intentionally mislabelling behaviour and narrowing down the scope of what "counts" as abuse is also an extension of abuse tactics btw.
saying you were "just selfish" or "just slobbish" or "just disrespectful" while the physical harm was allowed to be called out of line, is part of the abuse.
narrowing down the scope of what counts, and what the abuser can be labelled as responsible for, is just another tactic to delegitimise the victims claims and further make them feel like it wasnt "that bad" .

genuinely one of the worst things that’s happened to television in the last few years (exacerbated by streaming services) is death of Filler. going from 20 episodes to 8 because “we didn’t really need that episode where the main characters went to the beach right? it had no long lasting effect” but we DID!!! we needed to see how they act without the Big Bad Plot and to establish the dynamics between the characters and lay in the sun (do they forget sunscreen? how do they react to a thieving seagull? do they get buried in the sand or do they do the burying?). the plot isn’t everything. the action doesn’t hit as hard without the quiet moments. give us character development and our little scenes back

when it comes to cellbit suing twitter and everything, having an existing defamation case he already won would be good to refer to if hes gonna sue sasa specifically for defamation in terms of evidencing, right? ill be honest i dont know a whole lot about legal strategy but i imagine taking her to court for both abuse and defamation is the goal and having a case in which its already been proven that the harassment has damaged his career could be really important because after that his team just has to draw a clear connection between the harassment and sasa. idk though im not a lawyer much less a brazilian lawyer lol, do you mind weighing in? what do you think the strategy is here?
this is SUCH a good question so like. yes but also no it depends on how they argue it and on the judge imo
if he wins the lawsuit against the twitter people and proves that the harassment was awful and everything that is suuuch a strong argument to use in a lawsuit against his ex. like see they’ve recognized that this harassment affected my life a lot and really negatively and you started it
however. she could argue that she never asked people to harass him, or that she only said his name a couple of times within all the accusations, and that’s,,,, true. like, she implied VERY HEAVILY that it was him and i think (hope) that that’s enough, buttt it can also depend on how good HER lawyer is.
there IS a very clear connection between her actions and the harassment, but there’s the matter of intent. she can say she was just venting online, that she never asked people to harass him, that she tried to keep from talking about it but people kept bringing it up etc etc.
i think he still has a very strong case of she implied VERY hard that it was him and even straight up said it was him (the SA accusation quoted a tweet that said his name directly), and how more than once she talked about how awful it was that people still supported him and how they should take her side (i was a cellbit follower back in 2017/2018 it was THE TRENCHES i remember it all). at the end of the day, any judge that actually looks at the entire situation would be able to tell that, well, her side of the story is kinda iffy. no proof, just words, bringing it up whenever he’s getting more traction than usual, coming up with new, worse accusations every time but never taking him to court. saying she doesn’t want to be related to it or to him anymore and yet bringing it up at every opportunity after seven years.
so yes i think winning the lawsuit against twitter/the twitter accounts is a VERY good precedent for when he sues sasa. there are good arguments she can make for herself, but i think, at the end of the day, that if he really shows up with all the proof of what she’s done and the damage it caused, the chances of her winning are less than likely.
unless, of course, she has a bunch of proof we don’t know about. but she’s “exposed” him thousands of times without ever showing any of it, so, personally, i sorta doubt it.

hi thanks for your explainer posts on the legal stuff, they're super interesting! i'm currently studying for the exam you have to take to get into US law schools (since theyre graduate programs here unlike in most places where law is an undergraduate degree) so its really interesting to learn a bit about how the law functions differently in other places!
one thing i'm curious about -- when i first saw the info about cellbit being able to get the twitter info for these accounts, i assumed that he wasn't actually going to go through with suing ALL of them, and it would be more likely that most of them would simply get some sort of cease-and-desist letter instead, with maybe just a couple having full legal processes to use them as examples. However, I saw people on twitter saying that the process is actually a lot more simple than i had assumed and also takes place mostly online, so suing all of them would actually be more realistic than it sounds. do you know anything about that? how likely do you think it is that he actually sues all of these people (and also the other batches of accounts that probably just aren't public yet that hes also gonna go after later lol)

yes it is a LOT more simple than that. he wouldn’t need to sue them individually, and in brazil nowadays we do a LOT if not almost all of court/lawsuit work through the internet. mediation meetings are done through zoom. oral sustentation as well. it’s preeeetty chill
if he wants to, i’m absolutely sure he can sue all of them at once pretty easily. it depends on what his strategy is tho. i think sending cease-and-desist letters could also be a good call and probably way easier than suing hundreds of people, because even tho it’s simpler than it sounds, it’s still fucking hard /lh
even tho the crimes committed are basically the same, the degree of fucked up shit said throughout the many accounts and tweets varies quite a bit, so even tho he could sue everyone in the same lawsuit, it would still be 😭😭😭 a MESS and the judge might think the situations are too different bc of that varying degree and ask him to do different lawsuits anyway. so, like, how worth it would it be?
i don’t know how likely it is for him to sue everyone because that depends on him and his lawyer and what they think will work best, but i think he did the most important bit already — which was getting twitter to delete all the tweets, which they already have (they actually turned in to court with all the proof that they deleted everything like, this week, iirc). if he wants to sue everyone, he can, but i think he also can just sue the worst ones and that’d be wayyy easier. there’s also the whole discussion on whether or not he can sue the foreigners. so while he technically could sue everyone, can he sue the non-brazilians? the judge still has to decide that
so yes like technically he can and if he really wants to drive home the point of “you’re not free of consequences for what you say on the internet” he def should, but i think it depends on his strategy here.

I dont like they brought up forever as if they're on the same level, and the other things I don't agree with, but if there's proof cellbit made jokes that were pediphilic/nazi like (as in rascist) would it be defamation them saying he did that? they aren't saying he himself is a pedophile or a nazi, just what he said was pedophile/nazi rhetoric. apology if this ask is insensitive in any way

liiiike i don’t really know because i personally haven’t seen proof that he’s said stuff like that (and if there isn’t any, yes that’s defamation) but even if there is ive heard an overwhelming amount of people (even the ones accusing him of saying these things) say that these tweets were made over 10 years ago.
you can’t even sue someone for something done over 10 years ago in brazil, thats the deadline for something to go under “prescrição”, which means you took so long to say something that it’s basically not possible to ask for it in court anymore.
even if they’re not saying he himself is a pedophile/racist (and some people are), pedophilia and racism (racist speech also, pedophilia jokes like what people are accusing him of no) are crimes.
if there’s proof then no it’s not calúnia, butttt im not sure if it’d be difamação? there’s a lot of technicalities to it and sadly its not my main path of study so i wouldn’t know BUT if i have time this week i’ll try to do research on it and get back to you anon!!!

does brazil have a differentiation between criminal and civil courts the same way united states courts do? i know here its common in cases like this to launch both a civil case (much easier to prove, but iirc it doesnt get added to the persons criminal record & prison time isnt possible) and a criminal case (harder to prove, but a broader range of punishments are possible) to overwhelm the opposition essentially. this is just out of curiosity as a fellow Law Enjoyer, hope ur having a good evening!
we actually have a bunch of different courts!!! civil, criminal, administrative, for companies, for worker’s laws etc etc etc. depends on how big the “foro”/“comarca” is. that’s the region the court works for. there’s a lot of other technicalities there but that’s the big overall of it /lh
it’s also normal here for people to start actions in both criminal and civil courts, but as far as i know cellbit launched only a civil action. the part about proof applies here as well, but civil conviction leads to a MUCH broader range than criminal. if you’re convicted in a criminal court you either pay a fee, go to jail, go to home jail (idk the word of this in english you stay in your house and can’t leave)… restriction orders are also gotten from criminal courts. there’s probably more stuff but 😭😭😭 i know very little of criminal law i work in civil/companies and it’s what i’ve focused most of my studies on so i don’t know much more than the basics, even tho i think it’s really really interesting
for civil there are SO MANY POSSIBLE PUNISHMENTS. they can go and sell your fucking house. they can make you close a business. they can take away your credit card. they can add you to the people in debt national record. they can make you go to what’s called civil jail (it’s temporary it’s just a DO YOUR SHIT BITCH tactic). they can make you give the other person stuff. they can take your belongings. they can make you pay a bunch of money. so so many options.
basically, in criminal law the punishment is more boo hoo you did this awful thing now you’re paying for it within the law’s punishments!
in civil law the judge can CREATE punishments if they want to. it’s like, if you’re convicted in criminal law, ANYTHING can be done to get you to comply with the obligation (like, paying damages, child support, any shit like that) that was created from that conviction.
