagy támogatója, és egyik fő alakja a DCCPA-nak) aggályokat és megosztást keltett a politikusok között.
Azonban, ahogy az indulatok szépen lassan csitulnak (hála a Bloomberg, Wall Street Journal, Reuters és társaik áldozatos munkájának), Stabenow és Boozman szenátorok nyomására valójában továbbra is terítéken maradt és a tervezet szerint decemberben elbírálás alá kerülhet. (Na persze nem fog, annál lassabban őrölnek a CEX-ek malmai...)
Ennek megfelelően a CEX-ek neki kezdtek kitakarítani maguknál.
A Coinbase bejelentette, hogy nem támogatja tovább néhány coin, köztük az XRP-t sem a Coinbase Wallet-en. Sugallva, hogy a per feltehetően az XRP értékpapírosításával fog végződni. A mindig csendben a topon lévő Kraken is hasonló lépéseket tesz.
A Binance is visszalépett attól a tervétől, hogy kimenti az FTX-et, valamint a Bali-szigeteki G20 meetingen a szabályozásokat sürgette.
Avagy gondoljátok, hogy a BNB több mint tízszerezése a BTC ellenében 2021. óta konstans csőkkenő volumennel véletlen lenne?
FTT (FTX), SOL (Alameda), AVAX (Three Arrow Cap.) és a LUNA ugyanilyen jeleket küldtek, igaz a BNB kereslete jóval stabilabb és az utilitása is komplexebb. Azonban leleplezi a nagytakarítást.

बुधवार को जब बिल गेट्स के ट्विटर अकॉउंट से एक ट्वीट किया गया की - "हर कोई मुझसे समाज को कुछ वापस लौटाने के लिए कहता रहा है, अब वो समय आ गया, आप मुझे एक हज़ार डॉलर भेजिए, मैं आपको दो हज़ार डॉलर वापस भेजूंगा"| बाद में पता चला की बिल गेट्स के ट्विटर अकाउंट को हैक कर लिया गया है साथ में अमेरिका के कई प्रसिद्ध हस्तियों का ट्विटर अकाउंट हैक हो चूका था | उसमे अमेज़ॉन के ओनर जेफ़ बेज़ोस , एलन मस्क, किम कारदर्शियां , पूर्व राष्ट्रपति बराक ओबामा और डेमोक्रेटिक पार्टी के राष्ट्रपति पद के उम्मीदवार जो बाइडन भी शामिल थे | सबसे खास बात अकाउंट उन्ही के हैक हुए जिनके के फ़ॉलोअर्स बहुत ज्यादा है | कह सकते है की ये ट्विटर की चूक थी और तो और इसका पता भी 4 घंटे बाद पता चला | हैकेरो ने तब तक बहुत बिटकॉइन कमा लिए थे |
बिटकॉइन स्कैम-
कह ये भी सकते है की ये एक बिटकॉइन स्कैम था और वो कम से कम समय ज्यादा से ज्यादा पैसे कमाना चाहते है | इसीलिए इस तरह के ट्वीट करके उन्होंने केवल 30 मिनट्स का समय दिया था | और जैसे ही ट्विटर को पता चला उसने सब प्र���िद्ध लोगों के अकाउंट कुछ समय के लिए बंद कर दिए | अगर आप बिटकॉइन के बारे में नहीं जानते है तो आपको बता दे ये एक क्रिप्टो करेंसी है जैसे भारत की करेंसी रूपए है और अमेरिका की डॉलर है उसी तरह ये एक वर्चुअल करेंसी है | बहुत देशों ने इसपे बैन लगा रखा है | क्योकि ये बैंकों या नियंतरण में नहीं होती है |क्रिप्टो करेंसी के लिए कोई नियामक संस्था नहीं है, इसलिए नोटबंदी या करेंसी के अवमूल्यन जैसी स्थितियों का इस पर कोई असर नहीं पड़ता|ट्विटर के सीईओ जैक डॉर्सी को कहना पड़ा है कि 'ये ट्विटर के लिए एक मुश्किल दिन है. जो हुआ है उसे देखकर बहुत बुरा फ़ील हो रहा है'
